國有(you)資產監(jian)管大格局的指(zhi)導意見
為深入(ru)貫徹落(luo)實(shi)(shi)黨的十八(ba)大和十八(ba)屆三(san)中(zhong)全會精神,進一步完(wan)善全區國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管體(ti)制(zhi),提(ti)高全區國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管水平,根據《中(zhong)華人民共和國(guo)(guo)企(qi)業國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)法》、《企(qi)業國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)督管理暫行條例》、《地方國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管工(gong)作指(zhi)導(dao)監(jian)(jian)督辦法》(國(guo)(guo)務院國(guo)(guo)資(zi)(zi)委令第25號)等法律(lv)法規,結合實(shi)(shi)際,現就(jiu)加強市(shi)、縣(市(shi)、區,以下簡(jian)稱縣)國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管工(gong)作、加快構建全區國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管大格局,提(ti)出如(ru)下指(zhi)導(dao)意(yi)見。
一、重要意義
市(shi)、縣國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)工作(zuo)(zuo)(zuo)(zuo)(zuo)是(shi)全(quan)區(qu)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)工作(zuo)(zuo)(zuo)(zuo)(zuo)的(de)重(zhong)要(yao)組成部分(fen)(fen)。經過多年(nian)的(de)改革(ge)(ge)發(fa)展,全(quan)區(qu)市(shi)、縣兩級國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)體制機制不(bu)(bu)斷完善,國(guo)(guo)(guo)有(you)(you)經濟(ji)(ji)布局(ju)結(jie)構不(bu)(bu)斷優(you)化,國(guo)(guo)(guo)有(you)(you)企業(ye)規模(mo)質量(liang)不(bu)(bu)斷提升(sheng),市(shi)、縣兩級國(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)企成為推(tui)動本地(di)區(qu)經濟(ji)(ji)社會(hui)發(fa)展的(de)骨干(gan)力量(liang)。但是(shi),部分(fen)(fen)市(shi)、縣面臨著(zhu)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)體制不(bu)(bu)夠(gou)完善、履行(xing)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)出資(zi)人職責不(bu)(bu)夠(gou)到位、國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)工作(zuo)(zuo)(zuo)(zuo)(zuo)進展不(bu)(bu)夠(gou)平(ping)衡(heng)、企業(ye)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)基礎性管(guan)理工作(zuo)(zuo)(zuo)(zuo)(zuo)與形勢任(ren)務(wu)要(yao)求不(bu)(bu)適(shi)應(ying),以及國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)機構與有(you)(you)關部門的(de)關系尚未(wei)(wei)完全(quan)理順、縣級國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)出資(zi)人制度尚未(wei)(wei)完全(quan)落實、各級國(guo)(guo)(guo)資(zi)聯合互動的(de)工作(zuo)(zuo)(zuo)(zuo)(zuo)機制尚未(wei)(wei)真(zhen)正建(jian)立等亟待解(jie)決的(de)問題,影(ying)響國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)工作(zuo)(zuo)(zuo)(zuo)(zuo)和(he)國(guo)(guo)(guo)有(you)(you)企業(ye)改革(ge)(ge)的(de)深入推(tui)進,需要(yao)引起高(gao)度重(zhong)視。
上級(ji)國有(you)(you)(you)(you)(you)(you)資產(chan)監(jian)(jian)管(guan)機構對下(xia)級(ji)政(zheng)府國有(you)(you)(you)(you)(you)(you)資產(chan)監(jian)(jian)管(guan)工(gong)作(zuo)進(jin)行指導監(jian)(jian)督(du),是維(wei)護國有(you)(you)(you)(you)(you)(you)資產(chan)“國家(jia)所(suo)有(you)(you)(you)(you)(you)(you)、分級(ji)代表”的(de)一項重(zhong)要(yao)(yao)制度安排(pai)。加強(qiang)(qiang)指導監(jian)(jian)督(du)工(gong)作(zuo),是加快(kuai)完善國有(you)(you)(you)(you)(you)(you)資產(chan)監(jian)(jian)管(guan)體(ti)制和制度的(de)內在(zai)要(yao)(yao)求,也是進(jin)一步加強(qiang)(qiang)國有(you)(you)(you)(you)(you)(you)資產(chan)監(jian)(jian)管(guan)機構建設(she)的(de)重(zhong)要(yao)(yao)措施,對于切實解決好(hao)市、縣(xian)國有(you)(you)(you)(you)(you)(you)資產(chan)監(jian)(jian)管(guan)工(gong)作(zuo)存在(zai)的(de)不到位、不平衡、不適應等問題,提高(gao)國有(you)(you)(you)(you)(you)(you)資產(chan)監(jian)(jian)管(guan)機構履職(zhi)能力,加快(kuai)構建整合協調、開(kai)放合作(zuo)的(de)國有(you)(you)(you)(you)(you)(you)資產(chan)監(jian)(jian)管(guan)大格局(ju),實現(xian)各級(ji)國資融(rong)合發展、聯動發展,更好(hao)地(di)營造國有(you)(you)(you)(you)(you)(you)企業改革(ge)發展的(de)良好(hao)環境,做強(qiang)(qiang)做優國有(you)(you)(you)(you)(you)(you)企業,促進(jin)全區(qu)經濟社會(hui)穩中求進(jin)、穩中向(xiang)好(hao)發展具有(you)(you)(you)(you)(you)(you)十(shi)分重(zhong)要(yao)(yao)的(de)意義。
二、總體要求
市、縣兩級(ji)(ji)政府(fu)要(yao)加強對國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)工作(zuo)的領導(dao)(dao),按照國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)分級(ji)(ji)管(guan)理(li)的原(yuan)則,進(jin)一(yi)步明確國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)的責(ze)任主(zhu)體(ti)。全(quan)(quan)區各級(ji)(ji)國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)機構(gou)(gou)要(yao)在本(ben)級(ji)(ji)黨委、政府(fu)的領導(dao)(dao)下,堅持以(yi)鄧小平(ping)理(li)論、“三個(ge)代表”重要(yao)思想和(he)科學發(fa)展(zhan)(zhan)觀為(wei)指導(dao)(dao),深(shen)入貫徹落實黨的十(shi)八大、十(shi)八屆三中(zhong)全(quan)(quan)會(hui)精(jing)神(shen),緊緊圍(wei)繞推(tui)動國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)上(shang)水(shui)(shui)平(ping)、國(guo)(guo)(guo)(guo)企(qi)發(fa)展(zhan)(zhan)上(shang)臺階的“兩新目標”,以(yi)加強地(di)方國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)機構(gou)(gou)建(jian)設、推(tui)進(jin)經營(ying)性國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)集中(zhong)統一(yi)監(jian)(jian)(jian)管(guan)、強化(hua)(hua)企(qi)業國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)基礎管(guan)理(li)為(wei)重點,按照以(yi)管(guan)資(zi)(zi)(zi)本(ben)為(wei)主(zhu)加強國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)的要(yao)求,充分發(fa)揮國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)本(ben)運營(ying)平(ping)臺作(zuo)用(yong),努(nu)力提高國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)資(zi)(zi)(zi)本(ben)化(hua)(hua)、市場化(hua)(hua)、證券化(hua)(hua)水(shui)(shui)平(ping)。牢固樹立各級(ji)(ji)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)“一(yi)盤棋”的理(li)念(nian),立足“指導(dao)(dao)、溝通、交流、服務”,加快健全(quan)(quan)緊密聯系、深(shen)度融合、有效(xiao)整合的工作(zuo)系統,不斷完(wan)善指導(dao)(dao)監(jian)(jian)(jian)督有效(xiao)、互相支持有力、溝通協調(diao)順暢的工作(zuo)機制,推(tui)動構(gou)(gou)建(jian)國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)大格局,努(nu)力提升國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)機構(gou)(gou)依法履行出資(zi)(zi)(zi)人職責(ze)的能力和(he)水(shui)(shui)平(ping),為(wei)完(wan)善國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)體(ti)制機制、促進(jin)國(guo)(guo)(guo)(guo)有企(qi)業改(gai)革發(fa)展(zhan)(zhan)作(zuo)出新貢獻。
三、基本原則
(一)堅持國(guo)有資(zi)產屬(shu)于國(guo)家所有原則(ze),落實國(guo)有資(zi)產監管責任,保障國(guo)有資(zi)產監管政策法規的貫徹(che)實施(shi)。
(二)堅持各級(ji)政(zheng)府分別代(dai)表國家履行出(chu)(chu)資(zi)人職責(ze)原(yuan)則,各級(ji)國有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機構(gou)應(ying)當根據本級(ji)政(zheng)府授(shou)權,按照(zhao)法定職責(ze)和程(cheng)序指導監(jian)督下(xia)級(ji)國有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機構(gou)的(de)工作(zuo),尊重和維護下(xia)級(ji)國有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機構(gou)的(de)出(chu)(chu)資(zi)人權利,不得代(dai)替或(huo)者干預下(xia)級(ji)國有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機構(gou)履行出(chu)(chu)資(zi)人職責(ze)。
(三(san))堅持政(zheng)企分(fen)開(kai)、政(zheng)資(zi)(zi)分(fen)開(kai)、所(suo)有(you)(you)(you)權和(he)經營權分(fen)離、政(zheng)府的社會公共管(guan)理職(zhi)能與國(guo)有(you)(you)(you)資(zi)(zi)產(chan)出資(zi)(zi)人職(zhi)能分(fen)開(kai)的原則(ze),完善經營性國(guo)有(you)(you)(you)資(zi)(zi)產(chan)監(jian)管(guan)體(ti)制(zhi)機制(zhi),積極探索國(guo)有(you)(you)(you)資(zi)(zi)產(chan)監(jian)管(guan)和(he)運(yun)營的有(you)(you)(you)效途徑和(he)方式(shi)。
(四)堅(jian)持依法合規原則,加強(qiang)分(fen)類(lei)指導,突出監督重點,增強(qiang)地方國有(you)資(zi)產監管工(gong)作的規范性和有(you)效性。
四、重點任務
(一)繼續深(shen)化(hua)(hua)(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革。要認真貫徹(che)落實(shi)黨的十(shi)八大、十(shi)八屆(jie)三(san)中全(quan)(quan)會(hui)、自治(zhi)區(qu)黨委十(shi)屆(jie)四次全(quan)(quan)會(hui)精神,全(quan)(quan)面深(shen)化(hua)(hua)(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革,各市(shi)、縣要相應成立深(shen)化(hua)(hua)(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革領導(dao)小組,負責整體統籌(chou)推進(jin)改革工(gong)作(zuo),研究制定相關方案措施,協調解決存在的問題,全(quan)(quan)力做好本(ben)級政府深(shen)化(hua)(hua)(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革工(gong)作(zuo)。
(二)健全(quan)完善國有資產(chan)監(jian)管(guan)組織體系(xi)。市(shi)、縣政府要(yao)進一(yi)步加強國有資產(chan)監(jian)管(guan)機(ji)構建設,堅持市(shi)級(ji)國資委政府直(zhi)屬特設機(ji)構性(xing)質不變,明確縣級(ji)國有資產(chan)監(jian)管(guan)責任主體,積(ji)極探索符合(he)改(gai)革要(yao)求和(he)本地實際(ji)的國有資產(chan)監(jian)管(guan)有效方式和(he)途徑,努力實現經(jing)營(ying)性(xing)國有資產(chan)監(jian)管(guan)和(he)明確縣級(ji)國資監(jian)管(guan)責任主體的“全(quan)覆(fu)蓋(gai)”。
(三)健全完善國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管制(zhi)(zhi)度(du)(du)體系(xi)。市(shi)、縣國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管機構要依據《中華人(ren)民共和(he)(he)國(guo)(guo)(guo)(guo)企業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)法》和(he)(he)《企業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)督管理(li)暫行(xing)條例》,在國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)出資(zi)(zi)人(ren)制(zhi)(zhi)度(du)(du)、國(guo)(guo)(guo)(guo)家(jia)出資(zi)(zi)企業(ye)制(zhi)(zhi)度(du)(du)和(he)(he)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)統一監(jian)管制(zhi)(zhi)度(du)(du)三大制(zhi)(zhi)度(du)(du)框架下,健全完善本地區具體規章(zhang)制(zhi)(zhi)度(du)(du),形(xing)成監(jian)督有(you)力、管理(li)科學、運作高效的(de)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管制(zhi)(zhi)度(du)(du)體系(xi)。要切實加(jia)強國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管法律、行(xing)政法規和(he)(he)規章(zhang)的(de)執(zhi)行(xing)力度(du)(du),強化監(jian)督檢查,確(que)保各項(xiang)制(zhi)(zhi)度(du)(du)落實到位。
(四)健(jian)全(quan)(quan)完(wan)善(shan)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管工作(zuo)體(ti)系。市、縣國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管機構要深入(ru)探(tan)索(suo)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管工作(zuo)規律,進一(yi)步充實(shi)完(wan)善(shan)以發展戰(zhan)略制(zhi)定、主業(ye)(ye)核定、業(ye)(ye)績考核、薪酬分配、企業(ye)(ye)領導人員任(ren)(ren)(聘(pin))免、財務監(jian)(jian)(jian)督(du)與評價、產(chan)(chan)權管理、監(jian)(jian)(jian)事會監(jian)(jian)(jian)督(du)、風(feng)險管控等為(wei)主線的(de)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管工作(zuo)閉環,加快健(jian)全(quan)(quan)全(quan)(quan)區規則統一(yi)、分類分層(ceng)、權責明確、運轉高(gao)效和(he)規范透明的(de)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管工作(zuo)體(ti)系。建立完(wan)善(shan)經(jing)營(ying)性國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)集中統一(yi)監(jian)(jian)(jian)管制(zhi)度,推進全(quan)(quan)面(mian)實(shi)現(xian)政企分開(kai)、政資(zi)(zi)(zi)(zi)分開(kai)。根據基礎(chu)支(zhi)撐、戰(zhan)略引導、公(gong)益產(chan)(chan)品和(he)服務、一(yi)般(ban)競爭性領域等不(bu)同(tong)功能定位,探(tan)索(suo)實(shi)行(xing)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)分類監(jian)(jian)(jian)管,提(ti)高(gao)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管的(de)針對性有(you)(you)(you)效性,全(quan)(quan)面(mian)落實(shi)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)保值增值責任(ren)(ren)。
(五)健全完善(shan)指(zhi)(zhi)(zhi)導監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)作(zuo)(zuo)(zuo)機制。自治(zhi)區和(he)(he)市(shi)級國(guo)(guo)(guo)有(you)資(zi)產(chan)監(jian)(jian)(jian)管機構(gou)(gou)要嚴格(ge)按(an)照(zhao)《地(di)方國(guo)(guo)(guo)有(you)資(zi)產(chan)監(jian)(jian)(jian)管工(gong)(gong)作(zuo)(zuo)(zuo)指(zhi)(zhi)(zhi)導監(jian)(jian)(jian)督(du)(du)(du)辦法》(國(guo)(guo)(guo)務院國(guo)(guo)(guo)資(zi)委令第25號)的規(gui)定,進(jin)一步明確指(zhi)(zhi)(zhi)導監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)作(zuo)(zuo)(zuo)的主要職(zhi)責和(he)(he)要求,充分發揮好指(zhi)(zhi)(zhi)導監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)作(zuo)(zuo)(zuo)的引(yin)導、規(gui)范、提高和(he)(he)促進(jin)作(zuo)(zuo)(zuo)用(yong)。要加(jia)(jia)快完善(shan)上下聯動、規(gui)范有(you)序(xu)、全面覆蓋的指(zhi)(zhi)(zhi)導監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)作(zuo)(zuo)(zuo)機制,始終堅持指(zhi)(zhi)(zhi)導寓于服務之中,把指(zhi)(zhi)(zhi)導監(jian)(jian)(jian)督(du)(du)(du)下級國(guo)(guo)(guo)有(you)資(zi)產(chan)監(jian)(jian)(jian)管工(gong)(gong)作(zuo)(zuo)(zuo)的重(zhong)點放在(zai)加(jia)(jia)強(qiang)監(jian)(jian)(jian)管機構(gou)(gou)建(jian)設與提高監(jian)(jian)(jian)管機構(gou)(gou)依法履職(zhi)的能力和(he)(he)水平、指(zhi)(zhi)(zhi)導地(di)方國(guo)(guo)(guo)有(you)經(jing)濟布局結構(gou)(gou)調整、指(zhi)(zhi)(zhi)導和(he)(he)支(zhi)持國(guo)(guo)(guo)有(you)企業改革發展、加(jia)(jia)強(qiang)國(guo)(guo)(guo)有(you)資(zi)產(chan)基(ji)礎管理等(deng)重(zhong)點環節上,確保(bao)指(zhi)(zhi)(zhi)導監(jian)(jian)(jian)督(du)(du)(du)及(ji)時(shi)有(you)效。
五、主要措施
(一)切實(shi)加(jia)強組織領(ling)導(dao)。市(shi)(shi)(shi)、縣政府(fu)要(yao)高度重視(shi)國(guo)有資(zi)產(chan)監(jian)管工(gong)(gong)作(zuo)(zuo)(zuo),充分(fen)認識在新形勢(shi)下加(jia)強和完善國(guo)有資(zi)產(chan)監(jian)管工(gong)(gong)作(zuo)(zuo)(zuo)的(de)重要(yao)意義,為(wei)開展監(jian)管工(gong)(gong)作(zuo)(zuo)(zuo)創(chuang)造必要(yao)條件(jian)。市(shi)(shi)(shi)、縣國(guo)有資(zi)產(chan)監(jian)管機構要(yao)把加(jia)強國(guo)資(zi)監(jian)管工(gong)(gong)作(zuo)(zuo)(zuo)列入重要(yao)議事日程,研究制訂切實(shi)可行的(de)工(gong)(gong)作(zuo)(zuo)(zuo)計(ji)劃和實(shi)施方案,落(luo)實(shi)工(gong)(gong)作(zuo)(zuo)(zuo)職責(ze),加(jia)強督促檢(jian)查(cha)。條件(jian)成熟(shu)的(de)市(shi)(shi)(shi)可將對縣級國(guo)有資(zi)產(chan)監(jian)管工(gong)(gong)作(zuo)(zuo)(zuo)列入政府(fu)績效考評范圍。
(二)進一步明確(que)國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)責(ze)任(ren)主體。市、縣(xian)政府要(yao)建立(li)和完善本級國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)機(ji)構(gou),做(zuo)到機(ji)構(gou)、人員、職(zhi)(zhi)能、責(ze)任(ren)“四到位”。國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)數量較大、具(ju)備(bei)條件的(de)(de)縣(xian)應(ying)設立(li)獨(du)(du)立(li)的(de)(de)國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)機(ji)構(gou),暫不具(ju)備(bei)設立(li)獨(du)(du)立(li)監(jian)(jian)(jian)管(guan)機(ji)構(gou)的(de)(de)縣(xian)應(ying)明確(que)一個履行國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)職(zhi)(zhi)責(ze)的(de)(de)部門或組建國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)經營管(guan)理公司(si)授權統一監(jian)(jian)(jian)管(guan)。要(yao)認(ren)真落實以管(guan)資(zi)(zi)(zi)本為(wei)主加強國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)的(de)(de)要(yao)求,調整優化(hua)國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)職(zhi)(zhi)能,突出履行出資(zi)(zi)(zi)人職(zhi)(zhi)責(ze)的(de)(de)重點(dian)環節,做(zuo)到監(jian)(jian)(jian)管(guan)不缺位、不錯位、不越位。
(三)推動(dong)經(jing)營(ying)性國(guo)有(you)資(zi)產集中(zhong)統一監(jian)(jian)(jian)管(guan)。要切實轉變政府職能(neng),加(jia)快(kuai)政企分開(kai)步伐,對仍由黨政機關(guan)管(guan)理的(de)企業和經(jing)營(ying)性資(zi)產要制定分離(li)脫鉤方案和時間表,盡快(kuai)納(na)入國(guo)有(you)資(zi)產監(jian)(jian)(jian)管(guan)機構實行(xing)統一監(jian)(jian)(jian)管(guan)。支持按照出資(zi)關(guan)系對地方金融、文化等領(ling)域經(jing)營(ying)性國(guo)有(you)資(zi)產實行(xing)專業或授權監(jian)(jian)(jian)管(guan)。
(四(si))執行重大(da)事項報(bao)告(gao)制度。市、縣國(guo)資(zi)(zi)監(jian)(jian)管機構(gou)要定期向(xiang)本級(ji)黨委、政府匯報(bao)本地(di)(di)區(qu)國(guo)資(zi)(zi)國(guo)企改革發展情況(kuang)(kuang)(kuang)以(yi)及國(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)(chan)總(zong)(zong)量、結構(gou)、變(bian)動、收益等匯總(zong)(zong)分析(xi)情況(kuang)(kuang)(kuang),圍繞當地(di)(di)經濟(ji)社會(hui)發展大(da)局和國(guo)有(you)經濟(ji)改革發展狀(zhuang)況(kuang)(kuang)(kuang),提出(chu)相關意見(jian)建議。下級(ji)國(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管機構(gou)要將本地(di)(di)區(qu)國(guo)有(you)經濟(ji)運行情況(kuang)(kuang)(kuang)以(yi)及所出(chu)資(zi)(zi)企業匯總(zong)(zong)月(yue)度及年度財務情況(kuang)(kuang)(kuang)向(xiang)上一級(ji)國(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管機構(gou)報(bao)告(gao)。下級(ji)國(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管機構(gou)出(chu)臺的規范性文件(jian)要向(xiang)上一級(ji)國(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管機構(gou)報(bao)備。
(五)加強(qiang)指(zhi)導(dao)監(jian)督工作。根據(ju)逐(zhu)級(ji)指(zhi)導(dao)監(jian)督的原則,上級(ji)國有(you)(you)資(zi)產(chan)監(jian)管機構(gou)應當(dang)加強(qiang)與下(xia)級(ji)政(zheng)府的溝(gou)通(tong)(tong)協調(diao),加強(qiang)對下(xia)級(ji)國有(you)(you)資(zi)產(chan)監(jian)管工作的調(diao)研(yan)指(zhi)導(dao),加強(qiang)業務交流和培訓,及(ji)時總(zong)結推廣國有(you)(you)資(zi)產(chan)監(jian)管和國有(you)(you)企業改革發展的典型經驗,通(tong)(tong)報(bao)開展監(jian)督檢查情況。
(六)加強合作交(jiao)流。要進一步(bu)(bu)優(you)化(hua)資(zi)源配置(zhi),按照市場經濟規律,大力推(tui)進各級(ji)國(guo)(guo)有(you)資(zi)產開放性市場化(hua)有(you)效整合、兼并重組,實現(xian)優(you)勢互補、互利共贏。要進一步(bu)(bu)拓寬各級(ji)國(guo)(guo)有(you)資(zi)產監(jian)管(guan)機(ji)構(gou)信息交(jiao)流渠(qu)道,建(jian)立健全國(guo)(guo)有(you)資(zi)產基礎管(guan)理(li)信息平臺(tai)(tai),大力推(tui)進信息交(jiao)流工作的制度化(hua)、規范化(hua),逐步(bu)(bu)實現(xian)信息互通,數據共享(xiang)。要積極搭建(jian)人(ren)才(cai)(cai)隊(dui)伍(wu)培養平臺(tai)(tai),健全完善各級(ji)國(guo)(guo)有(you)資(zi)產監(jian)管(guan)機(ji)構(gou)之(zhi)(zhi)間(jian)、國(guo)(guo)有(you)資(zi)產監(jian)管(guan)機(ji)構(gou)與監(jian)管(guan)企業之(zhi)(zhi)間(jian)的人(ren)員雙向交(jiao)流掛(gua)職制度,努力實現(xian)人(ren)才(cai)(cai)資(zi)源共享(xiang)。
(七)嚴格實施監(jian)督檢查。各(ge)級國有(you)資(zi)(zi)產監(jian)管(guan)機構(gou)(gou)要依法(fa)(fa)加(jia)強對下級政府國有(you)資(zi)(zi)產監(jian)管(guan)工(gong)作(zuo)的(de)監(jian)督檢查,上級國有(you)資(zi)(zi)產監(jian)管(guan)機構(gou)(gou)發(fa)現下級政府國有(you)資(zi)(zi)產監(jian)管(guan)工(gong)作(zuo)中(zhong)存在與國有(you)資(zi)(zi)產監(jian)管(guan)法(fa)(fa)律、行政法(fa)(fa)規和(he)國家方針政策不符情形的(de),應當依法(fa)(fa)提(ti)出糾正意見或(huo)處理建議(yi)。
(八)著力(li)發展(zhan)地方(fang)國(guo)有(you)優(you)勢(shi)特色企(qi)(qi)業(ye)。繼(ji)續推(tui)動(dong)國(guo)有(you)企(qi)(qi)業(ye)加快轉型升級和(he)調整產(chan)業(ye)結構,推(tui)進(jin)自主創新(xin)、優(you)化內部資(zi)(zi)(zi)源(yuan)配置,大(da)力(li)發展(zhan)新(xin)型混合所有(you)制企(qi)(qi)業(ye),推(tui)動(dong)國(guo)有(you)資(zi)(zi)(zi)本、集體資(zi)(zi)(zi)本、非公(gong)有(you)資(zi)(zi)(zi)本相互(hu)融合、優(you)勢(shi)互(hu)補(bu)、共同發展(zhan),探(tan)索改組或(huo)組建國(guo)有(you)資(zi)(zi)(zi)本投資(zi)(zi)(zi)運(yun)營(ying)公(gong)司,加快打造一(yi)批具(ju)有(you)競(jing)爭力(li)和(he)影響力(li)的(de)地方(fang)優(you)勢(shi)特色企(qi)(qi)業(ye)。
(九)大(da)力加強自身(shen)建(jian)設。要大(da)力推動(dong)國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)機(ji)(ji)構專業化(hua)(hua)、規范(fan)化(hua)(hua)、制度化(hua)(hua)建(jian)設,切實改進干部(bu)作(zuo)(zuo)風,強化(hua)(hua)大(da)局(ju)意(yi)識、責任(ren)意(yi)識、服務意(yi)識、擔當意(yi)識,提升(sheng)履(lv)(lv)職能力,提高(gao)監(jian)(jian)管(guan)水平(ping)。要依法(fa)規范(fan)出資(zi)(zi)(zi)人行權履(lv)(lv)責的各項活動(dong),重(zhong)視合法(fa)性(xing)、合規性(xing)審查,強化(hua)(hua)監(jian)(jian)督機(ji)(ji)制,防(fang)范(fan)法(fa)律風險(xian),全面提高(gao)國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)工(gong)作(zuo)(zuo)規范(fan)化(hua)(hua)水平(ping)。
