國資委2016年度法治建設取得積極進展

貫徹落實中(zhong)共(gong)中(zhong)央(yang)、國務院印發的《法治政府建設實施綱要(2015-2020年)》(以下(xia)簡稱《綱要》)要求,國資委(wei)2016年法治建設取得積極進展(zhan)。
一、切實加強(qiang)組織領導(dao)
國(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)(wei)高度(du)(du)重(zhong)(zhong)(zhong)視機關(guan)和(he)(he)(he)(he)中(zhong)(zhong)央企(qi)(qi)(qi)業法(fa)(fa)(fa)(fa)(fa)治建(jian)(jian)(jian)設(she),深(shen)(shen)入推(tui)進(jin)(jin)依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)監(jian)管(guan)、依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)治企(qi)(qi)(qi),認真(zhen)落(luo)實(shi)《黨(dang)政(zheng)主要(yao)(yao)(yao)(yao)負(fu)(fu)責(ze)人(ren)履(lv)行(xing)推(tui)進(jin)(jin)法(fa)(fa)(fa)(fa)(fa)治建(jian)(jian)(jian)設(she)第(di)一(yi)(yi)(yi)(yi)(yi)責(ze)任人(ren)職(zhi)責(ze)規(gui)(gui)(gui)定(ding)(ding)》(以(yi)下簡稱《規(gui)(gui)(gui)定(ding)(ding)》),自(zi)(zi)覺(jue)運用(yong)法(fa)(fa)(fa)(fa)(fa)治思維和(he)(he)(he)(he)法(fa)(fa)(fa)(fa)(fa)治方(fang)(fang)(fang)式(shi)(shi)深(shen)(shen)化(hua)改(gai)革、推(tui)動(dong)發展(zhan)、化(hua)解矛(mao)盾、維護穩(wen)定(ding)(ding)。一(yi)(yi)(yi)(yi)(yi)是深(shen)(shen)入學(xue)(xue)(xue)習貫(guan)徹(che)習近平(ping)總書(shu)記(ji)(ji)系(xi)(xi)列重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)講(jiang)(jiang)話精(jing)神。黨(dang)的(de)(de)十八屆四中(zhong)(zhong)全會(hui)(hui)(hui)(hui)作(zuo)(zuo)(zuo)出(chu)了(le)(le)全面(mian)(mian)推(tui)進(jin)(jin)依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)治國(guo)的(de)(de)重(zhong)(zhong)(zhong)大(da)戰(zhan)略(lve)部署。習近平(ping)總書(shu)記(ji)(ji)圍繞(rao)推(tui)進(jin)(jin)全面(mian)(mian)依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)治國(guo)提出(chu)了(le)(le)一(yi)(yi)(yi)(yi)(yi)系(xi)(xi)列新理念新思想(xiang)新戰(zhan)略(lve),為全面(mian)(mian)推(tui)進(jin)(jin)各項(xiang)工作(zuo)(zuo)(zuo)提出(chu)了(le)(le)重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)遵循。國(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)(wei)黨(dang)委(wei)(wei)(wei)堅持把學(xue)(xue)(xue)習總書(shu)記(ji)(ji)系(xi)(xi)列重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)講(jiang)(jiang)話精(jing)神擺在重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)位置(zhi),牢固樹立“四個(ge)意識”,通過(guo)黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)、中(zhong)(zhong)心組(zu)學(xue)(xue)(xue)習、專(zhuan)題學(xue)(xue)(xue)習研(yan)(yan)討等方(fang)(fang)(fang)式(shi)(shi),集體學(xue)(xue)(xue)習總書(shu)記(ji)(ji)系(xi)(xi)列重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)講(jiang)(jiang)話精(jing)神,特(te)別(bie)是專(zhuan)題學(xue)(xue)(xue)習了(le)(le)習近平(ping)總書(shu)記(ji)(ji)在中(zhong)(zhong)共中(zhong)(zhong)央政(zheng)治局第(di)三(san)十七次(ci)集體學(xue)(xue)(xue)習時的(de)(de)重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)講(jiang)(jiang)話,深(shen)(shen)刻(ke)領會(hui)(hui)(hui)(hui)堅持依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)治國(guo)和(he)(he)(he)(he)以(yi)德治國(guo)相(xiang)(xiang)結合的(de)(de)重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)思想(xiang)。二(er)是加強(qiang)中(zhong)(zhong)央文(wen)件和(he)(he)(he)(he)黨(dang)內(nei)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)的(de)(de)學(xue)(xue)(xue)習。國(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)(wei)黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)傳(chuan)達學(xue)(xue)(xue)習了(le)(le)全國(guo)黨(dang)內(nei)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)工作(zuo)(zuo)(zuo)會(hui)(hui)(hui)(hui)議精(jing)神,并(bing)(bing)第(di)一(yi)(yi)(yi)(yi)(yi)時間(jian)向中(zhong)(zhong)央企(qi)(qi)(qi)業傳(chuan)達,要(yao)(yao)(yao)(yao)求將思想(xiang)建(jian)(jian)(jian)黨(dang)和(he)(he)(he)(he)制度(du)(du)治黨(dang)相(xiang)(xiang)結合、依(yi)(yi)規(gui)(gui)(gui)治黨(dang)和(he)(he)(he)(he)以(yi)德治黨(dang)相(xiang)(xiang)統(tong)一(yi)(yi)(yi)(yi)(yi),全面(mian)(mian)做好黨(dang)內(nei)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)制度(du)(du)建(jian)(jian)(jian)設(she);專(zhuan)門學(xue)(xue)(xue)習《綱要(yao)(yao)(yao)(yao)》《規(gui)(gui)(gui)定(ding)(ding)》《關(guan)于推(tui)行(xing)法(fa)(fa)(fa)(fa)(fa)律(lv)顧問制度(du)(du)和(he)(he)(he)(he)公(gong)(gong)職(zhi)律(lv)師公(gong)(gong)司律(lv)師制度(du)(du)的(de)(de)意見(jian)》等中(zhong)(zhong)央文(wen)件精(jing)神,并(bing)(bing)提出(chu)貫(guan)徹(che)落(luo)實(shi)要(yao)(yao)(yao)(yao)求。組(zu)織委(wei)(wei)(wei)機關(guan)和(he)(he)(he)(he)中(zhong)(zhong)央企(qi)(qi)(qi)業黨(dang)內(nei)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)輔導(dao)報告會(hui)(hui)(hui)(hui),邀請(qing)有關(guan)同(tong)志(zhi)(zhi)講(jiang)(jiang)解黨(dang)章、《中(zhong)(zhong)國(guo)共產黨(dang)問責(ze)條(tiao)例》等重(zhong)(zhong)(zhong)要(yao)(yao)(yao)(yao)黨(dang)內(nei)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)。三(san)是迅速出(chu)臺實(shi)施方(fang)(fang)(fang)案。《綱要(yao)(yao)(yao)(yao)》印(yin)(yin)發后,國(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)(wei)高度(du)(du)重(zhong)(zhong)(zhong)視,第(di)一(yi)(yi)(yi)(yi)(yi)時間(jian)部署安排(pai)貫(guan)徹(che)落(luo)實(shi)。經黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)和(he)(he)(he)(he)主任辦公(gong)(gong)會(hui)(hui)(hui)(hui)審議通過(guo),印(yin)(yin)發《國(guo)務院國(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)(wei)推(tui)進(jin)(jin)國(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)法(fa)(fa)(fa)(fa)(fa)治機構建(jian)(jian)(jian)設(she)實(shi)施方(fang)(fang)(fang)案》(以(yi)下簡稱《實(shi)施方(fang)(fang)(fang)案》,將《綱要(yao)(yao)(yao)(yao)》規(gui)(gui)(gui)定(ding)(ding)和(he)(he)(he)(he)國(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)工作(zuo)(zuo)(zuo)實(shi)際相(xiang)(xiang)結合,明(ming)確6個(ge)方(fang)(fang)(fang)面(mian)(mian)24項(xiang)主要(yao)(yao)(yao)(yao)任務,并(bing)(bing)逐一(yi)(yi)(yi)(yi)(yi)細化(hua)落(luo)實(shi)負(fu)(fu)責(ze)廳局、時間(jian)進(jin)(jin)度(du)(du)安排(pai)和(he)(he)(he)(he)可檢(jian)驗的(de)(de)成果形式(shi)(shi)。四是強(qiang)化(hua)工作(zuo)(zuo)(zuo)部署推(tui)動(dong)。黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)、主任辦公(gong)(gong)會(hui)(hui)(hui)(hui)多次(ci)研(yan)(yan)究法(fa)(fa)(fa)(fa)(fa)治工作(zuo)(zuo)(zuo),主要(yao)(yao)(yao)(yao)負(fu)(fu)責(ze)同(tong)志(zhi)(zhi)親自(zi)(zi)謀劃(hua)、親自(zi)(zi)協調,確保法(fa)(fa)(fa)(fa)(fa)治建(jian)(jian)(jian)設(she)與年度(du)(du)工作(zuo)(zuo)(zuo)要(yao)(yao)(yao)(yao)點同(tong)部署、同(tong)推(tui)進(jin)(jin)、同(tong)督促;在中(zhong)(zhong)央企(qi)(qi)(qi)業、地方(fang)(fang)(fang)國(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)(wei)負(fu)(fu)責(ze)人(ren)會(hui)(hui)(hui)(hui)議上,主要(yao)(yao)(yao)(yao)負(fu)(fu)責(ze)同(tong)志(zhi)(zhi)明(ming)確要(yao)(yao)(yao)(yao)求強(qiang)化(hua)依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)監(jian)管(guan),嚴格依(yi)(yi)據國(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)相(xiang)(xiang)關(guan)法(fa)(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)規(gui)(gui)(gui)定(ding)(ding)的(de)(de)權限和(he)(he)(he)(he)程序行(xing)權履(lv)職(zhi),健全完善國(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)制度(du)(du)體系(xi)(xi);組(zu)織召開中(zhong)(zhong)央企(qi)(qi)(qi)業法(fa)(fa)(fa)(fa)(fa)治工作(zuo)(zuo)(zuo)會(hui)(hui)(hui)(hui)議和(he)(he)(he)(he)國(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)(wei)系(xi)(xi)統(tong)政(zheng)策(ce)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)(gui)工作(zuo)(zuo)(zuo)研(yan)(yan)討培訓班,明(ming)確2017年推(tui)進(jin)(jin)依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)監(jian)管(guan)、依(yi)(yi)法(fa)(fa)(fa)(fa)(fa)治企(qi)(qi)(qi)的(de)(de)具體工作(zuo)(zuo)(zuo)任務。
二、著力打造國資監管法治機構(gou)
認真落實以(yi)管資本為主加強國有(you)資產(chan)監管的改革要求,嚴(yan)格依據(ju)公司(si)法(fa)、企業國有(you)資產(chan)法(fa)全面履(lv)行出資人職責,建立健(jian)全依法(fa)監管的機制制度,法(fa)治(zhi)機構建設取(qu)得(de)明顯進展(zhan)。
(一)依(yi)(yi)法(fa)(fa)全(quan)面履行(xing)國有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)管職責(ze)(ze)。一是(shi)推(tui)(tui)進(jin)國資(zi)(zi)(zi)(zi)監(jian)(jian)管職能(neng)轉(zhuan)變。研究(jiu)(jiu)制訂國務院國資(zi)(zi)(zi)(zi)委以管資(zi)(zi)(zi)(zi)本為(wei)主推(tui)(tui)進(jin)職能(neng)轉(zhuan)變方案,強(qiang)(qiang)化(hua)管資(zi)(zi)(zi)(zi)本重點職能(neng),加強(qiang)(qiang)出資(zi)(zi)(zi)(zi)人監(jian)(jian)督(du)(du),全(quan)面加強(qiang)(qiang)黨(dang)的建設,精簡監(jian)(jian)管事(shi)項,改(gai)進(jin)國資(zi)(zi)(zi)(zi)監(jian)(jian)管方式和(he)手段(duan)。同時(shi),加快研究(jiu)(jiu)制訂出資(zi)(zi)(zi)(zi)人監(jian)(jian)管權(quan)力(li)和(he)責(ze)(ze)任(ren)清單。二是(shi)運(yun)用(yong)法(fa)(fa)治化(hua)方式行(xing)權(quan)履責(ze)(ze)。嚴(yan)格按(an)照(zhao)法(fa)(fa)定(ding)職責(ze)(ze)和(he)程序加強(qiang)(qiang)國有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)管,完善(shan)中(zhong)央(yang)企(qi)業章程管理(li),推(tui)(tui)動(dong)中(zhong)央(yang)企(qi)業建立(li)規范董事(shi)會(hui)(hui),進(jin)一步規范董事(shi)會(hui)(hui)運(yun)作(zuo),依(yi)(yi)法(fa)(fa)依(yi)(yi)規選派(pai)、選任(ren)和(he)管理(li)股東代表、董事(shi)、監(jian)(jian)事(shi)及經營(ying)管理(li)者,更多通過公司法(fa)(fa)人治理(li)結構有(you)(you)效體現出資(zi)(zi)(zi)(zi)人意志。三是(shi)依(yi)(yi)法(fa)(fa)強(qiang)(qiang)化(hua)國有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)督(du)(du)。成立(li)監(jian)(jian)督(du)(du)一局、監(jian)(jian)督(du)(du)二局、監(jian)(jian)督(du)(du)三局,負責(ze)(ze)深入核查、分類處(chu)置和(he)整改(gai)督(du)(du)辦委機(ji)關(guan)、監(jian)(jian)事(shi)會(hui)(hui)及有(you)(you)關(guan)監(jian)(jian)督(du)(du)機(ji)構發(fa)現移交的問題(ti),依(yi)(yi)法(fa)(fa)組織開展國有(you)(you)資(zi)(zi)(zi)(zi)產(chan)重大損失調(diao)查,提(ti)出有(you)(you)關(guan)責(ze)(ze)任(ren)追究(jiu)(jiu)的意見(jian)建議。落實《關(guan)于建立(li)國有(you)(you)企(qi)業違(wei)規經營(ying)投(tou)資(zi)(zi)(zi)(zi)責(ze)(ze)任(ren)追究(jiu)(jiu)制度的意見(jian)》要求,加大對(dui)中(zhong)央(yang)企(qi)業違(wei)規經營(ying)責(ze)(ze)任(ren)追究(jiu)(jiu)力(li)度,形(xing)成發(fa)現、調(diao)查、處(chu)理(li)問題(ti)的監(jian)(jian)督(du)(du)工作(zuo)閉環。
(二)完善(shan)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)法(fa)(fa)(fa)規(gui)(gui)(gui)制度體系。一(yi)是加(jia)強(qiang)重點領(ling)域國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)立法(fa)(fa)(fa)。圍繞國(guo)(guo)(guo)(guo)(guo)企(qi)(qi)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)改革發展中(zhong)(zhong)心任(ren)(ren)務(wu)(wu),突出以管(guan)資(zi)(zi)(zi)(zi)本(ben)為主,編制我委(wei)2016年度立法(fa)(fa)(fa)工(gong)(gong)作計劃,保(bao)障改革立法(fa)(fa)(fa)需求(qiu)。全年共(gong)(gong)出臺《企(qi)(qi)業國(guo)(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產交易(yi)監(jian)督管(guan)理辦法(fa)(fa)(fa)》《中(zhong)(zhong)央企(qi)(qi)業負責人經(jing)營業績(ji)考(kao)核(he)辦法(fa)(fa)(fa)》《關(guan)于完善(shan)中(zhong)(zhong)央企(qi)(qi)業功能分類(lei)考(kao)核(he)的(de)實施(shi)方(fang)案(an)》等27件(jian)(jian)(jian)(jian)(jian)規(gui)(gui)(gui)章規(gui)(gui)(gui)范(fan)(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)(含黨(dang)委(wei)規(gui)(gui)(gui)范(fan)(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian))。截至(zhi)2016年底,國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)現行(xing)有效規(gui)(gui)(gui)章28件(jian)(jian)(jian)(jian)(jian),規(gui)(gui)(gui)范(fan)(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)294件(jian)(jian)(jian)(jian)(jian),國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)法(fa)(fa)(fa)規(gui)(gui)(gui)制度體系進(jin)一(yi)步完善(shan)。二是加(jia)強(qiang)規(gui)(gui)(gui)章規(gui)(gui)(gui)范(fan)(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)合(he)法(fa)(fa)(fa)性(xing)(xing)(xing)審查。根據(ju)立法(fa)(fa)(fa)法(fa)(fa)(fa)和(he)《規(gui)(gui)(gui)章制定(ding)(ding)程序條例》,嚴格(ge)落實《國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)立法(fa)(fa)(fa)工(gong)(gong)作規(gui)(gui)(gui)則》、《國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)規(gui)(gui)(gui)范(fan)(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)制定(ding)(ding)暫行(xing)辦法(fa)(fa)(fa)》,要求(qiu)規(gui)(gui)(gui)章規(gui)(gui)(gui)范(fan)(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)在提請(qing)委(wei)主任(ren)(ren)辦公會議(yi)審議(yi)前,須由法(fa)(fa)(fa)制機構進(jin)行(xing)合(he)法(fa)(fa)(fa)性(xing)(xing)(xing)審查并出具審查報告。三是深入開展國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)清(qing)(qing)理。根據(ju)國(guo)(guo)(guo)(guo)(guo)務(wu)(wu)院統(tong)一(yi)部署要求(qiu),對(dui)不(bu)利于穩(wen)增長、促改革、調結構、惠民(min)生的(de)政策性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)進(jin)行(xing)清(qing)(qing)理,共(gong)(gong)宣布(bu)廢止、失效一(yi)批政策性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)。清(qing)(qing)理結果以國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)公告的(de)形式向(xiang)社(she)會公布(bu)。此外,積極參(can)與《中(zhong)(zhong)華人民(min)共(gong)(gong)和(he)國(guo)(guo)(guo)(guo)(guo)商(shang)品(pin)流通法(fa)(fa)(fa)》《中(zhong)(zhong)華人民(min)共(gong)(gong)和(he)國(guo)(guo)(guo)(guo)(guo)反不(bu)正當競爭法(fa)(fa)(fa)》《中(zhong)(zhong)華人民(min)共(gong)(gong)和(he)國(guo)(guo)(guo)(guo)(guo)電(dian)力(li)法(fa)(fa)(fa)》等國(guo)(guo)(guo)(guo)(guo)家重要立法(fa)(fa)(fa)。
(三(san))推進決(jue)策(ce)(ce)(ce)科學化(hua)、民主化(hua)、法(fa)(fa)治化(hua)。一是完善依法(fa)(fa)決(jue)策(ce)(ce)(ce)程序。明確(que)(que)重大(da)決(jue)策(ce)(ce)(ce)應當經委(wei)黨委(wei)會、委(wei)主任(ren)辦公會議(yi)討(tao)論(lun),由主要負責同志在(zai)集體(ti)討(tao)論(lun)基礎上(shang)作出(chu)決(jue)定。二是加(jia)強(qiang)重大(da)決(jue)策(ce)(ce)(ce)合(he)法(fa)(fa)性審查。除(chu)規(gui)章規(gui)范性文件外,明確(que)(que)涉及國企國資(zi)改革(ge)發展的(de)重大(da)決(jue)策(ce)(ce)(ce),必(bi)須征(zheng)求法(fa)(fa)制(zhi)機(ji)構意見。三(san)是探索推行機(ji)關(guan)法(fa)(fa)律(lv)顧問制(zhi)度(du)。在(zai)國資(zi)監管立法(fa)(fa)、重大(da)事項決(jue)策(ce)(ce)(ce)、訴訟復議(yi)和訴訟案(an)件應對等機(ji)關(guan)法(fa)(fa)律(lv)事務(wu)中(zhong),充分發揮法(fa)(fa)律(lv)顧問的(de)法(fa)(fa)律(lv)咨詢論(lun)證、審核把關(guan)和協(xie)調服務(wu)作用。
(四)強化對權力的(de)(de)制(zhi)約(yue)和監(jian)(jian)(jian)督(du)(du)(du)。一是(shi)(shi)健全(quan)國(guo)資監(jian)(jian)(jian)管(guan)權力運行制(zhi)約(yue)和監(jian)(jian)(jian)督(du)(du)(du)體系。注重廉政風(feng)險(xian)防控(kong)建設,加(jia)強對“關(guan)鍵(jian)環(huan)節”的(de)(de)監(jian)(jian)(jian)督(du)(du)(du),緊盯權力集(ji)中(zhong)(zhong)(zhong)、資金密(mi)集(ji)、經營壟斷等(deng)重點(dian)(dian)領域、重點(dian)(dian)環(huan)節和重點(dian)(dian)人員。在國(guo)資委門(men)戶(hu)網(wang)站添加(jia)中(zhong)(zhong)(zhong)央(yang)國(guo)家機關(guan)舉報(bao)網(wang)站網(wang)址,暢(chang)通舉報(bao)監(jian)(jian)(jian)督(du)(du)(du)渠道(dao)。二是(shi)(shi)自覺接受黨(dang)內監(jian)(jian)(jian)督(du)(du)(du)和審計(ji)(ji)監(jian)(jian)(jian)督(du)(du)(du)。按照“條條要(yao)整改(gai)、件件有著落”的(de)(de)要(yao)求,把巡視(shi)反(fan)饋(kui)的(de)(de)突出問(wen)(wen)題(ti),提(ti)出對應整改(gai)措施,一一對賬銷號(hao),切實發(fa)揮好巡視(shi)發(fa)現問(wen)(wen)題(ti)、形成震懾、倒逼改(gai)革、促進(jin)(jin)發(fa)展(zhan)(zhan)的(de)(de)作(zuo)用。積極配(pei)合審計(ji)(ji)監(jian)(jian)(jian)督(du)(du)(du),全(quan)面提(ti)供(gong)資料、主(zhu)動(dong)說明(ming)情(qing)況;對審計(ji)(ji)發(fa)現的(de)(de)問(wen)(wen)題(ti)及時(shi)明(ming)確責任,落實整改(gai)措施,確保監(jian)(jian)(jian)管(guan)更加(jia)規范(fan)有效。三(san)是(shi)(shi)全(quan)面推進(jin)(jin)信息公(gong)(gong)開。2016年我委通過國(guo)資委門(men)戶(hu)網(wang)站主(zhu)動(dong)發(fa)布(bu)各類(lei)信息,涵蓋(gai)國(guo)企國(guo)資深化改(gai)革、中(zhong)(zhong)(zhong)央(yang)企業(ye)經營發(fa)展(zhan)(zhan)、中(zhong)(zhong)(zhong)央(yang)企業(ye)履行社(she)會責任等(deng)方面情(qing)況,特別是(shi)(shi)向社(she)會主(zhu)動(dong)公(gong)(gong)開中(zhong)(zhong)(zhong)央(yang)企業(ye)負責同志2015年度(du)薪酬(chou)水平(ping)情(qing)況,進(jin)(jin)一步提(ti)高了中(zhong)(zhong)(zhong)央(yang)企業(ye)透(tou)明(ming)度(du)。依法依規做好依申請(qing)公(gong)(gong)開工作(zuo),印發(fa)了《關(guan)于(yu)推進(jin)(jin)中(zhong)(zhong)(zhong)央(yang)企業(ye)信息公(gong)(gong)開的(de)(de)指導意見》,推動(dong)中(zhong)(zhong)(zhong)央(yang)企業(ye)信息公(gong)(gong)開試點(dian)(dian)工作(zuo)有序進(jin)(jin)行。
(五)依法(fa)有效化解矛(mao)(mao)盾糾紛。一是(shi)提(ti)高信(xin)(xin)息公開、授權委(wei)托等(deng)法(fa)律(lv)審核質量,全面(mian)做好涉訴案件和行政(zheng)復議應對(dui)工(gong)作(zuo)(zuo),較好地防(fang)范(fan)了委(wei)機關法(fa)律(lv)風(feng)險。二是(shi)完善信(xin)(xin)訪(fang)工(gong)作(zuo)(zuo)制度。建立(li)局處級干部定期參加接訪(fang)、新錄公務員信(xin)(xin)訪(fang)鍛煉等(deng)制度,提(ti)高全委(wei)干部信(xin)(xin)訪(fang)工(gong)作(zuo)(zuo)意(yi)識。進一步規(gui)范(fan)信(xin)(xin)訪(fang)事(shi)項辦理(li)流(liu)程(cheng),研(yan)究網上信(xin)(xin)訪(fang)工(gong)作(zuo)(zuo),暢通(tong)信(xin)(xin)訪(fang)渠(qu)道(dao),推(tui)動通(tong)過(guo)法(fa)定途(tu)徑分(fen)類處理(li)信(xin)(xin)訪(fang)投(tou)訴請(qing)求(qiu)。組(zu)織中央企業深入開展矛(mao)(mao)盾糾紛排(pai)查(cha)化解工(gong)作(zuo)(zuo),對(dui)排(pai)查(cha)出的問(wen)(wen)題(ti)(ti)做到責(ze)任、人員、措施“三落實”,健(jian)全中央企業不穩定問(wen)(wen)題(ti)(ti)臺(tai)賬。
(六)加(jia)(jia)強機(ji)關(guan)(guan)(guan)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)宣(xuan)傳(chuan)(chuan)教(jiao)(jiao)育。一是啟(qi)動“七五(wu)”普(pu)(pu)法(fa)(fa)(fa)(fa)(fa)(fa)工(gong)作。制(zhi)定《國(guo)(guo)(guo)(guo)(guo)務院國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)關(guan)(guan)(guan)于在國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)系統開(kai)展法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)宣(xuan)傳(chuan)(chuan)教(jiao)(jiao)育的(de)第七個五(wu)年規(gui)劃(2016-2020年)》,正式(shi)啟(qi)動國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)系統“七五(wu)”普(pu)(pu)法(fa)(fa)(fa)(fa)(fa)(fa)工(gong)作。二是深(shen)入抓好法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)教(jiao)(jiao)育。定期組(zu)織“法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)講(jiang)堂”,邀(yao)請(qing)政府機(ji)關(guan)(guan)(guan)、高等院校的(de)專家學者以(yi)及律師、企(qi)業(ye)(ye)(ye)總(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律顧問等,在各中(zhong)央(yang)企(qi)業(ye)(ye)(ye)和地方(fang)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)設立分會場,以(yi)視頻(pin)形式(shi)進行專題講(jiang)座,2016年共舉辦(ban)(ban)6期。深(shen)入開(kai)展“12·4”全(quan)國(guo)(guo)(guo)(guo)(guo)憲法(fa)(fa)(fa)(fa)(fa)(fa)日(ri)和全(quan)國(guo)(guo)(guo)(guo)(guo)法(fa)(fa)(fa)(fa)(fa)(fa)制(zhi)宣(xuan)傳(chuan)(chuan)日(ri)宣(xuan)傳(chuan)(chuan)教(jiao)(jiao)育活動,加(jia)(jia)強公務員初(chu)任培(pei)(pei)訓(xun)(xun)、干部任職培(pei)(pei)訓(xun)(xun)中(zhong)的(de)法(fa)(fa)(fa)(fa)(fa)(fa)律知識培(pei)(pei)訓(xun)(xun)。組(zu)織機(ji)關(guan)(guan)(guan)干部旁(pang)聽(ting)我委(wei)(wei)(wei)(wei)涉(she)訴案件庭審并開(kai)展座談會,通(tong)過網絡、微信等不斷拓寬法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)宣(xuan)傳(chuan)(chuan)教(jiao)(jiao)育渠道,提升機(ji)關(guan)(guan)(guan)干部法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)素養。三(san)是加(jia)(jia)強對外法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)宣(xuan)傳(chuan)(chuan)。加(jia)(jia)強國(guo)(guo)(guo)(guo)(guo)資(zi)監管法(fa)(fa)(fa)(fa)(fa)(fa)規(gui)制(zhi)度的(de)普(pu)(pu)法(fa)(fa)(fa)(fa)(fa)(fa)宣(xuan)傳(chuan)(chuan),及時向社會公開(kai)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)規(gui)章規(gui)范性文件,并通(tong)過網站、公告、新聞通(tong)氣會等方(fang)式(shi)進行政策解讀。組(zu)織編(bian)輯出版《一帶(dai)一路沿(yan)線國(guo)(guo)(guo)(guo)(guo)家法(fa)(fa)(fa)(fa)(fa)(fa)律風險防(fang)范指(zhi)引》印尼、沙特、俄羅斯等9個國(guo)(guo)(guo)(guo)(guo)家分冊。會同(tong)有(you)關(guan)(guan)(guan)部門共同(tong)舉辦(ban)(ban)2期反壟(long)斷法(fa)(fa)(fa)(fa)(fa)(fa)培(pei)(pei)訓(xun)(xun)班,對中(zhong)央(yang)和地方(fang)國(guo)(guo)(guo)(guo)(guo)有(you)大中(zhong)型企(qi)業(ye)(ye)(ye)進行法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)教(jiao)(jiao)育培(pei)(pei)訓(xun)(xun)。在2016年全(quan)國(guo)(guo)(guo)(guo)(guo)“六五(wu)”普(pu)(pu)法(fa)(fa)(fa)(fa)(fa)(fa)表彰中(zhong),國(guo)(guo)(guo)(guo)(guo)務院國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)普(pu)(pu)法(fa)(fa)(fa)(fa)(fa)(fa)辦(ban)(ban)被評為先進單位(wei)。
三、深入推(tui)進法治央企建(jian)設
認真貫徹全(quan)(quan)(quan)(quan)面(mian)依法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國戰略(lve),全(quan)(quan)(quan)(quan)力(li)推(tui)動(dong)(dong)國資委《關(guan)于全(quan)(quan)(quan)(quan)面(mian)推(tui)進(jin)(jin)(jin)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)建(jian)(jian)設(she)(she)的意見》落實(shi),力(li)爭到(dao)(dao)2020年(nian)打(da)造治(zhi)(zhi)(zhi)理(li)完(wan)善、經(jing)(jing)營合(he)(he)規(gui)、管(guan)理(li)規(gui)范(fan)(fan)、守法(fa)(fa)(fa)(fa)(fa)(fa)誠(cheng)信的法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)。一年(nian)來,在我委指導(dao)(dao)(dao)推(tui)動(dong)(dong)下,中央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)依法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)企(qi)(qi)(qi)(qi)(qi)取得(de)積極進(jin)(jin)(jin)展(zhan)和(he)明顯成(cheng)效。一是(shi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)建(jian)(jian)設(she)(she)順(shun)利開(kai)局(ju)。推(tui)動(dong)(dong)全(quan)(quan)(quan)(quan)部(bu)(bu)中央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)成(cheng)立法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)建(jian)(jian)設(she)(she)領導(dao)(dao)(dao)小組(zu)(zu),結合(he)(he)實(shi)際制(zhi)(zhi)定(ding)(ding)本企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)(she)實(shi)施方案(an),并將其(qi)納入“十三(san)(san)五(wu)”規(gui)劃(hua)同步(bu)(bu)實(shi)施、同步(bu)(bu)推(tui)進(jin)(jin)(jin)。許多企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)主要領導(dao)(dao)(dao)親自擔任組(zu)(zu)長,部(bu)(bu)署安排法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工作(zuo)重點任務(wu)和(he)具(ju)體措施,切(qie)實(shi)履行推(tui)進(jin)(jin)(jin)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)(she)第一責(ze)(ze)(ze)(ze)任人(ren)(ren)職(zhi)責(ze)(ze)(ze)(ze)。二是(shi)依法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)理(li)穩步(bu)(bu)推(tui)進(jin)(jin)(jin)。指導(dao)(dao)(dao)中央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)全(quan)(quan)(quan)(quan)面(mian)修(xiu)訂(ding)公(gong)司章程(cheng),健全(quan)(quan)(quan)(quan)議事(shi)規(gui)則,編(bian)制(zhi)(zhi)“三(san)(san)會一層”權(quan)責(ze)(ze)(ze)(ze)清單,依法(fa)(fa)(fa)(fa)(fa)(fa)明確職(zhi)責(ze)(ze)(ze)(ze)邊界和(he)履職(zhi)程(cheng)序,形成(cheng)權(quan)責(ze)(ze)(ze)(ze)對等(deng)、協調運轉、有(you)效制(zhi)(zhi)衡的治(zhi)(zhi)(zhi)理(li)機制(zhi)(zhi)。推(tui)動(dong)(dong)總(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)顧(gu)(gu)問(wen)制(zhi)(zhi)度(du)(du)和(he)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工作(zuo)要求納入章程(cheng),明確總(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)顧(gu)(gu)問(wen)列席董事(shi)會,為重大經(jing)(jing)營決(jue)策提供法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)支撐,促進(jin)(jin)(jin)各(ge)治(zhi)(zhi)(zhi)理(li)主體依法(fa)(fa)(fa)(fa)(fa)(fa)履職(zhi)、科學決(jue)策。三(san)(san)是(shi)依法(fa)(fa)(fa)(fa)(fa)(fa)合(he)(he)規(gui)經(jing)(jing)營深(shen)入開(kai)展(zhan)。指導(dao)(dao)(dao)中央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)強化改革方案(an)制(zhi)(zhi)定(ding)(ding)和(he)實(shi)施過(guo)程(cheng)的法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)審(shen)(shen)核(he)把關(guan),依法(fa)(fa)(fa)(fa)(fa)(fa)依規(gui)參(can)與處(chu)置“僵尸(shi)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)”、壓縮管(guan)理(li)層級(ji),依法(fa)(fa)(fa)(fa)(fa)(fa)解決(jue)破產注銷、債(zhai)權(quan)債(zhai)務(wu)處(chu)理(li)等(deng)難(nan)點問(wen)題,助力(li)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)瘦身健體提質(zhi)增效。四是(shi)依法(fa)(fa)(fa)(fa)(fa)(fa)規(gui)范(fan)(fan)管(guan)理(li)持續深(shen)化。目前(qian),中央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)規(gui)章制(zhi)(zhi)度(du)(du)、經(jing)(jing)濟合(he)(he)同、重要決(jue)策法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)審(shen)(shen)核(he)率(lv)已(yi)基本達(da)到(dao)(dao)100%。在此(ci)基礎(chu)上(shang),進(jin)(jin)(jin)一步(bu)(bu)督促企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)提高(gao)審(shen)(shen)核(he)質(zhi)量,加強風險(xian)識(shi)別、預警和(he)合(he)(he)同履約全(quan)(quan)(quan)(quan)程(cheng)管(guan)控,推(tui)動(dong)(dong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)管(guan)理(li)與經(jing)(jing)營管(guan)理(li)深(shen)度(du)(du)融合(he)(he)。組(zu)(zu)織中國石油、中國移動(dong)(dong)、東方電氣、招商局(ju)集團、中國中鐵(tie)等(deng)5家(jia)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)開(kai)展(zhan)合(he)(he)規(gui)管(guan)理(li)體系建(jian)(jian)設(she)(she)試點。五(wu)是(shi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工作(zuo)基礎(chu)不斷夯實(shi)。推(tui)動(dong)(dong)中央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)進(jin)(jin)(jin)一步(bu)(bu)健全(quan)(quan)(quan)(quan)總(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)顧(gu)(gu)問(wen)制(zhi)(zhi)度(du)(du),逐步(bu)(bu)拓(tuo)展(zhan)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)管(guan)理(li)職(zhi)能(neng),充實(shi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工作(zuo)力(li)量,深(shen)入開(kai)展(zhan)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣傳教育。截(jie)至目前(qian),102家(jia)中央(yang)(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)集團全(quan)(quan)(quan)(quan)部(bu)(bu)建(jian)(jian)立總(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)顧(gu)(gu)問(wen)制(zhi)(zhi)度(du)(du),全(quan)(quan)(quan)(quan)系統三(san)(san)級(ji)以(yi)上(shang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)建(jian)(jian)立總(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)顧(gu)(gu)問(wen)制(zhi)(zhi)度(du)(du)的達(da)到(dao)(dao)3131戶,專職(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)(lv)(lv)顧(gu)(gu)問(wen)人(ren)(ren)數超過(guo)2100
