一、主要負責人切實履行推進法治建設第一責任人職責
(一)深入學習貫徹習近平法治思想。國(guo)(guo)資(zi)委(wei)黨(dang)委(wei)書(shu)記(ji)、主任(ren)郝鵬嚴格貫徹落(luo)實(shi)《中共(gong)中央(yang)辦公廳(ting) 國(guo)(guo)務院辦公廳(ting)關于(yu)印發〈黨(dang)政(zheng)主要負(fu)(fu)責(ze)人(ren)履(lv)行推(tui)進(jin)法治(zhi)(zhi)(zhi)(zhi)建設(she)(she)第(di)一(yi)責(ze)任(ren)人(ren)職責(ze)規定〉的(de)(de)通知》要求,始終(zhong)把習(xi)(xi)(xi)(xi)近(jin)平(ping)法治(zhi)(zhi)(zhi)(zhi)思想作(zuo)為國(guo)(guo)資(zi)委(wei)系(xi)統(tong)法治(zhi)(zhi)(zhi)(zhi)建設(she)(she)的(de)(de)根本遵循,認(ren)真貫徹落(luo)實(shi)黨(dang)中央(yang)關于(yu)法治(zhi)(zhi)(zhi)(zhi)建設(she)(she)的(de)(de)重大決(jue)策部署,切實(shi)履(lv)行國(guo)(guo)資(zi)國(guo)(guo)企(qi)法治(zhi)(zhi)(zhi)(zhi)建設(she)(she)組織者、推(tui)動者和實(shi)踐者的(de)(de)職責(ze)。召(zhao)開黨(dang)委(wei)會(hui)議(yi)傳(chuan)達(da)學(xue)習(xi)(xi)(xi)(xi)習(xi)(xi)(xi)(xi)近(jin)平(ping)總書(shu)記(ji)在(zai)中央(yang)全(quan)面依(yi)法治(zhi)(zhi)(zhi)(zhi)國(guo)(guo)委(wei)員(yuan)會(hui)第(di)三次會(hui)議(yi)上的(de)(de)重要講(jiang)話(hua)精神(shen),部署依(yi)法防控疫情(qing)工(gong)作(zuo)。國(guo)(guo)資(zi)委(wei)黨(dang)委(wei)理論學(xue)習(xi)(xi)(xi)(xi)中心組集體深入(ru)學(xue)習(xi)(xi)(xi)(xi)習(xi)(xi)(xi)(xi)近(jin)平(ping)總書(shu)記(ji)在(zai)中央(yang)政(zheng)治(zhi)(zhi)(zhi)(zhi)局(ju)第(di)二十次集體學(xue)習(xi)(xi)(xi)(xi)時的(de)(de)重要講(jiang)話(hua)精神(shen),邀請全(quan)國(guo)(guo)人(ren)大常(chang)委(wei)會(hui)法制工(gong)作(zuo)委(wei)員(yuan)會(hui)負(fu)(fu)責(ze)同志作(zuo)《中華人(ren)民共(gong)和國(guo)(guo)民法典(dian)》(以下簡(jian)稱《民法典(dian)》)專題講(jiang)座,結合國(guo)(guo)資(zi)國(guo)(guo)企(qi)實(shi)際研究(jiu)推(tui)動落(luo)實(shi)措(cuo)施(shi)。黨(dang)委(wei)會(hui)議(yi)專題傳(chuan)達(da)學(xue)習(xi)(xi)(xi)(xi)中央(yang)全(quan)面依(yi)法治(zhi)(zhi)(zhi)(zhi)國(guo)(guo)工(gong)作(zuo)會(hui)議(yi)精神(shen),要求全(quan)面準確學(xue)習(xi)(xi)(xi)(xi)領會(hui)習(xi)(xi)(xi)(xi)近(jin)平(ping)法治(zhi)(zhi)(zhi)(zhi)思想,深入(ru)開展學(xue)習(xi)(xi)(xi)(xi)宣傳(chuan)教育活動,并就推(tui)進(jin)國(guo)(guo)資(zi)委(wei)系(xi)統(tong)法治(zhi)(zhi)(zhi)(zhi)建設(she)(she)作(zuo)出部署安排。
(二)加強國資國企法治建設的組織領導。深入研究(jiu)(jiu)謀劃(hua)國(guo)資(zi)國(guo)企法(fa)(fa)治(zhi)建(jian)(jian)(jian)設年度(du)工作,確(que)保法(fa)(fa)治(zhi)建(jian)(jian)(jian)設與其他重點工作同步部(bu)(bu)署、同步推(tui)進(jin)、同步督(du)促。黨(dang)(dang)(dang)(dang)委(wei)(wei)會(hui)(hui)議(yi)專題傳達學習中央政法(fa)(fa)工作會(hui)(hui)議(yi)精神,研究(jiu)(jiu)制(zhi)定貫(guan)徹(che)落(luo)實(shi)措施。嚴格依法(fa)(fa)依規(gui)決策(ce),健全重大(da)決策(ce)法(fa)(fa)律(lv)審(shen)核機制(zhi),加(jia)強對(dui)規(gui)章規(gui)范(fan)(fan)性文件(jian)(jian)和黨(dang)(dang)(dang)(dang)委(wei)(wei)規(gui)范(fan)(fan)性文件(jian)(jian)的審(shen)核把關(guan)。及時研究(jiu)(jiu)解決法(fa)(fa)治(zhi)建(jian)(jian)(jian)設重大(da)問題,國(guo)資(zi)委(wei)(wei)黨(dang)(dang)(dang)(dang)委(wei)(wei)會(hui)(hui)議(yi)、委(wei)(wei)務(wu)會(hui)(hui)議(yi)專題審(shen)議(yi)立(li)法(fa)(fa)工作計劃(hua)、黨(dang)(dang)(dang)(dang)委(wei)(wei)規(gui)范(fan)(fan)性文件(jian)(jian)制(zhi)定計劃(hua)、重要制(zhi)度(du)文件(jian)(jian)以(yi)及法(fa)(fa)治(zhi)建(jian)(jian)(jian)設年度(du)情況(kuang)報告等(deng)。統籌部(bu)(bu)署黨(dang)(dang)(dang)(dang)內法(fa)(fa)規(gui)制(zhi)度(du)建(jian)(jian)(jian)設,組織(zhi)研究(jiu)(jiu)制(zhi)定黨(dang)(dang)(dang)(dang)委(wei)(wei)規(gui)范(fan)(fan)性文件(jian)(jian),確(que)保黨(dang)(dang)(dang)(dang)內法(fa)(fa)規(gui)各項要求在國(guo)資(zi)委(wei)(wei)系統落(luo)實(shi)落(luo)地(di)。
(三)強化對法治建設具體措施的指導督促。受(shou)國(guo)務院委(wei)托,向(xiang)全國(guo)人(ren)大常委(wei)會報告國(guo)資(zi)委(wei)系統監(jian)管企業國(guo)有資(zi)產(chan)管理情(qing)況(kuang),認(ren)真接受(shou)人(ren)大監(jian)督。部(bu)署推動重要法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規研究(jiu)制(zhi)定(ding)工(gong)作,多(duo)次對配(pei)合做好《中華人(ren)民共和(he)國(guo)公司法(fa)(fa)(fa)(fa)》(以(yi)下(xia)(xia)簡稱《公司法(fa)(fa)(fa)(fa)》)修訂等作出批示(shi),組織研究(jiu)起草《中華人(ren)民共和(he)國(guo)公職人(ren)員政務處分(fen)法(fa)(fa)(fa)(fa)》(以(yi)下(xia)(xia)簡稱《政務處分(fen)法(fa)(fa)(fa)(fa)》)有關配(pei)套(tao)規定(ding)。專(zhuan)門(men)就中央(yang)企業法(fa)(fa)(fa)(fa)治(zhi)工(gong)作會議作出批示(shi),對“十四五(wu)”時期法(fa)(fa)(fa)(fa)治(zhi)央(yang)企建(jian)設工(gong)作提出明確要求。堅持重視法(fa)(fa)(fa)(fa)治(zhi)素養和(he)法(fa)(fa)(fa)(fa)治(zhi)能力的用人(ren)導向(xiang),推動將“依(yi)法(fa)(fa)(fa)(fa)依(yi)規辦事、制(zhi)度執行能力”等納入干(gan)部(bu)年度考核指標。
二、2020年法治建設主要舉措和成效
(一)依法全面行權履職。一(yi)是持續推(tui)進(jin)(jin)(jin)(jin)職能轉變重(zhong)點(dian)任務(wu)(wu)。加強組(zu)織推(tui)動(dong),建(jian)(jian)立健(jian)全(quan)職能轉變工(gong)(gong)作季報(bao)機制,定期梳(shu)(shu)理匯總工(gong)(gong)作進(jin)(jin)(jin)(jin)展(zhan)(zhan)。全(quan)面開展(zhan)(zhan)權(quan)(quan)責(ze)清(qing)(qing)單運(yun)行(xing)評估,梳(shu)(shu)理調整權(quan)(quan)責(ze)事項(xiang),推(tui)進(jin)(jin)(jin)(jin)新(xin)版清(qing)(qing)單編制工(gong)(gong)作。加大(da)(da)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)本投(tou)資(zi)(zi)(zi)、運(yun)營(ying)(ying)公司授權(quan)(quan)放(fang)權(quan)(quan)工(gong)(gong)作力度(du),推(tui)動(dong)優化運(yun)營(ying)(ying)模式和經(jing)營(ying)(ying)機制,更好(hao)服務(wu)(wu)實(shi)(shi)體(ti)經(jing)濟和科技創新(xin)。二(er)是進(jin)(jin)(jin)(jin)一(yi)步加大(da)(da)監(jian)(jian)(jian)(jian)(jian)(jian)督工(gong)(gong)作力度(du)。完善(shan)業(ye)務(wu)(wu)監(jian)(jian)(jian)(jian)(jian)(jian)督、綜合監(jian)(jian)(jian)(jian)(jian)(jian)督、責(ze)任追究三位(wei)一(yi)體(ti)的(de)監(jian)(jian)(jian)(jian)(jian)(jian)督工(gong)(gong)作格(ge)局(ju)(ju),指(zhi)(zhi)導(dao)推(tui)動(dong)中央企業(ye)不斷完善(shan)內控體(ti)系(xi)、內部審計(ji)等制度(du)。深入開展(zhan)(zhan)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)重(zhong)大(da)(da)損失調查及違規經(jing)營(ying)(ying)投(tou)資(zi)(zi)(zi)責(ze)任追究,嚴防(fang)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)流(liu)失。三是推(tui)動(dong)構建(jian)(jian)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)大(da)(da)格(ge)局(ju)(ju)。組(zu)織召(zhao)開構建(jian)(jian)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)大(da)(da)格(ge)局(ju)(ju)工(gong)(gong)作推(tui)進(jin)(jin)(jin)(jin)會,印發年(nian)度(du)指(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)(jian)(jian)督地方國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)工(gong)(gong)作計(ji)劃(hua),全(quan)面部署年(nian)度(du)重(zhong)點(dian)工(gong)(gong)作。經(jing)營(ying)(ying)性(xing)國(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)集(ji)中統(tong)一(yi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)有(you)序推(tui)進(jin)(jin)(jin)(jin),省級國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)比例(li)超(chao)過91%,全(quan)國(guo)(guo)(guo)(guo)24個地方監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)比例(li)超(chao)過95%。四是加快建(jian)(jian)設國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)企在(zai)線監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)系(xi)統(tong)。國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)企在(zai)線監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)系(xi)統(tong)建(jian)(jian)設取(qu)得實(shi)(shi)質性(xing)進(jin)(jin)(jin)(jin)展(zhan)(zhan),基(ji)本建(jian)(jian)成(cheng)涉企事項(xiang)網上服務(wu)(wu)大(da)(da)廳(ting),35項(xiang)常規業(ye)務(wu)(wu)實(shi)(shi)現網上辦理,推(tui)動(dong)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)向數字監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)、智慧(hui)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)轉變。統(tong)籌推(tui)進(jin)(jin)(jin)(jin)全(quan)國(guo)(guo)(guo)(guo)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)企在(zai)線監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)系(xi)統(tong)建(jian)(jian)設,促進(jin)(jin)(jin)(jin)形成(cheng)上下(xia)聯動(dong)的(de)信息化監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)格(ge)局(ju)(ju)。
(二)在法治軌道上扎實做好疫情防控和復工復產相關工作。一(yi)(yi)是加(jia)強組(zu)(zu)織領導(dao),健全工(gong)(gong)作(zuo)機制。第一(yi)(yi)時間(jian)成(cheng)立應對(dui)疫(yi)(yi)(yi)情(qing)(qing)(qing)工(gong)(gong)作(zuo)領導(dao)小組(zu)(zu),作(zuo)出全面(mian)部署(shu),加(jia)強對(dui)國(guo)(guo)資(zi)委(wei)和(he)(he)中(zhong)央企(qi)業疫(yi)(yi)(yi)情(qing)(qing)(qing)防(fang)控(kong)(kong)(kong)工(gong)(gong)作(zuo)的(de)領導(dao)。多(duo)(duo)措并舉確保(bao)國(guo)(guo)資(zi)委(wei)機關(guan)和(he)(he)直屬(shu)單位(wei)零感染(ran)(ran),主動作(zuo)為,及早成(cheng)立醫療(liao)物(wu)資(zi)保(bao)障專項(xiang)工(gong)(gong)作(zuo)組(zu)(zu)和(he)(he)境(jing)外疫(yi)(yi)(yi)情(qing)(qing)(qing)防(fang)控(kong)(kong)(kong)指(zhi)(zhi)導(dao)組(zu)(zu),指(zhi)(zhi)導(dao)企(qi)業依法(fa)(fa)做(zuo)(zuo)(zuo)好醫療(liao)物(wu)資(zi)保(bao)障和(he)(he)境(jing)外疫(yi)(yi)(yi)情(qing)(qing)(qing)風險排(pai)查防(fang)控(kong)(kong)(kong)等(deng)工(gong)(gong)作(zuo)。舉國(guo)(guo)資(zi)央企(qi)之力(li),盡銳出戰,奮(fen)力(li)奪取(qu)疫(yi)(yi)(yi)情(qing)(qing)(qing)防(fang)控(kong)(kong)(kong)和(he)(he)經營發(fa)展(zhan)雙勝利。二是強化(hua)疫(yi)(yi)(yi)情(qing)(qing)(qing)防(fang)控(kong)(kong)(kong)復工(gong)(gong)復產法(fa)(fa)治(zhi)保(bao)障。召開(kai)專題會議,對(dui)新冠病(bing)毒(du)疫(yi)(yi)(yi)苗(miao)研發(fa)、使用、接種(zhong)有(you)關(guan)法(fa)(fa)律問(wen)題進行研究分(fen)析,指(zhi)(zhi)導(dao)監督相關(guan)企(qi)業依法(fa)(fa)合(he)規(gui)開(kai)展(zhan)新冠病(bing)毒(du)疫(yi)(yi)(yi)苗(miao)研發(fa)生(sheng)產和(he)(he)使用等(deng)工(gong)(gong)作(zuo)。督促(cu)企(qi)業在做(zuo)(zuo)(zuo)好全面(mian)防(fang)控(kong)(kong)(kong)和(he)(he)確保(bao)依法(fa)(fa)合(he)規(gui)的(de)前(qian)提(ti)下(xia)有(you)序安排(pai)復工(gong)(gong)復產。配(pei)合(he)有(you)關(guan)部門做(zuo)(zuo)(zuo)好動物(wu)防(fang)疫(yi)(yi)(yi)法(fa)(fa)、傳染(ran)(ran)病(bing)防(fang)治(zhi)法(fa)(fa)修(xiu)訂工(gong)(gong)作(zuo),開(kai)展(zhan)野生(sheng)動物(wu)保(bao)護領域法(fa)(fa)規(gui)、規(gui)章、規(gui)范性文(wen)件(jian)清理。三是指(zhi)(zhi)導(dao)中(zhong)央企(qi)業依法(fa)(fa)防(fang)范涉疫(yi)(yi)(yi)風險。印發(fa)《關(guan)于依法(fa)(fa)防(fang)控(kong)(kong)(kong)疫(yi)(yi)(yi)情(qing)(qing)(qing)切實防(fang)范法(fa)(fa)律合(he)規(gui)風險的(de)通知(zhi)》等(deng)制度文(wen)件(jian),指(zhi)(zhi)導(dao)企(qi)業加(jia)強研判,切實防(fang)范防(fang)疫(yi)(yi)(yi)物(wu)資(zi)出口、境(jing)外施工(gong)(gong)等(deng)法(fa)(fa)律合(he)規(gui)風險。加(jia)強對(dui)境(jing)外項(xiang)目較多(duo)(duo)的(de)能源、建筑類企(qi)業依法(fa)(fa)防(fang)控(kong)(kong)(kong)境(jing)外疫(yi)(yi)(yi)情(qing)(qing)(qing)工(gong)(gong)作(zuo)的(de)調(diao)研指(zhi)(zhi)導(dao)。邀請有(you)關(guan)專家就(jiu)疫(yi)(yi)(yi)情(qing)(qing)(qing)期間(jian)不可抗力(li)原則適用和(he)(he)實務(wu)應對(dui)等(deng)問(wen)題作(zuo)專題培訓。
(三)強化對權力的制約和監督。一是嚴格落實(shi)(shi)依法(fa)決策(ce)(ce)機制。自覺(jue)(jue)(jue)落實(shi)(shi)《重(zhong)大行政(zheng)(zheng)決策(ce)(ce)程(cheng)序暫行條(tiao)例》,進一步規(gui)(gui)范(fan)議事程(cheng)序,推(tui)進決策(ce)(ce)科學化、民主化、法(fa)治化。強化對規(gui)(gui)章規(gui)(gui)范(fan)性文(wen)件、中(zhong)央企(qi)(qi)業(ye)章程(cheng)、改(gai)(gai)制重(zhong)組方(fang)案等的(de)(de)法(fa)律審(shen)核把關(guan),完善公(gong)平(ping)競爭審(shen)查機制。聘(pin)請11名法(fa)律專家擔任法(fa)律顧問,發揮(hui)法(fa)律顧問制度積極作(zuo)用。二(er)是自覺(jue)(jue)(jue)接受(shou)人大監督(du)。認(ren)真(zhen)落實(shi)(shi)全(quan)(quan)國(guo)人大常(chang)委(wei)會(hui)(hui)(hui)對企(qi)(qi)業(ye)國(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)管理(li)情(qing)(qing)況(kuang)(kuang)專項報告(gao)的(de)(de)審(shen)議意(yi)見,扎實(shi)(shi)推(tui)進整(zheng)(zheng)改(gai)(gai)落實(shi)(shi)。就(jiu)加(jia)強國(guo)有(you)(you)資(zi)(zi)(zi)本經(jing)(jing)營(ying)預算(suan)編報工(gong)作(zuo)、完善國(guo)有(you)(you)資(zi)(zi)(zi)本經(jing)(jing)營(ying)預算(suan)績效管理(li)問題,接受(shou)全(quan)(quan)國(guo)人大常(chang)委(wei)會(hui)(hui)(hui)問詢。配合(he)(he)做好全(quan)(quan)國(guo)人大常(chang)委(wei)會(hui)(hui)(hui)領導同志到(dao)國(guo)資(zi)(zi)(zi)委(wei)調研工(gong)作(zuo),協(xie)助組織(zhi)(zhi)召開(kai)(kai)企(qi)(qi)業(ye)國(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)管理(li)情(qing)(qing)況(kuang)(kuang)座談(tan)會(hui)(hui)(hui)并作(zuo)全(quan)(quan)面匯報。三(san)(san)是自覺(jue)(jue)(jue)接受(shou)審(shen)計(ji)監督(du)。成立由主要(yao)負(fu)責同志任組長(chang)的(de)(de)審(shen)計(ji)工(gong)作(zuo)領導小組,加(jia)強對委(wei)內(nei)審(shen)計(ji)的(de)(de)組織(zhi)(zhi)領導和統(tong)籌協(xie)調。積極支(zhi)持和配合(he)(he)審(shen)計(ji)署對國(guo)資(zi)(zi)(zi)委(wei)2019年(nian)預算(suan)執行和2020年(nian)政(zheng)(zheng)策(ce)(ce)跟(gen)蹤(zong)的(de)(de)審(shen)計(ji),全(quan)(quan)面提供資(zi)(zi)(zi)料、主動(dong)說明情(qing)(qing)況(kuang)(kuang),及時制定整(zheng)(zheng)改(gai)(gai)措施,認(ren)真(zhen)加(jia)以整(zheng)(zheng)改(gai)(gai)。堅持上下(xia)聯動(dong),及時督(du)促指導中(zhong)央企(qi)(qi)業(ye)整(zheng)(zheng)改(gai)(gai)審(shen)計(ji)發現的(de)(de)問題。四(si)是自覺(jue)(jue)(jue)接受(shou)社會(hui)(hui)(hui)監督(du)。認(ren)真(zhen)落實(shi)(shi)政(zheng)(zheng)務公(gong)開(kai)(kai)有(you)(you)關(guan)要(yao)求,規(gui)(gui)范(fan)做好信息(xi)公(gong)開(kai)(kai)工(gong)作(zuo)。依法(fa)依規(gui)(gui)公(gong)開(kai)(kai)中(zhong)央企(qi)(qi)業(ye)經(jing)(jing)濟運(yun)行情(qing)(qing)況(kuang)(kuang)、經(jing)(jing)營(ying)業(ye)績考核情(qing)(qing)況(kuang)(kuang)等信息(xi)。加(jia)強政(zheng)(zheng)策(ce)(ce)解讀力(li)度,全(quan)(quan)年(nian)組織(zhi)(zhi)召開(kai)(kai)13場(次)新聞發布活(huo)動(dong),主動(dong)回應社會(hui)(hui)(hui)關(guan)切。優化信息(xi)公(gong)開(kai)(kai)平(ping)臺建設,規(gui)(gui)范(fan)政(zheng)(zheng)務咨(zi)詢欄目留言辦理(li)工(gong)作(zuo)程(cheng)序。落實(shi)(shi)國(guo)企(qi)(qi)改(gai)(gai)革三(san)(san)年(nian)行動(dong)方(fang)案,部署推(tui)進中(zhong)央企(qi)(qi)業(ye)信息(xi)公(gong)開(kai)(kai)全(quan)(quan)覆(fu)蓋。
(四)完善國資監管法規制度體系。一是積(ji)極參與國家立(li)法(fa)工作(zuo)。深入(ru)開展《公(gong)司法(fa)》修改(gai)有關(guan)問題(ti)研(yan)究,組織起草(cao)配套辦法(fa),推動(dong)《政務處分(fen)法(fa)》規(gui)定落(luo)實落(luo)地。二是深入(ru)開展立(li)改(gai)廢釋工作(zuo)。編制2020年度立(li)法(fa)工作(zuo)計劃,加大計劃執行(xing)督促落(luo)實力度,圍繞業績考核(he)、章程管(guan)(guan)理、風險(xian)防范(fan)、產權(quan)管(guan)(guan)理等(deng)重點出臺(tai)規(gui)范(fan)性(xing)(xing)文件(jian)16件(jian)。深入(ru)開展規(gui)章規(gui)范(fan)性(xing)(xing)文件(jian)清理。截至2020年底,國資委現行(xing)有效(xiao)規(gui)章27件(jian),規(gui)范(fan)性(xing)(xing)文件(jian)221件(jian)。三(san)是加強重大立(li)法(fa)課(ke)題(ti)研(yan)究。完成完善國資監管(guan)(guan)法(fa)規(gui)制度體系(xi)課(ke)題(ti)研(yan)究項(xiang)目(mu),明確“十四五”時期健全國資監管(guan)(guan)法(fa)規(gui)制度體系(xi)的目(mu)標任務。
(五)深入推進法治央企建設。一是開(kai)展(zhan)法(fa)(fa)治(zhi)央(yang)(yang)企(qi)建(jian)設(she)總(zong)結驗收。全面(mian)(mian)總(zong)結5年(nian)(nian)來法(fa)(fa)治(zhi)央(yang)(yang)企(qi)建(jian)設(she)成效,深入查找短板和不(bu)足,及時推動整改提(ti)升。組織開(kai)展(zhan)中(zhong)(zhong)央(yang)(yang)企(qi)業(ye)(ye)(ye)(ye)(ye)優秀(xiu)(xiu)總(zong)法(fa)(fa)律(lv)(lv)顧問、優秀(xiu)(xiu)企(qi)業(ye)(ye)(ye)(ye)(ye)法(fa)(fa)律(lv)(lv)顧問和企(qi)業(ye)(ye)(ye)(ye)(ye)法(fa)(fa)律(lv)(lv)事(shi)務(wu)先進工(gong)作者(zhe)評(ping)比表彰,進一步激發(fa)企(qi)業(ye)(ye)(ye)(ye)(ye)法(fa)(fa)務(wu)人員(yuan)工(gong)作榮譽感和積(ji)極(ji)性。二(er)是強(qiang)化重(zhong)點領域(yu)合規(gui)管理(li)。編印中(zhong)(zhong)央(yang)(yang)企(qi)業(ye)(ye)(ye)(ye)(ye)合規(gui)管理(li)指南,指導(dao)企(qi)業(ye)(ye)(ye)(ye)(ye)切(qie)實防范合規(gui)風險(xian)。三是夯實糾紛案件(jian)管理(li)。全面(mian)(mian)分析2019年(nian)(nian)中(zhong)(zhong)央(yang)(yang)企(qi)業(ye)(ye)(ye)(ye)(ye)法(fa)(fa)律(lv)(lv)糾紛案件(jian)特點及原因,針對性指導(dao)企(qi)業(ye)(ye)(ye)(ye)(ye)加大案件(jian)處置力(li)度。開(kai)展(zhan)建(jian)筑行業(ye)(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)(ye)案件(jian)管理(li)“壓存控增、提(ti)質增效”專項行動。印發(fa)重(zhong)大案件(jian)督辦(ban)函,指導(dao)督促企(qi)業(ye)(ye)(ye)(ye)(ye)切(qie)實維(wei)護合法(fa)(fa)權益。
(六)扎實開展法治宣傳教育。一是(shi)突出法(fa)(fa)治(zhi)(zhi)(zhi)宣傳教育重(zhong)(zhong)點內(nei)(nei)容(rong)。將(jiang)學習(xi)領會習(xi)近平法(fa)(fa)治(zhi)(zhi)(zhi)思(si)想作為(wei)重(zhong)(zhong)大(da)政治(zhi)(zhi)(zhi)任(ren)務,切實(shi)發(fa)(fa)揮“關鍵少數”引領作用,國(guo)(guo)(guo)資委(wei)(wei)(wei)黨委(wei)(wei)(wei)帶頭認真學習(xi),吃透基本(ben)精神、把握(wo)核心要義(yi)、扎實(shi)抓(zhua)好落實(shi)。將(jiang)《民(min)法(fa)(fa)典》等重(zhong)(zhong)要法(fa)(fa)律法(fa)(fa)規納入國(guo)(guo)(guo)資委(wei)(wei)(wei)黨委(wei)(wei)(wei)理論學習(xi)中心組學習(xi)重(zhong)(zhong)要內(nei)(nei)容(rong),有力發(fa)(fa)揮領學促學作用。將(jiang)國(guo)(guo)(guo)資監(jian)管法(fa)(fa)規制度文件(jian)作為(wei)法(fa)(fa)治(zhi)(zhi)(zhi)宣傳教育重(zhong)(zhong)要內(nei)(nei)容(rong),及時(shi)通(tong)過網站、新媒體平臺對(dui)外公開(kai),采取多(duo)種形式(shi)加強宣傳解讀(du)。二是(shi)開(kai)展法(fa)(fa)治(zhi)(zhi)(zhi)建(jian)設專(zhuan)題(ti)培(pei)(pei)訓。面向國(guo)(guo)(guo)資委(wei)(wei)(wei)系統機關干部,舉辦(ban)法(fa)(fa)治(zhi)(zhi)(zhi)建(jian)設專(zhuan)題(ti)培(pei)(pei)訓班,提升干部法(fa)(fa)治(zhi)(zhi)(zhi)意識。面向中央企業、地(di)方(fang)國(guo)(guo)(guo)資委(wei)(wei)(wei)和國(guo)(guo)(guo)有企業,每兩月舉辦(ban)一期(qi)法(fa)(fa)治(zhi)(zhi)(zhi)講(jiang)堂,邀請專(zhuan)家(jia)講(jiang)授(shou)《民(min)法(fa)(fa)典》等法(fa)(fa)律法(fa)(fa)規,每期(qi)受眾(zhong)(zhong)超過2萬人。三(san)是(shi)創新普法(fa)(fa)方(fang)式(shi)方(fang)法(fa)(fa)。持續提升“互聯(lian)網+法(fa)(fa)治(zhi)(zhi)(zhi)宣傳”工(gong)作效能,充分利用門戶官網和微(wei)信公眾(zhong)(zhong)號等新媒體開(kai)展法(fa)(fa)治(zhi)(zhi)(zhi)宣傳教育。豐富普法(fa)(fa)活動,通(tong)過組織國(guo)(guo)(guo)家(jia)憲法(fa)(fa)日知(zhi)識競賽、優秀微(wei)視頻(pin)作品(pin)征集(ji)、班組學習(xi)等形式(shi),引導廣大(da)干部職工(gong)不斷增(zeng)強法(fa)(fa)治(zhi)(zhi)(zhi)意識和法(fa)(fa)治(zhi)(zhi)(zhi)能力。
(七)持續加強黨內法規制度建設。一(yi)是編制(zhi)(zhi)2020年(nian)黨(dang)(dang)委規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)制(zhi)(zhi)定計劃(hua),嚴格規(gui)(gui)范(fan)新增計劃(hua)外項目(mu)的報批程序,不斷(duan)增強(qiang)黨(dang)(dang)委規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)制(zhi)(zhi)定的科學性(xing)(xing)(xing)(xing)、計劃(hua)性(xing)(xing)(xing)(xing)和嚴肅性(xing)(xing)(xing)(xing)。全年(nian)制(zhi)(zhi)定黨(dang)(dang)委規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)6件(jian)(jian)(jian)。二是健全黨(dang)(dang)委規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)制(zhi)(zhi)定機制(zhi)(zhi)。落(luo)實(shi)中(zhong)央黨(dang)(dang)內(nei)法(fa)規(gui)(gui)要求(qiu),研究起(qi)草《國資委黨(dang)(dang)委規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)制(zhi)(zhi)定管理辦法(fa)》,進(jin)一(yi)步明確征求(qiu)意見、前置審核、審議簽批等程序規(gui)(gui)定,不斷(duan)健全黨(dang)(dang)內(nei)法(fa)規(gui)(gui)工(gong)作(zuo)(zuo)制(zhi)(zhi)度。認真開展(zhan)黨(dang)(dang)委規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)審查,按要求(qiu)做好文(wen)(wen)件(jian)(jian)(jian)備(bei)案(an)工(gong)作(zuo)(zuo)。三是加強(qiang)對中(zhong)央企業黨(dang)(dang)內(nei)法(fa)規(gui)(gui)制(zhi)(zhi)度建設(she)的指導督促。繼續開展(zhan)部分中(zhong)央企業黨(dang)(dang)委規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)備(bei)案(an)試點工(gong)作(zuo)(zuo),將8家企業列入試點,推(tui)動(dong)企業黨(dang)(dang)內(nei)法(fa)規(gui)(gui)制(zhi)(zhi)度建設(she)整體水(shui)平進(jin)一(yi)步提升。
三、存在問題和2021年工作打算
2020年,國資委法(fa)(fa)(fa)治(zhi)建(jian)(jian)設(she)(she)取得了(le)積極成(cheng)效,但(dan)與黨中央(yang)、國務院的(de)要(yao)(yao)求(qiu)以及國資國企(qi)改革(ge)發(fa)展新形勢新要(yao)(yao)求(qiu)相(xiang)比(bi),還(huan)(huan)存在著一(yi)些(xie)問題和(he)不足:一(yi)是(shi)學(xue)習宣傳(chuan)習近平法(fa)(fa)(fa)治(zhi)思想還(huan)(huan)需要(yao)(yao)進(jin)一(yi)步深入,廣大(da)干部職(zhi)工法(fa)(fa)(fa)治(zhi)意識和(he)法(fa)(fa)(fa)律(lv)素養仍需持(chi)續提升,運用(yong)法(fa)(fa)(fa)治(zhi)思維和(he)法(fa)(fa)(fa)治(zhi)方(fang)式開展工作的(de)能力還(huan)(huan)需要(yao)(yao)進(jin)一(yi)步培養。二(er)是(shi)國資監(jian)管領域法(fa)(fa)(fa)律(lv)制(zhi)度(du)(du)供給(gei)仍然不足,一(yi)些(xie)重大(da)改革(ge)成(cheng)果尚未及時制(zhi)度(du)(du)化(hua)、法(fa)(fa)(fa)律(lv)化(hua),法(fa)(fa)(fa)規(gui)制(zhi)度(du)(du)體(ti)(ti)系(xi)還(huan)(huan)不夠系(xi)統(tong)科(ke)學(xue)。三是(shi)國資監(jian)管體(ti)(ti)制(zhi)仍需進(jin)一(yi)步健全(quan),職(zhi)能轉變重點任務有(you)(you)待持(chi)續落實,差異化(hua)監(jian)管仍有(you)(you)差距(ju)。四是(shi)企(qi)業(ye)法(fa)(fa)(fa)治(zhi)建(jian)(jian)設(she)(she)工作總體(ti)(ti)還(huan)(huan)不平衡,中央(yang)企(qi)業(ye)子企(qi)業(ye)和(he)地方(fang)國有(you)(you)企(qi)業(ye)的(de)法(fa)(fa)(fa)治(zhi)建(jian)(jian)設(she)(she)仍較薄(bo)弱。
2021年,國(guo)資(zi)委(wei)(wei)將以習(xi)近平法(fa)治(zhi)(zhi)思想為指導(dao),持(chi)續(xu)落實法(fa)治(zhi)(zhi)政府建(jian)(jian)設(she)各項要求,重點(dian)做(zuo)好以下工作:一是(shi)深(shen)入學習(xi)貫(guan)徹習(xi)近平法(fa)治(zhi)(zhi)思想。籌備(bei)成立“八五”普法(fa)工作領導(dao)小組,在(zai)國(guo)資(zi)委(wei)(wei)系(xi)統深(shen)入學習(xi)宣傳習(xi)近平法(fa)治(zhi)(zhi)思想,加(jia)(jia)(jia)大普法(fa)力(li)度(du),不(bu)(bu)斷(duan)增強干部職(zhi)工依法(fa)行權(quan)履(lv)職(zhi)和依法(fa)辦(ban)事(shi)能力(li)水平。二是(shi)不(bu)(bu)斷(duan)完(wan)善國(guo)資(zi)監(jian)管法(fa)規制(zhi)度(du)體(ti)(ti)(ti)系(xi)。加(jia)(jia)(jia)強前瞻性(xing)研(yan)(yan)究,推(tui)(tui)動完(wan)善相(xiang)關法(fa)律法(fa)規。認(ren)真研(yan)(yan)究起草《政務處(chu)分法(fa)》配套辦(ban)法(fa),深(shen)入開展規章規范(fan)性(xing)文件清(qing)理,適時(shi)開展文件匯編。三(san)是(shi)持(chi)續(xu)深(shen)化國(guo)資(zi)監(jian)管職(zhi)能轉變。全口徑(jing)梳理面向中(zhong)(zhong)央(yang)企業(ye)(ye)和地方(fang)國(guo)資(zi)委(wei)(wei)的(de)工作事(shi)項,按(an)照中(zhong)(zhong)央(yang)統一部署,認(ren)真做(zuo)好權(quan)責(ze)清(qing)單編制(zhi)修(xiu)訂。加(jia)(jia)(jia)強國(guo)資(zi)委(wei)(wei)對混合(he)所(suo)有制(zhi)企業(ye)(ye)、股權(quan)多元化企業(ye)(ye)履(lv)行股東職(zhi)責(ze)的(de)研(yan)(yan)究,進一步規范(fan)履(lv)職(zhi)程序。四是(shi)不(bu)(bu)斷(duan)深(shen)化中(zhong)(zhong)央(yang)企業(ye)(ye)法(fa)治(zhi)(zhi)建(jian)(jian)設(she)。制(zhi)定進一步加(jia)(jia)(jia)強中(zhong)(zhong)央(yang)企業(ye)(ye)法(fa)治(zhi)(zhi)建(jian)(jian)設(she)的(de)指導(dao)意(yi)見(jian),明確“十四五”時(shi)期法(fa)治(zhi)(zhi)央(yang)企建(jian)(jian)設(she)總體(ti)(ti)(ti)思路(lu)、目標和舉措。推(tui)(tui)動中(zhong)(zhong)央(yang)企業(ye)(ye)建(jian)(jian)立健(jian)全合(he)規管理體(ti)(ti)(ti)系(xi),切(qie)實防范(fan)合(he)規風險。五是(shi)推(tui)(tui)動健(jian)全監(jian)督追責(ze)體(ti)(ti)(ti)系(xi),加(jia)(jia)(jia)大重大違規案(an)件查(cha)辦(ban)和警示力(li)度(du),不(bu)(bu)斷(duan)提(ti)升監(jian)督效能。
