體系建設有關事項的通知

各省、自治區、直轄市及計劃單列市和新疆生產建設兵團國資委:

《國(guo)務院辦公廳關于建(jian)(jian)(jian)立(li)國(guo)有企業(ye)違(wei)規經(jing)營(ying)投資(zi)(zi)(zi)(zi)責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)制(zhi)度的(de)(de)意見》(國(guo)辦發〔2016〕63號,以下簡(jian)稱63號文件)要求(qiu)在2020年年底(di)前,全(quan)面建(jian)(jian)(jian)立(li)覆蓋(gai)各級履行出資(zi)(zi)(zi)(zi)人(ren)職責(ze)(ze)(ze)(ze)的(de)(de)機構及(ji)國(guo)有企業(ye)的(de)(de)責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)體(ti)(ti)系,形成職責(ze)(ze)(ze)(ze)明確、流程清晰、規范有序的(de)(de)責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)機制(zhi)。各地(di)(di)國(guo)資(zi)(zi)(zi)(zi)委(wei)高度重視,積極推進(jin)違(wei)規經(jing)營(ying)投資(zi)(zi)(zi)(zi)責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)制(zhi)度機制(zhi)和(he)組(zu)織體(ti)(ti)系建(jian)(jian)(jian)設(she),35個地(di)(di)方(含計劃單列市和(he)新(xin)疆生產建(jian)(jian)(jian)設(she)兵團(tuan))出臺了(le)(le)(le)違(wei)規經(jing)營(ying)投資(zi)(zi)(zi)(zi)責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)制(zhi)度,設(she)立(li)或明確了(le)(le)(le)專門部門承擔責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)職責(ze)(ze)(ze)(ze),實(shi)現了(le)(le)(le)責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)有序平穩起步(bu),為推動(dong)企業(ye)高質(zhi)量(liang)發展發揮了(le)(le)(le)積極作(zuo)用。但由于責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)政(zheng)策性強、涉及(ji)面廣,工(gong)作(zuo)處于探索階段,仍存在對違(wei)規責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)重要性認(ren)識(shi)不到位,體(ti)(ti)系建(jian)(jian)(jian)設(she)工(gong)作(zuo)相(xiang)對滯后(hou),保障機制(zhi)還比較薄弱等(deng)問題。為進(jin)一(yi)步(bu)推動(dong)各級履行出資(zi)(zi)(zi)(zi)人(ren)職責(ze)(ze)(ze)(ze)的(de)(de)機構及(ji)國(guo)有企業(ye)責(ze)(ze)(ze)(ze)任追究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)體(ti)(ti)系建(jian)(jian)(jian)設(she),按期完(wan)成2020年年底(di)工(gong)作(zuo)目標,現將有關事(shi)項通知(zhi)如(ru)下:

一、提高政治站位,深化對責任追究工作重要性的認識。黨中央、國(guo)務(wu)院高度重(zhong)視強化(hua)國(guo)有(you)(you)(you)資(zi)(zi)產(chan)監管、落(luo)實(shi)國(guo)有(you)(you)(you)企(qi)(qi)業(ye)經(jing)(jing)(jing)營(ying)投資(zi)(zi)責任(ren)(ren),黨的(de)(de)十(shi)八(ba)屆三(san)中全會以及國(guo)資(zi)(zi)國(guo)企(qi)(qi)改(gai)革系(xi)(xi)列文件對強化(hua)經(jing)(jing)(jing)營(ying)投資(zi)(zi)責任(ren)(ren)追(zhui)究,建立健全國(guo)有(you)(you)(you)企(qi)(qi)業(ye)重(zhong)大(da)決(jue)策失(shi)誤和失(shi)職、瀆職責任(ren)(ren)追(zhui)究倒查機(ji)制等提出(chu)了明確(que)要(yao)求。各地國(guo)資(zi)(zi)委(wei)要(yao)站(zhan)在守(shou)護好全體人(ren)民共同財富的(de)(de)高度,深刻理解責任(ren)(ren)追(zhui)究工作(zuo)在有(you)(you)(you)效防止(zhi)國(guo)有(you)(you)(you)資(zi)(zi)產(chan)流失(shi)、落(luo)實(shi)國(guo)有(you)(you)(you)資(zi)(zi)產(chan)保值(zhi)增值(zhi)責任(ren)(ren)方面的(de)(de)重(zhong)要(yao)作(zuo)用(yong),將推進(jin)(jin)責任(ren)(ren)追(zhui)究工作(zuo)體系(xi)(xi)建設作(zuo)為提升(sheng)國(guo)有(you)(you)(you)企(qi)(qi)業(ye)合(he)規(gui)經(jing)(jing)(jing)營(ying)水平(ping)和防范化(hua)解重(zhong)大(da)風險的(de)(de)重(zhong)要(yao)抓手,通過有(you)(you)(you)效開展(zhan)責任(ren)(ren)追(zhui)究工作(zuo),促進(jin)(jin)各級經(jing)(jing)(jing)營(ying)管理人(ren)員規(gui)范履(lv)職、勤勉盡責,推動企(qi)(qi)業(ye)提升(sheng)合(he)規(gui)經(jing)(jing)(jing)營(ying)管理水平(ping)。

二、持續完善責任追究制度體系,實現制度全面覆蓋和有效約束。各地國(guo)資(zi)(zi)委要(yao)加(jia)快構(gou)建內容協調、流程清晰、配套(tao)完備、有(you)(you)效(xiao)管(guan)用(yong)的責(ze)(ze)(ze)(ze)任(ren)追(zhui)究(jiu)制(zhi)度(du)(du)體(ti)系。要(yao)根據地區具體(ti)情況、企業(ye)規(gui)模體(ti)量差異、業(ye)務模式特(te)點等,制(zhi)定(ding)(ding)履行出資(zi)(zi)人職責(ze)(ze)(ze)(ze)的機(ji)構(gou)及(ji)國(guo)有(you)(you)企業(ye)違(wei)規(gui)經(jing)營(ying)投(tou)資(zi)(zi)責(ze)(ze)(ze)(ze)任(ren)追(zhui)究(jiu)制(zhi)度(du)(du),細(xi)化各類經(jing)營(ying)投(tou)資(zi)(zi)責(ze)(ze)(ze)(ze)任(ren)條款和(he)清單,明(ming)確責(ze)(ze)(ze)(ze)任(ren)追(zhui)究(jiu)范(fan)圍、劃分資(zi)(zi)產損(sun)(sun)失(shi)標準(zhun),規(gui)范(fan)責(ze)(ze)(ze)(ze)任(ren)追(zhui)究(jiu)工(gong)作流程,研究(jiu)制(zhi)定(ding)(ding)損(sun)(sun)失(shi)認(ren)定(ding)(ding)、責(ze)(ze)(ze)(ze)任(ren)認(ren)定(ding)(ding)等實(shi)(shi)施細(xi)則,實(shi)(shi)現(xian)責(ze)(ze)(ze)(ze)任(ren)追(zhui)究(jiu)工(gong)作標準(zhun)一(yi)致(zhi)、有(you)(you)章可循、規(gui)范(fan)有(you)(you)序。2019年(nian)年(nian)底(di)前,要(yao)確保實(shi)(shi)現(xian)省級(ji)違(wei)規(gui)經(jing)營(ying)投(tou)資(zi)(zi)責(ze)(ze)(ze)(ze)任(ren)追(zhui)究(jiu)制(zhi)度(du)(du)全覆(fu)(fu)蓋。2020年(nian)6月(yue)底(di)前,要(yao)實(shi)(shi)現(xian)各級(ji)國(guo)有(you)(you)資(zi)(zi)產監(jian)督管(guan)理機(ji)構(gou)及(ji)國(guo)有(you)(you)企業(ye)責(ze)(ze)(ze)(ze)任(ren)追(zhui)究(jiu)制(zhi)度(du)(du)全覆(fu)(fu)蓋,同時做好(hao)制(zhi)度(du)(du)備案工(gong)作。

三、加快推進組織體系建設,完善追責工作運行機制。各(ge)(ge)地(di)國(guo)資委(wei)要健全(quan)責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)追(zhui)究組(zu)織(zhi)體(ti)(ti)(ti)(ti)系(xi),嚴格(ge)落實(shi)(shi)(shi)責(ze)(ze)(ze)(ze)(ze)(ze)任(ren),層(ceng)(ceng)層(ceng)(ceng)傳導壓力(li),持續深入推(tui)進(jin)責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)追(zhui)究工(gong)(gong)作(zuo)(zuo)。要根據地(di)方(fang)機(ji)構改革總體(ti)(ti)(ti)(ti)安排(pai),科學設(she)立或(huo)明(ming)確具體(ti)(ti)(ti)(ti)部門承(cheng)擔責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)追(zhui)究工(gong)(gong)作(zuo)(zuo)。同(tong)時結(jie)合(he)(he)地(di)方(fang)和企業實(shi)(shi)(shi)際(ji)、行業特(te)點(dian)等,推(tui)進(jin)責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)追(zhui)究工(gong)(gong)作(zuo)(zuo)組(zu)織(zhi)體(ti)(ti)(ti)(ti)系(xi)建(jian)設(she),壓實(shi)(shi)(shi)責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)追(zhui)究主體(ti)(ti)(ti)(ti)責(ze)(ze)(ze)(ze)(ze)(ze)任(ren),實(shi)(shi)(shi)現監(jian)督追(zhui)責(ze)(ze)(ze)(ze)(ze)(ze)組(zu)織(zhi)體(ti)(ti)(ti)(ti)系(xi)全(quan)覆蓋。各(ge)(ge)地(di)國(guo)資委(wei)和所監(jian)管(guan)國(guo)有企業要配(pei)(pei)齊配(pei)(pei)強配(pei)(pei)優(you)工(gong)(gong)作(zuo)(zuo)隊伍,提(ti)升(sheng)工(gong)(gong)作(zuo)(zuo)人員專業能(neng)力(li),提(ti)供必要的(de)保障條件,確保工(gong)(gong)作(zuo)(zuo)有效開展。要完善聯(lian)合(he)(he)實(shi)(shi)(shi)施、協(xie)同(tong)聯(lian)動(dong)(dong)的(de)工(gong)(gong)作(zuo)(zuo)機(ji)制,加強與紀檢監(jian)察、巡視、審(shen)計(ji)、人力(li)資源(yuan)等部門的(de)協(xie)同(tong)配(pei)(pei)合(he)(he)。要努力(li)提(ti)升(sheng)工(gong)(gong)作(zuo)(zuo)信息(xi)(xi)化水平,推(tui)進(jin)信息(xi)(xi)系(xi)統建(jian)設(she),力(li)爭(zheng)實(shi)(shi)(shi)現損失風(feng)險(xian)動(dong)(dong)態監(jian)測(ce)和責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)追(zhui)究工(gong)(gong)作(zuo)(zuo)全(quan)流(liu)(liu)程信息(xi)(xi)管(guan)理。2020年(nian)年(nian)底前(qian)形成職責(ze)(ze)(ze)(ze)(ze)(ze)明(ming)確、流(liu)(liu)程清晰、規(gui)范有序的(de)責(ze)(ze)(ze)(ze)(ze)(ze)任(ren)追(zhui)究工(gong)(gong)作(zuo)(zuo)機(ji)制。

四、堅持分級組織分類處理,扎實做好違規責任追究工作。各(ge)地(di)國資(zi)(zi)(zi)委要(yao)(yao)按照國有資(zi)(zi)(zi)本出資(zi)(zi)(zi)關(guan)系和(he)干(gan)部(bu)管理(li)權限,界定(ding)(ding)(ding)責任(ren)追(zhui)究工(gong)作(zuo)職責,分級組織開(kai)(kai)展責任(ren)追(zhui)究工(gong)作(zuo)。要(yao)(yao)堅(jian)持(chi)違(wei)規(gui)必(bi)究,追(zhui)責必(bi)嚴,切實增強(qiang)國資(zi)(zi)(zi)監管法規(gui)制(zhi)度和(he)企業內部(bu)管理(li)規(gui)定(ding)(ding)(ding)剛性(xing)約(yue)束。要(yao)(yao)強(qiang)化對違(wei)規(gui)經(jing)營投資(zi)(zi)(zi)責任(ren)追(zhui)究定(ding)(ding)(ding)性(xing)、定(ding)(ding)(ding)損(sun)、定(ding)(ding)(ding)責等關(guan)鍵環節的(de)指導把關(guan)和(he)監督檢查,積(ji)極探(tan)索有效的(de)工(gong)作(zuo)方式方法。要(yao)(yao)加強(qiang)案例通(tong)報(bao),在(zai)適(shi)當(dang)范圍總結、通(tong)報(bao)及公開(kai)(kai)違(wei)規(gui)經(jing)營投資(zi)(zi)(zi)責任(ren)追(zhui)究處理(li)情況,以案為鑒,發(fa)揮“追(zhui)責一個、警示(shi)一片”的(de)警示(shi)教育作(zuo)用。

五、堅持糾建并舉,健全以追責促發展的長效機制。責(ze)(ze)任追究(jiu)(jiu)是(shi)手段不是(shi)目的(de),各地(di)國資委與所監管國有企業都要(yao)(yao)(yao)(yao)注重做好(hao)監督追責(ze)(ze)“后半篇文章”,把追責(ze)(ze)成果(guo)轉化為促進企業健(jian)康發(fa)展(zhan)的(de)監管效能。要(yao)(yao)(yao)(yao)以追責(ze)(ze)促追損,及(ji)時化解資產損失風(feng)險,防止國有資產流失。要(yao)(yao)(yao)(yao)舉一(yi)反三,以點帶面(mian),深入開(kai)展(zhan)共(gong)性(xing)問題(ti)核查(cha),排查(cha)問題(ti)隱患,預(yu)警提示經(jing)營風(feng)險。要(yao)(yao)(yao)(yao)以責(ze)(ze)任追究(jiu)(jiu)為重要(yao)(yao)(yao)(yao)抓手,通過懲治(zhi)教育和制度建設相結合,強化國有企業各級經(jing)營管理(li)人(ren)員合規履(lv)職的(de)自覺性(xing)和主動性(xing),全面(mian)推進依法治(zhi)企,有效促進企業穩健(jian)經(jing)營和可持續發(fa)展(zhan)。

各(ge)省級國資委要按照目(mu)標要求,細化(hua)任務(wu)舉措,扎實(shi)推進(jin)各(ge)項工作,請于(yu)2020年6月30日前書面(mian)報(bao)告階段性進(jin)展情況,于(yu)2020年12月底前報(bao)送(song)63號文件目(mu)標任務(wu)完成情況。
