國(guo)務院(yuan)國(guo)資(zi)委(wei)近日(ri)印發(fa)《中央(yang)企業工資(zi)總額管理辦(ban)法》(國(guo)資(zi)委(wei)令第39號,以下簡稱《辦(ban)法》)。
《辦法(fa)(fa)》以(yi)習近平(ping)新時代(dai)中國特色社會主(zhu)義思(si)想為(wei)指引(yin),以(yi)建(jian)立(li)健全與勞動力市場基本(ben)(ben)適應(ying)、與企業經濟效益和(he)勞動生(sheng)產率掛鉤的工資決(jue)定(ding)和(he)正常(chang)增(zeng)長機制,增(zeng)強企業活力和(he)動力,促進(jin)企業實現高質量發(fa)展,推動國有(you)資本(ben)(ben)做強做優做大(da)為(wei)目標,以(yi)出資人管(guan)資本(ben)(ben)為(wei)主(zhu)強化激勵約束建(jian)設為(wei)遵循(xun),按照《國務(wu)院關于改革國有(you)企業工資決(jue)定(ding)機制的意(yi)見(jian)(jian)》(國發(fa)〔2018〕16號,以(yi)下簡(jian)稱《意(yi)見(jian)(jian)》)精神,在(zai)繼承以(yi)往有(you)效經驗和(he)做法(fa)(fa)的基礎上,對現行(xing)中央企業工資總額管(guan)理相(xiang)關制度辦法(fa)(fa)進(jin)行(xing)修改和(he)完善(shan)。
《辦法》明確對(dui)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)工(gong)資總(zong)額實(shi)行分類(lei)管(guan)理(li)。對(dui)主(zhu)業(ye)(ye)(ye)處于充分競(jing)爭行業(ye)(ye)(ye)和領(ling)域(yu)(yu)的(de)(de)商業(ye)(ye)(ye)類(lei)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)工(gong)資總(zong)額預(yu)算(suan)原則上全部實(shi)行備案制管(guan)理(li),由企業(ye)(ye)(ye)董事(shi)會在依法依規(gui)的(de)(de)前提(ti)下,自主(zhu)決定年度工(gong)資總(zong)額預(yu)算(suan),國(guo)資委由事(shi)前核(he)準(zhun)轉變(bian)為事(shi)前引(yin)導(dao)、事(shi)中(zhong)(zhong)監測和事(shi)后監督;對(dui)主(zhu)業(ye)(ye)(ye)處于關系(xi)國(guo)家安全、國(guo)民經濟(ji)命(ming)脈的(de)(de)重要行業(ye)(ye)(ye)和關鍵領(ling)域(yu)(yu)、主(zhu)要承擔重大(da)專項(xiang)任務(wu)的(de)(de)商業(ye)(ye)(ye)類(lei)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)和以提(ti)供公(gong)(gong)共產品或服務(wu)為主(zhu)的(de)(de)公(gong)(gong)益類(lei)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye),工(gong)資總(zong)額預(yu)算(suan)繼續實(shi)行核(he)準(zhun)制管(guan)理(li);對(dui)開展國(guo)有(you)資本投(tou)資、運營公(gong)(gong)司或者混合所有(you)制改革等試點的(de)(de)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye),提(ti)出可以探索實(shi)行更加靈活高效的(de)(de)工(gong)資總(zong)額管(guan)理(li)方式(shi)。
《辦(ban)(ban)(ban)法》明確對中央企(qi)業(ye)(ye)(ye)工資(zi)總(zong)額(e)實(shi)行(xing)分(fen)(fen)級管(guan)(guan)理(li)。按照《中共中央 國務院(yuan)關于深化國有企(qi)業(ye)(ye)(ye)改革的指導意見》(中發〔2015〕22號,以下簡稱中發22號文件)、《國務院(yuan)辦(ban)(ban)(ban)公廳關于轉發國務院(yuan)國資(zi)委以管(guan)(guan)資(zi)本為(wei)主推進(jin)職(zhi)能(neng)轉變(bian)方案的通知》(國辦(ban)(ban)(ban)發〔2017〕38號)要求,結合當前(qian)中央企(qi)業(ye)(ye)(ye)工資(zi)總(zong)額(e)管(guan)(guan)理(li)實(shi)際(ji),強調中央企(qi)業(ye)(ye)(ye)工資(zi)總(zong)額(e)實(shi)行(xing)分(fen)(fen)級管(guan)(guan)理(li)體制(zhi),國資(zi)委與中央企(qi)業(ye)(ye)(ye)權責(ze)清晰、各司其職(zhi),國資(zi)委負(fu)責(ze)管(guan)(guan)制(zhi)度、管(guan)(guan)總(zong)量、管(guan)(guan)監(jian)督,中央企(qi)業(ye)(ye)(ye)負(fu)責(ze)管(guan)(guan)內(nei)部(bu)自主分(fen)(fen)配、管(guan)(guan)預算分(fen)(fen)解落實(shi)、管(guan)(guan)具體操作執行(xing)。
《辦(ban)法》緊(jin)緊(jin)圍繞中(zhong)發22號文件和《意(yi)見》關(guan)于(yu)“建立健全與勞(lao)動力市場(chang)基(ji)本適應、與企(qi)業(ye)(ye)(ye)(ye)經濟(ji)效(xiao)益(yi)和勞(lao)動生(sheng)產率掛(gua)鉤的(de)(de)工(gong)資(zi)(zi)(zi)(zi)決定(ding)和正常增長(chang)(chang)機制(zhi)”的(de)(de)要(yao)求(qiu),明確(que)規定(ding)中(zhong)央(yang)企(qi)業(ye)(ye)(ye)(ye)工(gong)資(zi)(zi)(zi)(zi)總額(e)預算主(zhu)要(yao)按照(zhao)效(xiao)益(yi)決定(ding)、效(xiao)率調(diao)(diao)整、水(shui)平(ping)調(diao)(diao)控(kong)三個環(huan)節決定(ding)。一(yi)是中(zhong)央(yang)企(qi)業(ye)(ye)(ye)(ye)工(gong)資(zi)(zi)(zi)(zi)總額(e)預算與利潤總額(e)等(deng)經濟(ji)效(xiao)益(yi)指(zhi)標(biao)的(de)(de)業(ye)(ye)(ye)(ye)績考核目(mu)(mu)(mu)標(biao)值掛(gua)鉤,并且(qie)根據目(mu)(mu)(mu)標(biao)值的(de)(de)先進(jin)程度(du)確(que)定(ding)不同(tong)的(de)(de)預算水(shui)平(ping),引(yin)導中(zhong)央(yang)企(qi)業(ye)(ye)(ye)(ye)通過(guo)(guo)完成高(gao)質量發展目(mu)(mu)(mu)標(biao),帶動職(zhi)工(gong)工(gong)資(zi)(zi)(zi)(zi)總額(e)合(he)理(li)有(you)(you)序增長(chang)(chang)。二是工(gong)資(zi)(zi)(zi)(zi)增長(chang)(chang)還應當通過(guo)(guo)人工(gong)成本投入產出(chu)效(xiao)率、勞(lao)動生(sheng)產率等(deng)指(zhi)標(biao)對標(biao)進(jin)行(xing)調(diao)(diao)整,進(jin)一(yi)步協(xie)調(diao)(diao)不同(tong)效(xiao)率的(de)(de)企(qi)業(ye)(ye)(ye)(ye)之(zhi)間(jian)工(gong)資(zi)(zi)(zi)(zi)分(fen)(fen)配關(guan)系,提高(gao)企(qi)業(ye)(ye)(ye)(ye)工(gong)資(zi)(zi)(zi)(zi)總額(e)決定(ding)機制(zhi)的(de)(de)科學(xue)性與有(you)(you)效(xiao)性。三是注重收入分(fen)(fen)配公(gong)平(ping),國資(zi)(zi)(zi)(zi)委(wei)將(jiang)按照(zhao)國家有(you)(you)關(guan)部(bu)門發布的(de)(de)工(gong)資(zi)(zi)(zi)(zi)指(zhi)導線和對非競爭類國有(you)(you)企(qi)業(ye)(ye)(ye)(ye)的(de)(de)工(gong)資(zi)(zi)(zi)(zi)調(diao)(diao)控(kong)要(yao)求(qiu),對部(bu)分(fen)(fen)工(gong)資(zi)(zi)(zi)(zi)水(shui)平(ping)偏高(gao)、過(guo)(guo)高(gao)的(de)(de)行(xing)業(ye)(ye)(ye)(ye)與企(qi)業(ye)(ye)(ye)(ye),尤(you)其是主(zhu)業(ye)(ye)(ye)(ye)不屬于(yu)充分(fen)(fen)競爭行(xing)業(ye)(ye)(ye)(ye)和領域的(de)(de)企(qi)業(ye)(ye)(ye)(ye)工(gong)資(zi)(zi)(zi)(zi)增長(chang)(chang)過(guo)(guo)快的(de)(de)情況進(jin)行(xing)適當約束(shu),確(que)保(bao)企(qi)業(ye)(ye)(ye)(ye)職(zhi)工(gong)工(gong)資(zi)(zi)(zi)(zi)的(de)(de)水(shui)平(ping)與增長(chang)(chang)幅度(du)更(geng)加公(gong)平(ping)合(he)理(li)、規范有(you)(you)序。同(tong)時,對中(zhong)央(yang)企(qi)業(ye)(ye)(ye)(ye)承擔(dan)重大(da)專項任務、重大(da)科技創新項目(mu)(mu)(mu)等(deng)特(te)殊(shu)事項的(de)(de),《辦(ban)法》也明確(que)將(jiang)予以(yi)適度(du)支持。
《辦法》在(zai)從宏觀層面(mian)完善國家(jia)、企(qi)(qi)(qi)業和(he)職(zhi)工(gong)三者(zhe)工(gong)資分(fen)配(pei)關系,加(jia)大(da)出資人(ren)向中(zhong)央企(qi)(qi)(qi)業董事(shi)會授權的(de)(de)同(tong)時,也同(tong)步對(dui)責任落實(shi)和(he)制(zhi)度配(pei)套(tao)進行了規定(ding)。一是強調企(qi)(qi)(qi)業作為內部(bu)(bu)分(fen)配(pei)的(de)(de)責任主體,應(ying)當(dang)持續(xu)深化內部(bu)(bu)三項制(zhi)度改革(ge),構建企(qi)(qi)(qi)業內部(bu)(bu)管(guan)理人(ren)員(yuan)能(neng)上(shang)能(neng)下、員(yuan)工(gong)能(neng)進能(neng)出、收入(ru)能(neng)增(zeng)能(neng)減的(de)(de)市場化勞動用工(gong)和(he)收入(ru)分(fen)配(pei)管(guan)理機制(zhi),切實(shi)承擔起搞(gao)好、搞(gao)活企(qi)(qi)(qi)業內部(bu)(bu)分(fen)配(pei)的(de)(de)職(zhi)責。二是加(jia)強監(jian)督檢查,明確(que)界(jie)定(ding)企(qi)(qi)(qi)業違規責任,并將企(qi)(qi)(qi)業工(gong)資總額管(guan)理情況納(na)入(ru)各項監(jian)督檢查范圍,與審計、巡視等工(gong)作形成合力,確(que)保實(shi)現(xian)權責對(dui)等,監(jian)管(guan)到(dao)位。
