近年來我(wo)國電(dian)(dian)子(zi)(zi)商(shang)務(wu)(wu)發(fa)展(zhan)迅猛,不(bu)僅創(chuang)(chuang)造(zao)(zao)了新(xin)的(de)消(xiao)費需求(qiu),引(yin)發(fa)了新(xin)的(de)投資(zi)熱潮,開辟(pi)了就業增收新(xin)渠道,為大眾創(chuang)(chuang)業、萬眾創(chuang)(chuang)新(xin)提(ti)供了新(xin)空間,而且電(dian)(dian)子(zi)(zi)商(shang)務(wu)(wu)正加速與(yu)(yu)制(zhi)造(zao)(zao)業融合,推動(dong)(dong)(dong)服務(wu)(wu)業轉型升級,催生(sheng)新(xin)興業態(tai),成(cheng)(cheng)為提(ti)供公(gong)共產品、公(gong)共服務(wu)(wu)的(de)新(xin)力量,成(cheng)(cheng)為經濟(ji)發(fa)展(zhan)新(xin)的(de)原動(dong)(dong)(dong)力。與(yu)(yu)此同時,電(dian)(dian)子(zi)(zi)商(shang)務(wu)(wu)發(fa)展(zhan)面臨管理方式不(bu)適應、誠信體系(xi)不(bu)健全、市場秩序不(bu)規范等問題,亟需采取措(cuo)施(shi)予以解決(jue)。當前(qian),我(wo)國已進(jin)入全面建成(cheng)(cheng)小康社會的(de)決(jue)定性階段,為減少束縛電(dian)(dian)子(zi)(zi)商(shang)務(wu)(wu)發(fa)展(zhan)的(de)機制(zhi)體制(zhi)障礙(ai),進(jin)一步(bu)發(fa)揮電(dian)(dian)子(zi)(zi)商(shang)務(wu)(wu)在培育經濟(ji)新(xin)動(dong)(dong)(dong)力,打造(zao)(zao)“雙引(yin)擎(qing)”、實現(xian)“雙目標(biao)”等方面的(de)重要作用,現(xian)提(ti)出以下(xia)意見:
一、指導思想(xiang)、基(ji)本原則和(he)主要目標
(一(yi))指導(dao)思想。全面貫(guan)徹(che)黨(dang)(dang)的十八大和十八屆二中、三中、四中全會精神,按照黨(dang)(dang)中央、國(guo)務(wu)(wu)院決策部署,堅持依靠改革推動(dong)科學發展(zhan),主動(dong)適應和引領經濟(ji)發展(zhan)新常(chang)態,著(zhu)力(li)解決電(dian)(dian)子(zi)商務(wu)(wu)發展(zhan)中的深層(ceng)次矛盾和重大問(wen)題(ti),大力(li)推進政策創(chuang)(chuang)新、管理創(chuang)(chuang)新和服務(wu)(wu)創(chuang)(chuang)新,加(jia)快建立開放、規范、誠信(xin)、安全的電(dian)(dian)子(zi)商務(wu)(wu)發展(zhan)環境,進一(yi)步激發電(dian)(dian)子(zi)商務(wu)(wu)創(chuang)(chuang)新動(dong)力(li)、創(chuang)(chuang)造(zao)潛力(li)、創(chuang)(chuang)業活力(li),加(jia)速推動(dong)經濟(ji)結構戰略性調整,實現經濟(ji)提質增效升級(ji)。
(二)基本(ben)原則。一是(shi)積(ji)極推動(dong)(dong)。主(zhu)動(dong)(dong)作為(wei)、支持(chi)發(fa)(fa)展(zhan)。積(ji)極協調解決(jue)電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)發(fa)(fa)展(zhan)中(zhong)的(de)各種矛盾與問題。在政(zheng)府資(zi)源(yuan)開(kai)放、網絡(luo)安全保障、投融資(zi)支持(chi)、基礎設施和誠信體系建設等(deng)方面(mian)加(jia)大服務(wu)力度。推進(jin)電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)企(qi)業(ye)(ye)稅費合(he)理化(hua),減(jian)輕企(qi)業(ye)(ye)負擔。進(jin)一步(bu)(bu)釋(shi)放電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)發(fa)(fa)展(zhan)潛力,提升(sheng)電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)創(chuang)新發(fa)(fa)展(zhan)水平。二是(shi)逐(zhu)步(bu)(bu)規(gui)范。簡政(zheng)放權、放管結合(he)。法無禁止(zhi)的(de)市(shi)場(chang)主(zhu)體即(ji)可為(wei),法未授(shou)權的(de)政(zheng)府部門(men)不能(neng)為(wei),最(zui)大限(xian)度減(jian)少對(dui)電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)市(shi)場(chang)的(de)行政(zheng)干預。在放寬(kuan)市(shi)場(chang)準入的(de)同(tong)時,要在發(fa)(fa)展(zhan)中(zhong)逐(zhu)步(bu)(bu)規(gui)范市(shi)場(chang)秩序,營造公平競爭(zheng)的(de)創(chuang)業(ye)(ye)發(fa)(fa)展(zhan)環境,進(jin)一步(bu)(bu)激發(fa)(fa)社會創(chuang)業(ye)(ye)活(huo)力,拓(tuo)寬(kuan)電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)創(chuang)新發(fa)(fa)展(zhan)領域。三(san)是(shi)加(jia)強(qiang)(qiang)(qiang)引(yin)導(dao)(dao)。把(ba)握趨勢、因勢利導(dao)(dao)。加(jia)強(qiang)(qiang)(qiang)對(dui)電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)發(fa)(fa)展(zhan)中(zhong)前瞻(zhan)性(xing)、苗(miao)頭性(xing)、傾向(xiang)性(xing)問題的(de)研(yan)究,及時在商(shang)(shang)(shang)業(ye)(ye)模式創(chuang)新、關(guan)鍵技術研(yan)發(fa)(fa)、國際市(shi)場(chang)開(kai)拓(tuo)等(deng)方面(mian)加(jia)大對(dui)企(qi)業(ye)(ye)的(de)支持(chi)引(yin)導(dao)(dao)力度,引(yin)領電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)向(xiang)打造“雙引(yin)擎”、實現“雙目標(biao)”發(fa)(fa)展(zhan),進(jin)一步(bu)(bu)增強(qiang)(qiang)(qiang)企(qi)業(ye)(ye)的(de)創(chuang)新動(dong)(dong)力,加(jia)速電(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)(shang)務(wu)創(chuang)新發(fa)(fa)展(zhan)步(bu)(bu)伐。
(三)主要(yao)目標。到(dao)2020年,統一開放、競爭有序、誠信守(shou)法(fa)、安全(quan)可靠的電子商務(wu)大市場基本(ben)建成。電子商務(wu)與其他產業深度融合,成為(wei)促進創業、穩定就業、改(gai)善民(min)生服務(wu)的重(zhong)要(yao)平臺,對工業化、信息化、城鎮化、農業現代(dai)化同步發展起(qi)到(dao)關(guan)鍵性作用。
二(er)、營造寬(kuan)松發展環境
(四)降低準入(ru)門檻。全面(mian)清理(li)電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)領(ling)(ling)域(yu)(yu)現有前置(zhi)審(shen)(shen)批(pi)事(shi)項,無法律法規依據(ju)的(de)一律取(qu)消,嚴禁違法設(she)定行(xing)政(zheng)許可、增加行(xing)政(zheng)許可條件和程(cheng)序(xu)。(國(guo)務(wu)院審(shen)(shen)改(gai)(gai)辦,有關部門按職(zhi)責(ze)分工(gong)分別(bie)負責(ze))進(jin)一步簡(jian)化注冊資本(ben)登記,深入(ru)推進(jin)電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)領(ling)(ling)域(yu)(yu)由“先證后(hou)照(zhao)”改(gai)(gai)為“先照(zhao)后(hou)證”改(gai)(gai)革。(工(gong)商(shang)(shang)總局、中央編辦)落實《注冊資本(ben)登記制(zhi)(zhi)度改(gai)(gai)革方(fang)案》,放(fang)寬電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)市(shi)場主體住所(經營場所)登記條件,完(wan)善相關管理(li)措施。(省級人民政(zheng)府)推進(jin)對快(kuai)(kuai)遞企業設(she)立非法人快(kuai)(kuai)遞末端網點(dian)實施備案制(zhi)(zhi)管理(li)。(郵政(zheng)局)簡(jian)化境(jing)內電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)企業海外上市(shi)審(shen)(shen)批(pi)流(liu)程(cheng),鼓勵電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)領(ling)(ling)域(yu)(yu)的(de)跨(kua)境(jing)人民幣(bi)直接投(tou)資。(發展(zhan)改(gai)(gai)革委、商(shang)(shang)務(wu)部、外匯(hui)局、證監會、人民銀(yin)行(xing))放(fang)開外商(shang)(shang)投(tou)資電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)業務(wu)的(de)外方(fang)持股(gu)比例限制(zhi)(zhi)。(工(gong)業和信息(xi)化部、發展(zhan)改(gai)(gai)革委、商(shang)(shang)務(wu)部)探(tan)索建立能源、鐵路、公共事(shi)業等行(xing)業電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)服務(wu)的(de)市(shi)場化機制(zhi)(zhi)。(有關部門按職(zhi)責(ze)分工(gong)分別(bie)負責(ze))
(五)合(he)理(li)降稅(shui)(shui)減負。從事電(dian)子商務(wu)(wu)(wu)(wu)活動(dong)的企(qi)業,經認(ren)定為(wei)高(gao)新(xin)技術企(qi)業的,依(yi)(yi)法(fa)享受高(gao)新(xin)技術企(qi)業相關(guan)優惠(hui)政(zheng)(zheng)策,小微企(qi)業依(yi)(yi)法(fa)享受稅(shui)(shui)收(shou)優惠(hui)政(zheng)(zheng)策。(科技部(bu)(bu)、財政(zheng)(zheng)部(bu)(bu)、稅(shui)(shui)務(wu)(wu)(wu)(wu)總(zong)局(ju))加快推進“營(ying)改增(zeng)”,逐步(bu)將旅游電(dian)子商務(wu)(wu)(wu)(wu)、生活服務(wu)(wu)(wu)(wu)類電(dian)子商務(wu)(wu)(wu)(wu)等相關(guan)行業納(na)入“營(ying)改增(zeng)”范圍(wei)。(財政(zheng)(zheng)部(bu)(bu)、稅(shui)(shui)務(wu)(wu)(wu)(wu)總(zong)局(ju))
(六)加(jia)大(da)金(jin)(jin)融(rong)服務(wu)支持。建立健全適應電子(zi)(zi)商(shang)務(wu)發(fa)展(zhan)(zhan)的(de)多(duo)元化、多(duo)渠(qu)道(dao)投融(rong)資(zi)機(ji)制。(有關部門按職責分(fen)工分(fen)別負責)研究鼓勵符合條(tiao)件的(de)互聯網企(qi)業(ye)在境內上市(shi)等相關政(zheng)策(ce)。(證監會)支持商(shang)業(ye)銀行(xing)、擔保存貨(huo)管理(li)機(ji)構及電子(zi)(zi)商(shang)務(wu)企(qi)業(ye)開(kai)(kai)展(zhan)(zhan)無(wu)形資(zi)產(chan)(chan)、動產(chan)(chan)質(zhi)押等多(duo)種形式(shi)的(de)融(rong)資(zi)服務(wu)。鼓勵商(shang)業(ye)銀行(xing)、商(shang)業(ye)保理(li)機(ji)構、電子(zi)(zi)商(shang)務(wu)企(qi)業(ye)開(kai)(kai)展(zhan)(zhan)供應鏈金(jin)(jin)融(rong)、商(shang)業(ye)保理(li)服務(wu),進一(yi)步拓展(zhan)(zhan)電子(zi)(zi)商(shang)務(wu)企(qi)業(ye)融(rong)資(zi)渠(qu)道(dao)。(人民銀行(xing)、商(shang)務(wu)部)引導和推動創業(ye)投資(zi)基(ji)金(jin)(jin),加(jia)大(da)對(dui)電子(zi)(zi)商(shang)務(wu)初(chu)創企(qi)業(ye)的(de)支持。(發(fa)展(zhan)(zhan)改(gai)革委)
(七)維護(hu)公平競(jing)(jing)爭(zheng)(zheng)。規范電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)市場(chang)競(jing)(jing)爭(zheng)(zheng)行(xing)為(wei)(wei),促(cu)進建立開放、公平、健康的(de)(de)電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)市場(chang)競(jing)(jing)爭(zheng)(zheng)秩序。研(yan)究制定電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)產(chan)(chan)(chan)(chan)品質(zhi)(zhi)量(liang)監(jian)督管理辦法,探索建立風險監(jian)測、網(wang)(wang)(wang)上抽查、源(yuan)頭追溯(su)、屬地(di)查處的(de)(de)電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)產(chan)(chan)(chan)(chan)品質(zhi)(zhi)量(liang)監(jian)督機(ji)制,完(wan)善部(bu)(bu)(bu)門間、區域間監(jian)管信息(xi)共(gong)享和(he)職(zhi)能銜接機(ji)制。依(yi)法打擊網(wang)(wang)(wang)絡虛假宣(xuan)傳、生產(chan)(chan)(chan)(chan)銷(xiao)售(shou)假冒(mao)偽劣產(chan)(chan)(chan)(chan)品、違反(fan)(fan)國家出(chu)口管制法規政策跨境銷(xiao)售(shou)兩用(yong)品和(he)技術、不(bu)(bu)正(zheng)當(dang)競(jing)(jing)爭(zheng)(zheng)等違法行(xing)為(wei)(wei),組織開展電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)產(chan)(chan)(chan)(chan)品質(zhi)(zhi)量(liang)提升行(xing)動,促(cu)進合法、誠(cheng)信經營。(工(gong)商(shang)總局(ju)(ju)、質(zhi)(zhi)檢總局(ju)(ju)、公安部(bu)(bu)(bu)、商(shang)務(wu)(wu)(wu)(wu)(wu)部(bu)(bu)(bu)按職(zhi)責分(fen)(fen)工(gong)分(fen)(fen)別負(fu)責)重點查處達成壟斷(duan)協議和(he)濫(lan)用(yong)市場(chang)支配地(di)位的(de)(de)問題,通過經營者(zhe)集中反(fan)(fan)壟斷(duan)審查,防止(zhi)排除(chu)、限(xian)制市場(chang)競(jing)(jing)爭(zheng)(zheng)的(de)(de)行(xing)為(wei)(wei)。(發(fa)展改(gai)革委(wei)、工(gong)商(shang)總局(ju)(ju)、商(shang)務(wu)(wu)(wu)(wu)(wu)部(bu)(bu)(bu))加強電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)領(ling)域知識產(chan)(chan)(chan)(chan)權保護(hu),研(yan)究進一(yi)步加大(da)網(wang)(wang)(wang)絡商(shang)業(ye)方法領(ling)域發(fa)明專(zhuan)利(li)保護(hu)力度。(工(gong)業(ye)和(he)信息(xi)化部(bu)(bu)(bu)、商(shang)務(wu)(wu)(wu)(wu)(wu)部(bu)(bu)(bu)、海關總署、工(gong)商(shang)總局(ju)(ju)、新聞出(chu)版廣電(dian)(dian)總局(ju)(ju)、知識產(chan)(chan)(chan)(chan)權局(ju)(ju)等部(bu)(bu)(bu)門按職(zhi)責分(fen)(fen)工(gong)分(fen)(fen)別負(fu)責)進一(yi)步加大(da)政府利(li)用(yong)電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)平臺進行(xing)采購的(de)(de)力度。(財政部(bu)(bu)(bu))各級政府部(bu)(bu)(bu)門不(bu)(bu)得通過行(xing)政命令(ling)指定為(wei)(wei)電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)提供(gong)公共(gong)服務(wu)(wu)(wu)(wu)(wu)的(de)(de)供(gong)應商(shang),不(bu)(bu)得濫(lan)用(yong)行(xing)政權力排除(chu)、限(xian)制電(dian)(dian)子商(shang)務(wu)(wu)(wu)(wu)(wu)的(de)(de)競(jing)(jing)爭(zheng)(zheng)。(有關部(bu)(bu)(bu)門按職(zhi)責分(fen)(fen)工(gong)分(fen)(fen)別負(fu)責)
三(san)、促進(jin)就業創業
(八)鼓勵(li)電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)領域就業(ye)(ye)創(chuang)(chuang)(chuang)業(ye)(ye)。把(ba)發展電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)促進就業(ye)(ye)納入各地(di)就業(ye)(ye)發展規(gui)(gui)劃和(he)電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)發展整體(ti)規(gui)(gui)劃。建立電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)就業(ye)(ye)和(he)社會保障指(zhi)標統計制(zhi)度。經(jing)工商(shang)(shang)登記注(zhu)冊的網(wang)絡(luo)商(shang)(shang)戶(hu)從(cong)(cong)業(ye)(ye)人(ren)(ren)員(yuan),同等享受各項(xiang)就業(ye)(ye)創(chuang)(chuang)(chuang)業(ye)(ye)扶(fu)持(chi)(chi)政(zheng)策。未進行工商(shang)(shang)登記注(zhu)冊的網(wang)絡(luo)商(shang)(shang)戶(hu)從(cong)(cong)業(ye)(ye)人(ren)(ren)員(yuan),可(ke)認定為(wei)靈活就業(ye)(ye)人(ren)(ren)員(yuan),享受靈活就業(ye)(ye)人(ren)(ren)員(yuan)扶(fu)持(chi)(chi)政(zheng)策,其中在(zai)網(wang)絡(luo)平臺實名注(zhu)冊、穩(wen)定經(jing)營(ying)且信(xin)譽良(liang)好的網(wang)絡(luo)商(shang)(shang)戶(hu)創(chuang)(chuang)(chuang)業(ye)(ye)者(zhe),可(ke)按規(gui)(gui)定享受小額擔保貸款及(ji)貼息政(zheng)策。支持(chi)(chi)中小微企業(ye)(ye)應用電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)、拓展業(ye)(ye)務(wu)(wu)領域,鼓勵(li)有條(tiao)件的地(di)區(qu)建設(she)電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)創(chuang)(chuang)(chuang)業(ye)(ye)園(yuan)區(qu),指(zhi)導(dao)各類創(chuang)(chuang)(chuang)業(ye)(ye)孵(fu)化基地(di)為(wei)電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)創(chuang)(chuang)(chuang)業(ye)(ye)人(ren)(ren)員(yuan)提供(gong)(gong)場地(di)支持(chi)(chi)和(he)創(chuang)(chuang)(chuang)業(ye)(ye)孵(fu)化服務(wu)(wu)。加強電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)企業(ye)(ye)用工服務(wu)(wu),完善(shan)電(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)人(ren)(ren)才供(gong)(gong)求(qiu)信(xin)息對接機制(zhi)。(人(ren)(ren)力資(zi)源(yuan)社會保障部、工業(ye)(ye)和(he)信(xin)息化部、商(shang)(shang)務(wu)(wu)部、統計局,地(di)方各級人(ren)(ren)民政(zheng)府)
