國務院國資(zi)委(wei)近日印發《中(zhong)央企業工資(zi)總額(e)管(guan)理(li)辦(ban)法(fa)》(國資(zi)委(wei)令(ling)第39號,以(yi)下簡稱《辦(ban)法(fa)》)。
《辦法》以(yi)習近平新時(shi)代中國特色社會主義思想為(wei)指引(yin),以(yi)建(jian)立健全與(yu)勞(lao)動力(li)(li)市場基本(ben)適應、與(yu)企(qi)業(ye)經(jing)濟效益(yi)和(he)(he)勞(lao)動生產率掛鉤的工資(zi)(zi)(zi)決(jue)定(ding)(ding)和(he)(he)正常(chang)增長(chang)機(ji)制(zhi),增強(qiang)企(qi)業(ye)活力(li)(li)和(he)(he)動力(li)(li),促進企(qi)業(ye)實現(xian)高質量發(fa)展,推動國有資(zi)(zi)(zi)本(ben)做強(qiang)做優做大為(wei)目標,以(yi)出資(zi)(zi)(zi)人管資(zi)(zi)(zi)本(ben)為(wei)主強(qiang)化激勵約束建(jian)設為(wei)遵循,按照《國務院關于改(gai)革國有企(qi)業(ye)工資(zi)(zi)(zi)決(jue)定(ding)(ding)機(ji)制(zhi)的意(yi)見》(國發(fa)〔2018〕16號,以(yi)下簡稱《意(yi)見》)精神,在繼承(cheng)以(yi)往(wang)有效經(jing)驗和(he)(he)做法的基礎(chu)上(shang),對(dui)現(xian)行(xing)中央(yang)企(qi)業(ye)工資(zi)(zi)(zi)總(zong)額管理相關制(zhi)度辦法進行(xing)修改(gai)和(he)(he)完善。
《辦法》明(ming)確對中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額(e)(e)(e)實行(xing)分類(lei)管(guan)(guan)理。對主(zhu)業(ye)(ye)處于(yu)(yu)充(chong)分競爭行(xing)業(ye)(ye)和(he)領(ling)域的商業(ye)(ye)類(lei)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額(e)(e)(e)預(yu)算(suan)(suan)原則上(shang)全(quan)部實行(xing)備案制(zhi)管(guan)(guan)理,由(you)企(qi)業(ye)(ye)董事(shi)會(hui)在依法依規的前(qian)提下,自主(zhu)決定(ding)年度工(gong)資(zi)(zi)總額(e)(e)(e)預(yu)算(suan)(suan),國(guo)(guo)資(zi)(zi)委由(you)事(shi)前(qian)核(he)準轉變為事(shi)前(qian)引導、事(shi)中(zhong)(zhong)(zhong)(zhong)監(jian)測和(he)事(shi)后監(jian)督;對主(zhu)業(ye)(ye)處于(yu)(yu)關系國(guo)(guo)家安(an)全(quan)、國(guo)(guo)民(min)經(jing)濟命脈的重要行(xing)業(ye)(ye)和(he)關鍵領(ling)域、主(zhu)要承擔重大專項任務的商業(ye)(ye)類(lei)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye)和(he)以提供(gong)公共(gong)產品或服(fu)務為主(zhu)的公益類(lei)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye),工(gong)資(zi)(zi)總額(e)(e)(e)預(yu)算(suan)(suan)繼續實行(xing)核(he)準制(zhi)管(guan)(guan)理;對開展國(guo)(guo)有資(zi)(zi)本投資(zi)(zi)、運營公司或者混合所有制(zhi)改(gai)革等試點的中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye),提出(chu)可以探索實行(xing)更加靈(ling)活(huo)高效的工(gong)資(zi)(zi)總額(e)(e)(e)管(guan)(guan)理方(fang)式。
《辦法》明確對中央企(qi)(qi)業工資(zi)總(zong)額實(shi)行(xing)分級管(guan)理(li)。按(an)照《中共中央 國(guo)務院(yuan)(yuan)關于(yu)深化國(guo)有企(qi)(qi)業改革(ge)的指導意(yi)見》(中發(fa)〔2015〕22號(hao),以下簡稱中發(fa)22號(hao)文件)、《國(guo)務院(yuan)(yuan)辦公廳關于(yu)轉(zhuan)發(fa)國(guo)務院(yuan)(yuan)國(guo)資(zi)委以管(guan)資(zi)本為主推進職能轉(zhuan)變方案(an)的通知》(國(guo)辦發(fa)〔2017〕38號(hao))要求,結(jie)合當前中央企(qi)(qi)業工資(zi)總(zong)額管(guan)理(li)實(shi)際,強調中央企(qi)(qi)業工資(zi)總(zong)額實(shi)行(xing)分級管(guan)理(li)體制,國(guo)資(zi)委與中央企(qi)(qi)業權責清(qing)晰、各司其(qi)職,國(guo)資(zi)委負(fu)責管(guan)制度、管(guan)總(zong)量、管(guan)監督(du),中央企(qi)(qi)業負(fu)責管(guan)內部自(zi)主分配(pei)、管(guan)預算分解落(luo)實(shi)、管(guan)具體操作執行(xing)。
《辦法(fa)》緊(jin)緊(jin)圍繞中發(fa)(fa)22號文件和《意見》關(guan)于“建立健全與(yu)勞(lao)(lao)動(dong)(dong)力市(shi)場(chang)基本適應、與(yu)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)經濟效(xiao)益(yi)和勞(lao)(lao)動(dong)(dong)生產率掛(gua)鉤(gou)的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)決定和正(zheng)常(chang)增(zeng)(zeng)(zeng)長機制”的(de)(de)(de)要求,明(ming)確(que)(que)規定中央企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)總額預算主要按照效(xiao)益(yi)決定、效(xiao)率調(diao)整、水(shui)平(ping)(ping)調(diao)控(kong)三(san)個環節決定。一(yi)是中央企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)總額預算與(yu)利潤(run)總額等經濟效(xiao)益(yi)指(zhi)標(biao)的(de)(de)(de)業(ye)(ye)(ye)(ye)績考核目標(biao)值掛(gua)鉤(gou),并(bing)且根據目標(biao)值的(de)(de)(de)先(xian)進(jin)程(cheng)度確(que)(que)定不同(tong)的(de)(de)(de)預算水(shui)平(ping)(ping),引導中央企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)通過完成(cheng)高(gao)質量發(fa)(fa)展目標(biao),帶動(dong)(dong)職工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)總額合理(li)(li)有序增(zeng)(zeng)(zeng)長。二是工(gong)(gong)資(zi)(zi)(zi)增(zeng)(zeng)(zeng)長還應當(dang)通過人(ren)工(gong)(gong)成(cheng)本投入產出效(xiao)率、勞(lao)(lao)動(dong)(dong)生產率等指(zhi)標(biao)對標(biao)進(jin)行調(diao)整,進(jin)一(yi)步協調(diao)不同(tong)效(xiao)率的(de)(de)(de)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)之間工(gong)(gong)資(zi)(zi)(zi)分(fen)配關(guan)系,提高(gao)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)總額決定機制的(de)(de)(de)科學性與(yu)有效(xiao)性。三(san)是注重(zhong)收入分(fen)配公平(ping)(ping),國資(zi)(zi)(zi)委將(jiang)(jiang)按照國家(jia)有關(guan)部門發(fa)(fa)布(bu)的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)指(zhi)導線和對非競(jing)爭類(lei)國有企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)調(diao)控(kong)要求,對部分(fen)工(gong)(gong)資(zi)(zi)(zi)水(shui)平(ping)(ping)偏(pian)高(gao)、過高(gao)的(de)(de)(de)行業(ye)(ye)(ye)(ye)與(yu)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye),尤其(qi)是主業(ye)(ye)(ye)(ye)不屬于充分(fen)競(jing)爭行業(ye)(ye)(ye)(ye)和領(ling)域(yu)的(de)(de)(de)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)增(zeng)(zeng)(zeng)長過快的(de)(de)(de)情況進(jin)行適當(dang)約束,確(que)(que)保企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)職工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de)水(shui)平(ping)(ping)與(yu)增(zeng)(zeng)(zeng)長幅度更加公平(ping)(ping)合理(li)(li)、規范有序。同(tong)時,對中央企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)承擔(dan)重(zhong)大專項(xiang)(xiang)任(ren)務、重(zhong)大科技創新項(xiang)(xiang)目等特殊(shu)事項(xiang)(xiang)的(de)(de)(de),《辦法(fa)》也明(ming)確(que)(que)將(jiang)(jiang)予(yu)以(yi)適度支持(chi)。
《辦法》在從宏觀(guan)層面完善(shan)國家、企業(ye)(ye)和(he)職工三者工資(zi)分(fen)配關系(xi),加(jia)大(da)出資(zi)人向中(zhong)央企業(ye)(ye)董事會授權(quan)的(de)同時(shi),也同步對(dui)責(ze)任落實(shi)和(he)制度配套(tao)進行了規定(ding)。一是強(qiang)調企業(ye)(ye)作為(wei)內(nei)(nei)部分(fen)配的(de)責(ze)任主體,應當持續深化內(nei)(nei)部三項(xiang)制度改革,構建企業(ye)(ye)內(nei)(nei)部管(guan)(guan)理(li)(li)人員(yuan)能(neng)(neng)上能(neng)(neng)下(xia)、員(yuan)工能(neng)(neng)進能(neng)(neng)出、收入能(neng)(neng)增能(neng)(neng)減(jian)的(de)市場化勞(lao)動用工和(he)收入分(fen)配管(guan)(guan)理(li)(li)機制,切(qie)實(shi)承擔起搞好(hao)、搞活(huo)企業(ye)(ye)內(nei)(nei)部分(fen)配的(de)職責(ze)。二(er)是加(jia)強(qiang)監督檢查(cha),明確界定(ding)企業(ye)(ye)違規責(ze)任,并將企業(ye)(ye)工資(zi)總(zong)額管(guan)(guan)理(li)(li)情況納(na)入各項(xiang)監督檢查(cha)范圍(wei),與審計、巡視等(deng)工作形成(cheng)合力(li),確保(bao)實(shi)現權(quan)責(ze)對(dui)等(deng),監管(guan)(guan)到位。
