同志們:

  這(zhe)次(ci)(ci)(ci)會(hui)(hui)議(yi)是(shi)在“十二五”開(kai)局之(zhi)年,國(guo)(guo)資(zi)監(jian)(jian)管(guan)和(he)國(guo)(guo)企改革進(jin)(jin)入新(xin)階段召開(kai)的(de)一(yi)次(ci)(ci)(ci)重(zhong)(zhong)要會(hui)(hui)議(yi)。會(hui)(hui)議(yi)的(de)主要任(ren)務是(shi):總結杭州(zhou)會(hui)(hui)議(yi)以(yi)來指(zhi)導(dao)監(jian)(jian)督地(di)方(fang)(fang)國(guo)(guo)資(zi)工作(zuo)(zuo)的(de)進(jin)(jin)展(zhan)和(he)成(cheng)效,交流各地(di)好(hao)的(de)做法(fa)和(he)經驗,圍(wei)繞(rao)“國(guo)(guo)資(zi)監(jian)(jian)管(guan)上(shang)新(xin)水平、國(guo)(guo)企發(fa)展(zhan)上(shang)新(xin)臺階”的(de)“兩新(xin)目標”,研(yan)究(jiu)“十二五”時期(qi)指(zhi)導(dao)監(jian)(jian)督地(di)方(fang)(fang)國(guo)(guo)資(zi)工作(zuo)(zuo)的(de)總體思路和(he)工作(zuo)(zuo)重(zhong)(zhong)點,提出(chu)做好(hao)下一(yi)步(bu)工作(zuo)(zuo)的(de)具(ju)體措施。國(guo)(guo)務院國(guo)(guo)資(zi)委對(dui)這(zhe)次(ci)(ci)(ci)會(hui)(hui)議(yi)高度(du)重(zhong)(zhong)視,國(guo)(guo)資(zi)委主任(ren)、黨委書記王勇同志做出(chu)重(zhong)(zhong)要批示,對(dui)進(jin)(jin)一(yi)步(bu)加強指(zhi)導(dao)監(jian)(jian)督工作(zuo)(zuo)提出(chu)明確要求。大家要認真學習(xi)領會(hui)(hui),全面貫(guan)徹落實(shi)。下面,我(wo)講三(san)點意見。

  一、指導(dao)監督地方國資工作取得新進展新成效(xiao)

  去年(nian)杭州會議(yi)以來(lai),國(guo)(guo)(guo)資委(wei)系(xi)統緊緊圍繞國(guo)(guo)(guo)資監(jian)管和(he)國(guo)(guo)(guo)企改革發展的(de)中心任務,大力推進(jin)指導監(jian)督工作(zuo),國(guo)(guo)(guo)資系(xi)統一盤棋理念進(jin)一步增強(qiang),上下級國(guo)(guo)(guo)資委(wei)溝通聯(lian)系(xi)進(jin)一步密切,工作(zuo)合(he)力進(jin)一步形成(cheng),指導監(jian)督工作(zuo)取得(de)新(xin)的(de)進(jin)展和(he)成(cheng)效。

  (一(yi))加強組織(zhi)領導(dao),指(zhi)導(dao)監(jian)督(du)工(gong)作機制基(ji)本形成。

  分(fen)(fen)管領導(dao)和工作(zuo)(zuo)機構全(quan)面落實(shi)。各(ge)省(sheng)級國(guo)(guo)資(zi)委(wei)將指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)擺上(shang)重要議事(shi)日(ri)程,普遍成(cheng)立了指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)領導(dao)小(xiao)組,不少地方國(guo)(guo)資(zi)委(wei)由一把手親自擔(dan)任領導(dao)小(xiao)組組長,同時明(ming)確了委(wei)內(nei)(nei)牽頭處(chu)室,建立了各(ge)處(chu)室之間的(de)分(fen)(fen)工協(xie)調(diao)機制(zhi)。北京市國(guo)(guo)資(zi)委(wei)將36項工作(zuo)(zuo)任務(wu)分(fen)(fen)解到(dao)16個處(chu)室。山東省(sheng)國(guo)(guo)資(zi)委(wei)將各(ge)處(chu)室指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)開展情況(kuang)列(lie)入年度考核內(nei)(nei)容。上(shang)海(hai)市國(guo)(guo)資(zi)委(wei)對區(qu)縣國(guo)(guo)資(zi)監(jian)管工作(zuo)(zuo)中遇到(dao)的(de)難題,由各(ge)業(ye)務(wu)處(chu)室實(shi)行(xing)對口“一條(tiao)龍”服務(wu)。通過落實(shi)分(fen)(fen)管領導(dao)和工作(zuo)(zuo)機構,初(chu)步形成(cheng)了職(zhi)責明(ming)確、統籌協(xie)調(diao)、分(fen)(fen)工負責的(de)指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)組織體系。

  指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)作(zuo)制(zhi)度(du)建設(she)不斷加強。國(guo)務(wu)院國(guo)資委修訂發布了(le)《地方(fang)國(guo)有(you)資產監(jian)(jian)管(guan)(guan)工(gong)作(zuo)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)辦(ban)法(fa)(fa)》(以下簡稱(cheng)《指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)辦(ban)法(fa)(fa)》),按照(zhao)“指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)、溝通、交流(liu)、服務(wu)”的(de)原(yuan)則(ze),明(ming)確(que)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)作(zuo)機制(zhi)和主要工(gong)作(zuo)事項,進一(yi)步規(gui)范了(le)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)的(de)主要方(fang)式和途徑。上海市(shi)國(guo)資委制(zhi)定了(le)《指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)辦(ban)法(fa)(fa)》的(de)實施細則(ze),將區縣貫徹執行國(guo)資監(jian)(jian)管(guan)(guan)政策法(fa)(fa)規(gui)情況作(zuo)為指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)作(zuo)重點(dian)。湖南(nan)、湖北、四川、重慶、甘肅、內蒙、新疆生產建設(she)兵(bing)團(tuan)等省區市(shi)國(guo)資委出臺了(le)加強市(shi)、縣級國(guo)資監(jian)(jian)管(guan)(guan)工(gong)作(zuo)的(de)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)(jian)督(du)辦(ban)法(fa)(fa),探索建立政策指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)與具體(ti)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)、日常(chang)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)與專項指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)相結合的(de)工(gong)作(zuo)體(ti)系(xi)。

  上下級國(guo)(guo)資委(wei)之間(jian)的(de)(de)溝(gou)通(tong)交流平臺逐步形(xing)成(cheng)。國(guo)(guo)務院(yuan)國(guo)(guo)資委(wei)定期編發(fa)簡報,及時傳達(da)指(zhi)導監(jian)督工(gong)作要(yao)求,交流推廣各地(di)(di)國(guo)(guo)資監(jian)管的(de)(de)特色做(zuo)法和先進經驗(yan),同(tong)時加快建立地(di)(di)方(fang)國(guo)(guo)資監(jian)管信(xin)息資源系(xi)統,嘗試(shi)指(zhi)導監(jian)督基礎(chu)數據的(de)(de)整(zheng)合與利用。福建、安徽(hui)等省(sheng)國(guo)(guo)資委(wei)健全監(jian)管工(gong)作體(ti)系(xi),形(xing)成(cheng)了(le)覆(fu)蓋全省(sheng)的(de)(de)基礎(chu)數據網(wang)絡(luo)。遼(liao)寧(ning)省(sheng)國(guo)(guo)資委(wei)通(tong)過與地(di)(di)市(shi)國(guo)(guo)資委(wei)辦公信(xin)息系(xi)統聯網(wang),確(que)保了(le)重要(yao)信(xin)息及時上報。國(guo)(guo)資委(wei)系(xi)統運用溝(gou)通(tong)交流平臺,有力地(di)(di)促進了(le)相互之間(jian)的(de)(de)學習借鑒和信(xin)息共享。

  (二)創新方(fang)式(shi)方(fang)法(fa),指導監督工作全面展開。

  精心規劃(hua)部(bu)署(shu)指導監(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)。國(guo)務院(yuan)國(guo)資(zi)(zi)委印發年(nian)度工(gong)(gong)(gong)作(zuo)(zuo)(zuo)計(ji)劃(hua),明確了2011年(nian)指導監(jian)(jian)(jian)督(du)的(de)40項工(gong)(gong)(gong)作(zuo)(zuo)(zuo)任務和責任廳(ting)局(ju)。湖南(nan)、新疆、西(xi)藏、廈門(men)等(deng)許多省(sheng)市國(guo)資(zi)(zi)委也制定了指導監(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)年(nian)度計(ji)劃(hua)。福建(jian)、江西(xi)、陜西(xi)等(deng)省(sheng)市國(guo)資(zi)(zi)委專門(men)組織召開了全(quan)省(sheng)指導監(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)會(hui)(hui)議(yi)。北京市國(guo)資(zi)(zi)委邀請區縣(xian)政府(fu)主管領導參加(jia)國(guo)資(zi)(zi)監(jian)(jian)(jian)管工(gong)(gong)(gong)作(zuo)(zuo)(zuo)會(hui)(hui)議(yi),全(quan)面部(bu)署(shu)了區縣(xian)國(guo)資(zi)(zi)監(jian)(jian)(jian)管重(zhong)點工(gong)(gong)(gong)作(zuo)(zuo)(zuo)。四川省(sheng)國(guo)資(zi)(zi)委召開研討會(hui)(hui),研究部(bu)署(shu)“十二五(wu)”時(shi)期(qi)指導監(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)的(de)總體思路(lu)、重(zhong)點任務和工(gong)(gong)(gong)作(zuo)(zuo)(zuo)措施(shi)。通過工(gong)(gong)(gong)作(zuo)(zuo)(zuo)計(ji)劃(hua)和會(hui)(hui)議(yi)部(bu)署(shu),各地指導監(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)開始(shi)全(quan)面啟動,并初步(bu)打開了工(gong)(gong)(gong)作(zuo)(zuo)(zuo)局(ju)面。

  深(shen)入調(diao)(diao)(diao)研摸清指導(dao)監(jian)(jian)督(du)面上情況(kuang)。今(jin)年(nian)(nian)上半年(nian)(nian),國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)法規局赴(fu)13個(ge)省(sheng)(sheng)(sheng)市(shi)深(shen)入了(le)解地(di)方國(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)管(guan)機構(gou)建(jian)設、全覆蓋監(jian)(jian)管(guan)、融(rong)資(zi)平臺公司(si)經營等方面的(de)(de)(de)情況(kuang)和(he)問題(ti)(ti),并提交(jiao)了(le)有(you)關調(diao)(diao)(diao)研報告和(he)上報的(de)(de)(de)專題(ti)(ti)信息(xi)。福建(jian)省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)對(dui)市(shi)、縣(xian)國(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)管(guan)工(gong)作和(he)指導(dao)監(jian)(jian)督(du)工(gong)作情況(kuang)進(jin)(jin)行(xing)(xing)全面調(diao)(diao)(diao)研。山東省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)針對(dui)部(bu)(bu)分(fen)地(di)市(shi)出現(xian)的(de)(de)(de)國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)監(jian)(jian)管(guan)企(qi)業劃回原(yuan)主管(guan)部(bu)(bu)門(men)的(de)(de)(de)體制(zhi)回潮現(xian)象,由委(wei)(wei)領(ling)導(dao)分(fen)頭帶隊進(jin)(jin)行(xing)(xing)集中調(diao)(diao)(diao)研督(du)導(dao)。安徽省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)建(jian)立了(le)委(wei)(wei)領(ling)導(dao)班子(zi)聯(lian)系點制(zhi)度,每人分(fen)別聯(lian)系2-3個(ge)地(di)市(shi)國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei),定期開展調(diao)(diao)(diao)研指導(dao)。四川、黑龍江等省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)分(fen)片區開展專題(ti)(ti)調(diao)(diao)(diao)研,實地(di)協調(diao)(diao)(diao)解決市(shi)縣(xian)國(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)管(guan)機構(gou)的(de)(de)(de)困(kun)難和(he)問題(ti)(ti)。通過開展廣泛深(shen)入的(de)(de)(de)調(diao)(diao)(diao)查研究,進(jin)(jin)一(yi)步(bu)增強(qiang)了(le)指導(dao)監(jian)(jian)督(du)工(gong)作的(de)(de)(de)針對(dui)性(xing)和(he)有(you)效性(xing)。

  注重發揮先(xian)進典(dian)型示(shi)范引(yin)路作(zuo)(zuo)用。河南、云南、青島(dao)等省市(shi)對下(xia)級國資(zi)監管工作(zuo)(zuo)進行評優(you)表彰,樹立先(xian)進典(dian)型。山東省國資(zi)委(wei)總結推廣(guang)濟寧、聊(liao)城、棗莊等地(di)市(shi)國資(zi)委(wei)在加強(qiang)職能建設、強(qiang)化考核(he)培(pei)訓等方面(mian)的經驗(yan)和做(zuo)法。寧夏自治區(qu)國資(zi)委(wei)指(zhi)導推動全區(qu)國有企業開展與全國先(xian)進企業、全區(qu)先(xian)進企業、本(ben)行業先(xian)進企業的“三對標”活動。各地(di)通過總結推廣(guang)特色做(zuo)法和先(xian)進經驗(yan),以點帶面(mian),使指(zhi)導監督工作(zuo)(zuo)的引(yin)領示(shi)范效(xiao)應得到較好體現(xian)。

  不(bu)斷強(qiang)化(hua)和豐富指(zhi)導(dao)監(jian)(jian)督工作(zuo)內涵。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)(zi)委(wei)先后組織召(zhao)開國(guo)(guo)資(zi)(zi)(zi)委(wei)系統(tong)財(cai)務監(jian)(jian)督、產權管(guan)理、業(ye)績考核、收(shou)益分(fen)(fen)配、改革改制(zhi)、董(dong)事會(hui)(hui)與監(jian)(jian)事會(hui)(hui)工作(zuo)、紀檢(jian)監(jian)(jian)察等專題會(hui)(hui)議和培訓(xun)班,對各地國(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)工作(zuo)進行(xing)(xing)專項指(zhi)導(dao)。深圳、上海(hai)、河北、大連等部(bu)分(fen)(fen)省(sheng)市(shi)國(guo)(guo)資(zi)(zi)(zi)委(wei)在本地區積極(ji)探索推進經濟增(zeng)(zeng)加(jia)(jia)值(zhi)考核,引(yin)導(dao)國(guo)(guo)有(you)企業(ye)增(zeng)(zeng)強(qiang)價值(zhi)創造能力,提(ti)高發展質量和效(xiao)益。云(yun)南、江蘇(su)等省(sheng)國(guo)(guo)資(zi)(zi)(zi)委(wei)組織對地市(shi)國(guo)(guo)有(you)企業(ye)生產經營狀況進行(xing)(xing)綜合分(fen)(fen)析,全面掌握地市(shi)國(guo)(guo)有(you)經濟的(de)運行(xing)(xing)情況。廣(guang)東省(sheng)國(guo)(guo)資(zi)(zi)(zi)委(wei)指(zhi)導(dao)地市(shi)國(guo)(guo)資(zi)(zi)(zi)委(wei)建立健(jian)全國(guo)(guo)有(you)企業(ye)財(cai)務快(kuai)報制(zhi)度(du)。江蘇(su)、湖北等省(sheng)國(guo)(guo)資(zi)(zi)(zi)委(wei)統(tong)一全省(sheng)企業(ye)國(guo)(guo)有(you)產權交易(yi)(yi)信息發布,實行(xing)(xing)產權交易(yi)(yi)網上動(dong)態監(jian)(jian)測。加(jia)(jia)強(qiang)對國(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)各項專題工作(zuo)的(de)指(zhi)導(dao)推動(dong),已經成為國(guo)(guo)資(zi)(zi)(zi)委(wei)系統(tong)加(jia)(jia)強(qiang)聯系、共同提(ti)高的(de)重(zhong)要紐帶。

  (三(san))突出工作(zuo)重點,指導監督效果初(chu)步顯現。

  指導(dao)(dao)(dao)國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)管體(ti)制(zhi)(zhi)和(he)(he)(he)(he)(he)制(zhi)(zhi)度建設邁出(chu)新步伐。各(ge)地(di)(di)(di)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)以(yi)保(bao)持(chi)機(ji)構(gou)的(de)(de)獨立性(xing)、專(zhuan)業(ye)(ye)性(xing)和(he)(he)(he)(he)(he)落實出(chu)資(zi)(zi)(zi)人三項主(zhu)要職(zhi)責(ze)(ze)為(wei)(wei)重點,通過立法和(he)(he)(he)(he)(he)政(zheng)策引(yin)導(dao)(dao)(dao)等(deng)多種途徑,深入推(tui)進本(ben)地(di)(di)(di)區國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)管體(ti)制(zhi)(zhi)和(he)(he)(he)(he)(he)制(zhi)(zhi)度的(de)(de)完善。湖北(bei)省(sheng)(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)主(zhu)要領導(dao)(dao)(dao)親自掛(gua)帥,主(zhu)動(dong)(dong)地(di)(di)(di)向(xiang)省(sheng)(sheng)委(wei)(wei)(wei)(wei)(wei)(wei)、省(sheng)(sheng)政(zheng)府(fu)(fu)匯(hui)報(bao),積極加強與省(sheng)(sheng)政(zheng)府(fu)(fu)各(ge)部(bu)門(men)和(he)(he)(he)(he)(he)省(sheng)(sheng)人大法律委(wei)(wei)(wei)(wei)(wei)(wei)的(de)(de)協(xie)調配合(he),組織起(qi)草并(bing)推(tui)動(dong)(dong)出(chu)臺了(le)《湖北(bei)省(sheng)(sheng)企業(ye)(ye)國(guo)(guo)(guo)有資(zi)(zi)(zi)產監(jian)督管理條(tiao)例》,首次以(yi)地(di)(di)(di)方性(xing)法規的(de)(de)形式,明確(que)了(le)全省(sheng)(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)的(de)(de)直(zhi)屬特設機(ji)構(gou)性(xing)質(zhi)和(he)(he)(he)(he)(he)全覆蓋監(jian)管職(zhi)責(ze)(ze),健全完善了(le)地(di)(di)(di)方國(guo)(guo)(guo)有資(zi)(zi)(zi)本(ben)經(jing)營(ying)預算制(zhi)(zhi)度。山東、貴州等(deng)省(sheng)(sheng)市(shi)(shi)(shi)(shi)(shi)(shi)也(ye)先后出(chu)臺了(le)指導(dao)(dao)(dao)本(ben)地(di)(di)(di)區國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)管體(ti)制(zhi)(zhi)完善的(de)(de)專(zhuan)門(men)文件(jian),對(dui)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)職(zhi)責(ze)(ze)定(ding)(ding)位(wei)、監(jian)管范圍(wei)以(yi)及(ji)市(shi)(shi)(shi)(shi)(shi)(shi)縣國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)管責(ze)(ze)任主(zhu)體(ti)等(deng)做出(chu)了(le)明確(que)規定(ding)(ding)。福建省(sheng)(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)針(zhen)對(dui)部(bu)分地(di)(di)(di)市(shi)(shi)(shi)(shi)(shi)(shi)擬撤并(bing)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)的(de)(de)動(dong)(dong)向(xiang),及(ji)時與各(ge)地(di)(di)(di)市(shi)(shi)(shi)(shi)(shi)(shi)黨委(wei)(wei)(wei)(wei)(wei)(wei)、政(zheng)府(fu)(fu)溝通,并(bing)將(jiang)情況上報(bao)省(sheng)(sheng)政(zheng)府(fu)(fu)取得支持(chi),保(bao)持(chi)了(le)地(di)(di)(di)市(shi)(shi)(shi)(shi)(shi)(shi)級國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)機(ji)構(gou)的(de)(de)穩定(ding)(ding)。重慶、陜西等(deng)省(sheng)(sheng)市(shi)(shi)(shi)(shi)(shi)(shi)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)主(zhu)要領導(dao)(dao)(dao)與地(di)(di)(di)市(shi)(shi)(shi)(shi)(shi)(shi)政(zheng)府(fu)(fu)主(zhu)要負責(ze)(ze)同志(zhi)深入協(xie)商溝通,推(tui)動(dong)(dong)地(di)(di)(di)市(shi)(shi)(shi)(shi)(shi)(shi)級國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei)的(de)(de)單獨設立和(he)(he)(he)(he)(he)職(zhi)責(ze)(ze)到位(wei)。最近,深圳(zhen)市(shi)(shi)(shi)(shi)(shi)(shi)委(wei)(wei)(wei)(wei)(wei)(wei)和(he)(he)(he)(he)(he)市(shi)(shi)(shi)(shi)(shi)(shi)政(zheng)府(fu)(fu)對(dui)市(shi)(shi)(shi)(shi)(shi)(shi)國(guo)(guo)(guo)資(zi)(zi)(zi)局(ju)的(de)(de)機(ji)構(gou)名稱和(he)(he)(he)(he)(he)機(ji)構(gou)性(xing)質(zhi)專(zhuan)門(men)作了(le)研究(jiu),正(zheng)式決定(ding)(ding)將(jiang)市(shi)(shi)(shi)(shi)(shi)(shi)國(guo)(guo)(guo)資(zi)(zi)(zi)局(ju)更名為(wei)(wei)市(shi)(shi)(shi)(shi)(shi)(shi)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)(wei)(wei),機(ji)構(gou)性(xing)質(zhi)由市(shi)(shi)(shi)(shi)(shi)(shi)政(zheng)府(fu)(fu)工作部(bu)門(men)變更為(wei)(wei)市(shi)(shi)(shi)(shi)(shi)(shi)政(zheng)府(fu)(fu)直(zhi)屬特設機(ji)構(gou)。

  推進(jin)經營性(xing)(xing)國有(you)資(zi)產(chan)(chan)(chan)集中統一(yi)監(jian)管(guan)取(qu)得新(xin)進(jin)展(zhan)。各地按照“政企分(fen)開(kai)、政資(zi)分(fen)開(kai)”原則,積(ji)極拓展(zhan)國資(zi)委(wei)(wei)系統的(de)監(jian)管(guan)范(fan)圍。目前(qian),全(quan)國有(you)14個(ge)省級(ji)(ji)國資(zi)委(wei)(wei)監(jian)管(guan)覆蓋面達到80%以上,北京、天津、上海(hai)、重(zhong)慶(qing)四(si)個(ge)直轄市實現(xian)了(le)經營性(xing)(xing)國有(you)資(zi)產(chan)(chan)(chan)的(de)全(quan)覆蓋監(jian)管(guan)。湖(hu)北省國資(zi)委(wei)(wei)對糧油(you)、水(shui)電、文化等領域的(de)脫鉤改(gai)制企業(ye)實現(xian)了(le)“統一(yi)納入、委(wei)(wei)托監(jian)管(guan)”。云(yun)南選擇昆明、曲(qu)靖、文山、大理等四(si)個(ge)州市進(jin)行了(le)國有(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)全(quan)覆蓋試點。此(ci)外(wai),全(quan)國有(you)28個(ge)省級(ji)(ji)國資(zi)委(wei)(wei)和70個(ge)地市級(ji)(ji)國資(zi)委(wei)(wei)監(jian)管(guan)范(fan)圍還涵蓋了(le)金融類國有(you)資(zi)產(chan)(chan)(chan)。

  推動(dong)落(luo)實縣(xian)級國(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)管(guan)(guan)責(ze)任取得新(xin)成效。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)召開(kai)義烏(wu)現場會(hui)后,浙江(jiang)、廣東等(deng)省國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)相繼在全(quan)省范(fan)圍內大力總(zong)(zong)結推廣義烏(wu)、順德經驗,進一(yi)步加強縣(xian)級國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機構建設,健全(quan)縣(xian)級國(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)管(guan)(guan)體制(zhi)。湖(hu)北(bei)省國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)總(zong)(zong)結推廣“大國(guo)(guo)資(zi)(zi)(zi)(zi)、大監(jian)管(guan)(guan)、大資(zi)(zi)(zi)(zi)源、大配(pei)置”的“宜(yi)都模(mo)式”,大冶市(shi)(shi)對經營性國(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)和行(xing)政事業性資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)實行(xing)產(chan)(chan)(chan)(chan)權、預算、資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)處置、資(zi)(zi)(zi)(zi)源配(pei)置“四(si)統(tong)一(yi)”的監(jian)管(guan)(guan)模(mo)式。寧(ning)波(bo)市(shi)(shi)國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)推動(dong)明確了區(qu)縣(xian)國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)責(ze)任主體。據對吉(ji)林、安徽、廣西等(deng)8省市(shi)(shi)所轄883個縣(xian)區(qu)的統(tong)計,單獨設立國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機構的有(you)(you)167個,占總(zong)(zong)數的19%。廣東、江(jiang)西、四(si)川的縣(xian)(區(qu))單獨設立國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機構的比例(li)分別達到36%、30%和28%。

  指導(dao)地(di)(di)方國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)(ji)發揮引領(ling)帶(dai)動(dong)作用呈現新(xin)格局(ju)。各級國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)積(ji)極指導(dao)推(tui)(tui)進跨區(qu)(qu)域(yu)、跨層級國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業之間的調(diao)整重組(zu),引導(dao)地(di)(di)方國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)更多(duo)地(di)(di)投向(xiang)支柱行業和(he)特色產(chan)業。國(guo)(guo)(guo)(guo)(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)推(tui)(tui)動(dong)中央(yang)企(qi)業與(yu)(yu)(yu)許多(duo)省(sheng)(sheng)(sheng)市(shi)開展(zhan)了央(yang)地(di)(di)合(he)作。福建(jian)(jian)省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)牽頭搭建(jian)(jian)本(ben)地(di)(di)區(qu)(qu)對接央(yang)企(qi)的合(he)作平臺。不(bu)少(shao)地(di)(di)方把國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)(ji)作為推(tui)(tui)進城市(shi)化建(jian)(jian)設的重要平臺。四個直(zhi)轄市(shi)的企(qi)業國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)逐(zhu)步(bu)向(xiang)支柱產(chan)業和(he)關系民生的公(gong)共(gong)基礎設施領(ling)域(yu)集中。山西省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)以(yi)煤炭(tan)資(zi)(zi)(zi)源整合(he)為推(tui)(tui)手(shou),加(jia)快推(tui)(tui)進省(sheng)(sheng)(sheng)、市(shi)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業的結構調(diao)整和(he)產(chan)業升級。海(hai)南(nan)省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)大力推(tui)(tui)動(dong)省(sheng)(sheng)(sheng)屬國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業與(yu)(yu)(yu)市(shi)縣合(he)作,共(gong)同組(zu)建(jian)(jian)參與(yu)(yu)(yu)新(xin)城區(qu)(qu)和(he)港區(qu)(qu)開發的投資(zi)(zi)(zi)主體。青海(hai)省(sheng)(sheng)(sheng)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)以(yi)循環(huan)經濟(ji)(ji)試驗區(qu)(qu)和(he)高(gao)新(xin)技術(shu)產(chan)業為依托,積(ji)極搭建(jian)(jian)省(sheng)(sheng)(sheng)內國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業合(he)作發展(zhan)平臺。各地(di)(di)通過指導(dao)推(tui)(tui)動(dong)優勢資(zi)(zi)(zi)源集中,使(shi)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)(ji)在地(di)(di)方經濟(ji)(ji)社(she)會發展(zhan)中的引領(ling)帶(dai)動(dong)作用得(de)到進一步(bu)發揮。

  總體上看,近一年來,各地(di)國資委(wei)認真貫徹落實杭州會議精神,通過建(jian)立(li)健全指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)機制和制度,不斷創新指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)方式和方法,抓住重(zhong)點(dian),突(tu)破(po)難(nan)(nan)點(dian),國資委(wei)系(xi)(xi)統指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)開始從(cong)起步(bu)開局向(xiang)縱深推進轉(zhuan)(zhuan)變(bian),從(cong)分頭(tou)摸索(suo)向(xiang)集中(zhong)借鑒轉(zhuan)(zhuan)變(bian),從(cong)提出一般要求(qiu)向(xiang)深化(hua)體系(xi)(xi)建(jian)設轉(zhuan)(zhuan)變(bian),為推進完善(shan)地(di)方國資監(jian)(jian)(jian)(jian)管體制、促(cu)進地(di)方國有(you)企(qi)業(ye)科學發(fa)展(zhan)發(fa)揮了(le)積極(ji)作(zuo)(zuo)用。在(zai)肯定(ding)成績的(de)同時,我們也要清醒地(di)看到,目前(qian)指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)尚處于剛(gang)剛(gang)起步(bu)、逐步(bu)發(fa)展(zhan)的(de)階(jie)段,仍然存在(zai)不少(shao)問題,主要是:對指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)的(de)認識參差不齊,各地(di)工(gong)(gong)(gong)作(zuo)(zuo)進展(zhan)不平衡;指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)工(gong)(gong)(gong)作(zuo)(zuo)體系(xi)(xi)還不夠(gou)完善(shan),特別是對縣級國資監(jian)(jian)(jian)(jian)管工(gong)(gong)(gong)作(zuo)(zuo)的(de)指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)仍較薄弱;指(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)督(du)的(de)一些重(zhong)點(dian)難(nan)(nan)點(dian)還需要積極(ji)探(tan)索(suo)、尋求(qiu)突(tu)破(po)。對存在(zai)的(de)這些問題,我們要在(zai)下一步(bu)工(gong)(gong)(gong)作(zuo)(zuo)中(zhong)采取切(qie)實措施,努力加以解決。

  二(er)(er)、“十二(er)(er)五”時(shi)期指導監督(du)地方國資工(gong)作的總體思路和主(zhu)要任務

  “十(shi)(shi)二五”時(shi)期(qi),是深(shen)(shen)入推進國(guo)(guo)(guo)有(you)資(zi)產監管體(ti)制完善(shan)的(de)關鍵時(shi)期(qi),也是深(shen)(shen)化國(guo)(guo)(guo)有(you)企業(ye)改(gai)(gai)革發(fa)(fa)展(zhan)的(de)重(zhong)要時(shi)期(qi)。按照以科學(xue)發(fa)(fa)展(zhan)為主題、以加(jia)快(kuai)轉變經(jing)濟發(fa)(fa)展(zhan)方式為主線的(de)要求(qiu),“十(shi)(shi)二五”時(shi)期(qi)將更(geng)加(jia)重(zhong)視(shi)改(gai)(gai)革的(de)頂層(ceng)設計和總體(ti)規劃,在繼(ji)續(xu)完善(shan)經(jing)營性國(guo)(guo)(guo)有(you)資(zi)產監管體(ti)制的(de)同時(shi),還將完善(shan)國(guo)(guo)(guo)有(you)金(jin)融資(zi)產、行政(zheng)事業(ye)單(dan)位資(zi)產和自然資(zi)源資(zi)產監管體(ti)制,推動重(zhong)點領域(yu)和關鍵環節的(de)改(gai)(gai)革取得突破性進展(zhan)。從國(guo)(guo)(guo)際看,隨著經(jing)濟全球化進程(cheng)不斷深(shen)(shen)入,國(guo)(guo)(guo)有(you)企業(ye)“走出去”步伐進一步加(jia)快(kuai),美國(guo)(guo)(guo)、歐(ou)盟(meng)等發(fa)(fa)達國(guo)(guo)(guo)家和地區對我國(guo)(guo)(guo)國(guo)(guo)(guo)有(you)企業(ye)的(de)管理體(ti)制和治理模式將越來越關注。國(guo)(guo)(guo)內外(wai)形勢的(de)發(fa)(fa)展(zhan)變化,既為完善(shan)國(guo)(guo)(guo)有(you)資(zi)產監管體(ti)制、加(jia)快(kuai)國(guo)(guo)(guo)有(you)企業(ye)改(gai)(gai)革帶(dai)來新(xin)的(de)機遇(yu)與(yu)挑戰(zhan),也對“十(shi)(shi)二五”時(shi)期(qi)深(shen)(shen)入開展(zhan)指導監督地方國(guo)(guo)(guo)資(zi)工(gong)作提(ti)出了新(xin)任(ren)務和新(xin)要求(qiu)。

  “十二五”時期(qi)指導監(jian)督地(di)方國(guo)(guo)(guo)(guo)資(zi)工作(zuo)(zuo)的(de)總體(ti)思(si)路是:以鄧小平理論(lun)和“三個代表(biao)”重(zhong)(zhong)要思(si)想為指導,深入貫徹落(luo)實科學發(fa)展觀(guan),緊緊圍繞(rao) “兩新目標”,牢(lao)固樹立國(guo)(guo)(guo)(guo)資(zi)系統(tong)一(yi)(yi)盤棋理念,立足“指導、溝(gou)通(tong)、交流、服(fu)務(wu)”,以加強地(di)方國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管機構(gou)建設、推進(jin)(jin)經營性國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)集中(zhong)統(tong)一(yi)(yi)監(jian)管、促(cu)進(jin)(jin)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管工作(zuo)(zuo)不斷深化、強化企(qi)業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)基礎管理為重(zhong)(zhong)點,進(jin)(jin)一(yi)(yi)步完善指導監(jian)督工作(zuo)(zuo)機制(zhi)和制(zhi)度,推動構(gou)建國(guo)(guo)(guo)(guo)資(zi)工作(zuo)(zuo)大(da)格局,努力提升地(di)方國(guo)(guo)(guo)(guo)資(zi)委依法(fa)履行出資(zi)人職責、加強國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管的(de)能力和水平,為完善企(qi)業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管體(ti)制(zhi)、促(cu)進(jin)(jin)國(guo)(guo)(guo)(guo)有(you)企(qi)業(ye)改(gai)革發(fa)展作(zuo)(zuo)出新貢獻。

  根據上(shang)述總體思路,“十二五”時期指(zhi)導(dao)監督地方國(guo)資工作(zuo)要(yao)全面落實以(yi)下四項主(zhu)要(yao)任(ren)務:

  (一)指(zhi)導加強(qiang)地方(fang)國(guo)有資(zi)產監管機構(gou)建(jian)設。

  加強(qiang)國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監管(guan)(guan)(guan)機構建設,是完善國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監管(guan)(guan)(guan)體(ti)(ti)(ti)制(zhi)的(de)(de)(de)組(zu)織(zhi)基礎。黨的(de)(de)(de)十六大以(yi)來,中央(yang)和省、地市(shi)三(san)級政府組(zu)建國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei),作為(wei)政府直屬特設機構,在機構設置上實(shi)(shi)現了(le)政府的(de)(de)(de)社(she)會公(gong)共管(guan)(guan)(guan)理(li)部門與政府的(de)(de)(de)國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監管(guan)(guan)(guan)機構完全分開。政府對國(guo)(guo)(guo)有(you)企業的(de)(de)(de)管(guan)(guan)(guan)理(li),由(you)過(guo)去(qu)以(yi)行政方(fang)式管(guan)(guan)(guan)理(li)改(gai)(gai)為(wei)以(yi)出(chu)(chu)資(zi)(zi)(zi)方(fang)式管(guan)(guan)(guan)理(li),由(you)過(guo)去(qu)各部門多(duo)頭(tou)管(guan)(guan)(guan)理(li)改(gai)(gai)為(wei)由(you)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)統(tong)一(yi)履行出(chu)(chu)資(zi)(zi)(zi)人(ren)職責(ze)。這(zhe)一(yi)新體(ti)(ti)(ti)制(zhi)具(ju)有(you)鮮明的(de)(de)(de)中國(guo)(guo)(guo)特色,既是我國(guo)(guo)(guo)不斷探索(suo)規范(fan)政府與國(guo)(guo)(guo)有(you)企業之(zhi)間關系的(de)(de)(de)重要制(zhi)度(du)創新,也是不斷深(shen)化國(guo)(guo)(guo)有(you)企業改(gai)(gai)革(ge)的(de)(de)(de)經(jing)驗結晶。8年(nian)多(duo)來的(de)(de)(de)實(shi)(shi)踐表明,這(zhe)一(yi)新體(ti)(ti)(ti)制(zhi)有(you)利(li)于(yu)保障國(guo)(guo)(guo)有(you)企業真正成為(wei)獨立的(de)(de)(de)市(shi)場主(zhu)體(ti)(ti)(ti)和法人(ren)實(shi)(shi)體(ti)(ti)(ti),有(you)利(li)于(yu)國(guo)(guo)(guo)有(you)企業平等(deng)參與國(guo)(guo)(guo)內外兩個市(shi)場競爭,因而更好(hao)(hao)地適應(ying)(ying)了(le)深(shen)化國(guo)(guo)(guo)有(you)企業改(gai)(gai)革(ge)的(de)(de)(de)客觀需要,更好(hao)(hao)地適應(ying)(ying)了(le)發(fa)展(zhan)社(she)會主(zhu)義市(shi)場經(jing)濟的(de)(de)(de)客觀需要。

  目前,省級國(guo)(guo)資(zi)(zi)(zi)委機(ji)構及其(qi)職(zhi)責(ze)定位比(bi)(bi)較(jiao)(jiao)穩固,但(dan)不(bu)(bu)少地(di)市國(guo)(guo)資(zi)(zi)(zi)委由直屬(shu)特(te)設(she)(she)機(ji)構改(gai)為(wei)了(le)政(zheng)府(fu)部門或者與其(qi)他部門合署(shu)辦公,機(ji)構不(bu)(bu)獨立(li)、行政(zheng)化趨勢比(bi)(bi)較(jiao)(jiao)明(ming)顯。據(ju)統計,全國(guo)(guo)356個(ge)地(di)市中(zhong)(zhong),盡(jin)管有(you)331個(ge)設(she)(she)立(li)國(guo)(guo)資(zi)(zi)(zi)委,占93%,但(dan)作為(wei)獨立(li)機(ji)構的(de)(de)(de)只(zhi)有(you)227個(ge),占設(she)(she)立(li)國(guo)(guo)資(zi)(zi)(zi)委的(de)(de)(de)68.6%;保留(liu)直屬(shu)特(te)設(she)(she)機(ji)構性質(zhi)的(de)(de)(de)只(zhi)有(you)107個(ge),占設(she)(she)立(li)國(guo)(guo)資(zi)(zi)(zi)委的(de)(de)(de)32.3%。從職(zhi)責(ze)上看(kan),一(yi)些地(di)方(fang)國(guo)(guo)資(zi)(zi)(zi)委出(chu)資(zi)(zi)(zi)人三項(xiang)主要(yao)(yao)職(zhi)責(ze)不(bu)(bu)統一(yi)、不(bu)(bu)到位現象仍然比(bi)(bi)較(jiao)(jiao)突出(chu),面上監管職(zhi)責(ze)尤(you)為(wei)薄弱(ruo)。個(ge)別(bie)地(di)市國(guo)(guo)資(zi)(zi)(zi)委的(de)(de)(de)主要(yao)(yao)工作集中(zhong)(zhong)在企業(ye)(ye)改(gai)制、處理(li)信訪和維護穩定上,企業(ye)(ye)國(guo)(guo)有(you)資(zi)(zi)(zi)產監管職(zhi)責(ze)沒有(you)得到落實。

  針對上述情況(kuang),“十二五”時期要(yao)(yao)把(ba)指(zhi)導推進(jin)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產(chan)監管機(ji)構(gou)(gou)(gou)建(jian)設(she)擺在首(shou)要(yao)(yao)位置,核(he)心是堅(jian)(jian)持(chi)國(guo)(guo)資(zi)(zi)(zi)(zi)委直屬特設(she)機(ji)構(gou)(gou)(gou)性質。具體來說,要(yao)(yao)把(ba)握(wo)好(hao)以下三點:一要(yao)(yao)準確把(ba)握(wo)特設(she)機(ji)構(gou)(gou)(gou)的(de)(de)實質要(yao)(yao)求(qiu)。注意區別(bie)于政(zheng)府(fu)公共(gong)管理部(bu)門和(he)(he)機(ji)構(gou)(gou)(gou),堅(jian)(jian)持(chi)國(guo)(guo)資(zi)(zi)(zi)(zi)委在政(zheng)府(fu)層(ceng)面依法履行出資(zi)(zi)(zi)(zi)人(ren)(ren)職(zhi)(zhi)(zhi)責(ze)、專司(si)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產(chan)監管、不承擔公共(gong)管理職(zhi)(zhi)(zhi)能(neng)的(de)(de)特殊定位。二要(yao)(yao)準確把(ba)握(wo)特設(she)機(ji)構(gou)(gou)(gou)的(de)(de)職(zhi)(zhi)(zhi)責(ze)邊(bian)界(jie)。對出資(zi)(zi)(zi)(zi)人(ren)(ren)職(zhi)(zhi)(zhi)責(ze)范(fan)圍內的(de)(de)工作(zuo),盡職(zhi)(zhi)(zhi)盡責(ze)不缺位;對指(zhi)導和(he)(he)推動監管企(qi)業的(de)(de)工作(zuo),有(you)據有(you)度不越位;對協助政(zheng)府(fu)其他部(bu)門的(de)(de)工作(zuo),做好(hao)配合(he)(he)不錯位。三要(yao)(yao)準確把(ba)握(wo)特設(she)機(ji)構(gou)(gou)(gou)的(de)(de)職(zhi)(zhi)(zhi)能(neng)配置。堅(jian)(jian)持(chi)將出資(zi)(zi)(zi)(zi)人(ren)(ren)職(zhi)(zhi)(zhi)責(ze)和(he)(he)面上監管職(zhi)(zhi)(zhi)責(ze)有(you)機(ji)結合(he)(he)起來,在依法履行出資(zi)(zi)(zi)(zi)人(ren)(ren)職(zhi)(zhi)(zhi)責(ze)的(de)(de)同時,認真履行好(hao)面上監管職(zhi)(zhi)(zhi)責(ze)。

  (二(er))指導推動經營性國有資產的(de)集中統(tong)一監(jian)管。

  今年初,張德江(jiang)副(fu)總理在(zai)(zai)全國(guo)(guo)(guo)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監督管(guan)(guan)(guan)(guan)理工(gong)作(zuo)會議上(shang)提出(chu),要“拓寬監管(guan)(guan)(guan)(guan)范圍,逐(zhu)步做到全過(guo)程、全方(fang)位監管(guan)(guan)(guan)(guan),不留死角,不留遺漏,不出(chu)現重(zhong)大失責(ze)”。國(guo)(guo)(guo)務院領導(dao)的(de)明確(que)要求(qiu),為深(shen)入推(tui)動經營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)集(ji)中(zhong)統(tong)一監管(guan)(guan)(guan)(guan)指明了方(fang)向。當前(qian),不少(shao)省級(ji)國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)在(zai)(zai)省委(wei)(wei)、省政府(fu)的(de)重(zhong)視、支持下,逐(zhu)步推(tui)進地(di)(di)方(fang)經營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)的(de)集(ji)中(zhong)統(tong)一監管(guan)(guan)(guan)(guan),監管(guan)(guan)(guan)(guan)范圍不斷(duan)拓展。但有(you)(you)的(de)地(di)(di)方(fang)經營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)監管(guan)(guan)(guan)(guan)還較為分散,當地(di)(di)國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)監管(guan)(guan)(guan)(guan)的(de)比(bi)例(li)比(bi)較低,目前(qian)仍(reng)有(you)(you)4個省級(ji)國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)監管(guan)(guan)(guan)(guan)覆(fu)蓋面低于(yu)50%。有(you)(you)的(de)地(di)(di)方(fang)將(jiang)(jiang)新設立(li)的(de)國(guo)(guo)(guo)有(you)(you)企業(ye)(ye)交(jiao)由公共管(guan)(guan)(guan)(guan)理部門監管(guan)(guan)(guan)(guan),還有(you)(you)的(de)地(di)(di)方(fang)甚至(zhi)將(jiang)(jiang)國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)監管(guan)(guan)(guan)(guan)企業(ye)(ye)重(zhong)新劃回原(yuan)行業(ye)(ye)主管(guan)(guan)(guan)(guan)部門。因此,必(bi)須(xu)把推(tui)動地(di)(di)方(fang)經營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)的(de)集(ji)中(zhong)統(tong)一監管(guan)(guan)(guan)(guan),作(zuo)為指導(dao)監督工(gong)作(zuo)的(de)重(zhong)要任務。

  “十二五”時期,推動(dong)地(di)(di)方經(jing)營性國(guo)有(you)資(zi)(zi)產(chan)的(de)集(ji)中(zhong)統一(yi)(yi)(yi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan),應當著力(li)抓好(hao)以(yi)下(xia)三點:一(yi)(yi)(yi)要積極拓展國(guo)資(zi)(zi)委監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)范圍(wei)。各(ge)地(di)(di)國(guo)資(zi)(zi)委要主(zhu)動(dong)匯報,爭取(qu)地(di)(di)方黨委、政(zheng)府支持。要以(yi)統一(yi)(yi)(yi)履行出資(zi)(zi)人(ren)職責為(wei)目標,采取(qu)多種方式,循序漸進,盡可能(neng)將地(di)(di)方國(guo)有(you)企(qi)(qi)業(ye)(ye)納入(ru)新的(de)國(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)體(ti)制(zhi)。完全納入(ru)暫時還有(you)困難(nan)的(de),可以(yi)采取(qu)由國(guo)資(zi)(zi)委委托監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)、行業(ye)(ye)部(bu)門(men)具(ju)體(ti)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)等方式。二要注意(yi)發(fa)揮好(hao)統一(yi)(yi)(yi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)的(de)體(ti)制(zhi)優(you)(you)勢(shi)。嚴格按照出資(zi)(zi)關系,切實加(jia)(jia)強出資(zi)(zi)人(ren)專業(ye)(ye)化、系統化、規范化監(jian)(jian)(jian)(jian)管(guan)(guan)(guan),提高國(guo)有(you)資(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)效率(lv),使出資(zi)(zi)人(ren)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)的(de)體(ti)制(zhi)優(you)(you)勢(shi)得到充分體(ti)現。三要集(ji)中(zhong)資(zi)(zi)源打(da)造(zao)優(you)(you)勢(shi)企(qi)(qi)業(ye)(ye)。通(tong)過推動(dong)集(ji)中(zhong)統一(yi)(yi)(yi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan),加(jia)(jia)快在更大范圍(wei)、更高層次(ci)上的(de)企(qi)(qi)業(ye)(ye)重組和資(zi)(zi)源整(zheng)合,著力(li)培育一(yi)(yi)(yi)批地(di)(di)方優(you)(you)勢(shi)企(qi)(qi)業(ye)(ye),具(ju)備(bei)條件(jian)的(de)還要力(li)爭培育成為(wei)國(guo)內領先企(qi)(qi)業(ye)(ye)或(huo)世界一(yi)(yi)(yi)流企(qi)(qi)業(ye)(ye)。總之,要通(tong)過指導推動(dong),爭取(qu)在新的(de)體(ti)制(zhi)框架下(xia)實現集(ji)中(zhong)統一(yi)(yi)(yi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan),在優(you)(you)化資(zi)(zi)源配置的(de)前提下(xia)實現集(ji)中(zhong)統一(yi)(yi)(yi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan),在打(da)造(zao)優(you)(you)勢(shi)企(qi)(qi)業(ye)(ye)的(de)過程中(zhong)實現集(ji)中(zhong)統一(yi)(yi)(yi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)。

  (三)指導促進地方國有資產監管(guan)工作不斷(duan)深化。

  目前,各(ge)地(di)國有(you)(you)資(zi)(zi)(zi)產監管工作基(ji)本進入規(gui)范化(hua)軌道。但隨著國有(you)(you)企業(ye)改(gai)革(ge)發展的不(bu)(bu)斷加(jia)快,國資(zi)(zi)(zi)監管工作還(huan)不(bu)(bu)能(neng)完(wan)全適(shi)應當前形勢(shi)發展變(bian)化(hua)的需要,監管不(bu)(bu)到(dao)位、監管資(zi)(zi)(zi)源分散、監管效率不(bu)(bu)高的問題(ti)還(huan)不(bu)(bu)同程度地(di)存在(zai),國資(zi)(zi)(zi)委內(nei)部業(ye)務(wu)流(liu)程和(he)組織(zhi)結構也有(you)(you)待優化(hua)完(wan)善(shan)。特別是在(zai)股權多元化(hua)條件下(xia),國有(you)(you)資(zi)(zi)(zi)產出資(zi)(zi)(zi)人代表如何(he)在(zai)企業(ye)層層落實(shi)到(dao)位,如何(he)加(jia)強境(jing)外國有(you)(you)資(zi)(zi)(zi)產和(he)重要子(zi)企業(ye)監管等,都需要進一(yi)步探索和(he)規(gui)范。

  “十二五”時期要(yao)通過加(jia)強(qiang)(qiang)指導(dao)監(jian)(jian)(jian)(jian)督,大力(li)推(tui)進國資(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)工作的(de)(de)不(bu)(bu)斷(duan)深(shen)化。一要(yao)著力(li)拓寬監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)思路,提(ti)(ti)(ti)高(gao)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)工作的(de)(de)前瞻性(xing)(xing)(xing)。注(zhu)意指導(dao)下級國資(zi)(zi)委(wei)(wei)妥善(shan)應(ying)對日(ri)趨復(fu)雜的(de)(de)宏觀經濟環境(jing),準確把握國有(you)(you)(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)和國有(you)(you)(you)(you)(you)企(qi)(qi)業(ye)(ye)改革(ge)發(fa)(fa)展中的(de)(de)方向性(xing)(xing)(xing)、趨勢性(xing)(xing)(xing)問(wen)題。二要(yao)著力(li)突(tu)出監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)重(zhong)點,提(ti)(ti)(ti)高(gao)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)工作的(de)(de)針(zhen)對性(xing)(xing)(xing)。根據(ju)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)企(qi)(qi)業(ye)(ye)不(bu)(bu)同的(de)(de)股權(quan)結構和組織形(xing)式,積(ji)極探索(suo)分類監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)。切實加(jia)強(qiang)(qiang)混合所(suo)有(you)(you)(you)(you)(you)制(zhi)下國有(you)(you)(you)(you)(you)產權(quan)的(de)(de)管(guan)(guan)(guan)(guan)理,繼續完善(shan)有(you)(you)(you)(you)(you)利(li)于(yu)推(tui)動企(qi)(qi)業(ye)(ye)自主(zhu)創(chuang)新(xin)、提(ti)(ti)(ti)高(gao)發(fa)(fa)展質量的(de)(de)考核(he)指標體(ti)系。適應(ying)國有(you)(you)(you)(you)(you)企(qi)(qi)業(ye)(ye)“走(zou)出去”要(yao)求,進一步加(jia)強(qiang)(qiang)對境(jing)外國有(you)(you)(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)。針(zhen)對國有(you)(you)(you)(you)(you)企(qi)(qi)業(ye)(ye)大部(bu)分資(zi)(zi)產集中在二、三(san)級企(qi)(qi)業(ye)(ye)的(de)(de)情況,完善(shan)對重(zhong)要(yao)子企(qi)(qi)業(ye)(ye)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)制(zhi)度機(ji)(ji)制(zhi)。三(san)要(yao)著力(li)整合監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)資(zi)(zi)源,提(ti)(ti)(ti)高(gao)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)工作的(de)(de)有(you)(you)(you)(you)(you)效性(xing)(xing)(xing)。適時調整優化國資(zi)(zi)委(wei)(wei)內部(bu)機(ji)(ji)構設置和職能配置,加(jia)強(qiang)(qiang)投資(zi)(zi)規劃、產權(quan)管(guan)(guan)(guan)(guan)理、財(cai)務監(jian)(jian)(jian)(jian)督、業(ye)(ye)績(ji)考核(he)、薪酬(chou)分配、干部(bu)任(ren)免、外派(pai)監(jian)(jian)(jian)(jian)事會(hui)、紀檢監(jian)(jian)(jian)(jian)察等各(ge)個環節的(de)(de)銜接協調,形(xing)成國資(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)閉環鏈(lian)條。探索(suo)國有(you)(you)(you)(you)(you)企(qi)(qi)業(ye)(ye)財(cai)務信息公開制(zhi)度,注(zhu)重(zhong)利(li)用現代(dai)信息技術實施監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),不(bu)(bu)斷(duan)創(chuang)新(xin)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)方式,不(bu)(bu)斷(duan)提(ti)(ti)(ti)高(gao)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)效率(lv)。

  這(zhe)里,我還要(yao)特別強調國(guo)(guo)資(zi)委系統融(rong)資(zi)平(ping)(ping)(ping)臺(tai)(tai)公(gong)司(si)風險防(fang)范問題(ti)。這(zhe)是當(dang)前(qian)和今后一個時(shi)期,指導(dao)監(jian)(jian)督(du)工作應當(dang)給予高度關注的(de)問題(ti)。融(rong)資(zi)平(ping)(ping)(ping)臺(tai)(tai)公(gong)司(si)大(da)多(duo)以國(guo)(guo)有土地(di)使用權、國(guo)(guo)有企業(ye)股(gu)權等作為(wei)融(rong)資(zi)擔(dan)保,貸款期限長,潛(qian)在風險大(da)。要(yao)注意(yi)指導(dao)地(di)方融(rong)資(zi)平(ping)(ping)(ping)臺(tai)(tai)公(gong)司(si)按(an)(an)照企業(ye)規(gui)律運營,既要(yao)服務于當(dang)地(di)經濟(ji)社會發(fa)展大(da)局,為(wei)地(di)方基礎設施建設提供(gong)資(zi)金(jin)支持;又要(yao)量入為(wei)出,合理確定(ding)融(rong)資(zi)規(gui)模,不(bu)能以犧牲國(guo)(guo)有資(zi)產(chan)安全解決暫時(shi)的(de)資(zi)金(jin)需求(qiu),不(bu)能給國(guo)(guo)有經濟(ji)發(fa)展帶來長期隱患。各地(di)國(guo)(guo)資(zi)委要(yao)對所(suo)監(jian)(jian)管的(de)融(rong)資(zi)平(ping)(ping)(ping)臺(tai)(tai)公(gong)司(si)依(yi)法(fa)履行好出資(zi)人職責,嚴格按(an)(an)照法(fa)定(ding)程(cheng)序參與(yu)重大(da)事項決策,重視指導(dao)融(rong)資(zi)平(ping)(ping)(ping)臺(tai)(tai)公(gong)司(si)完善治理結(jie)構(gou),提高科學決策水平(ping)(ping)(ping)。要(yao)抓緊摸清所(suo)監(jian)(jian)管的(de)融(rong)資(zi)平(ping)(ping)(ping)臺(tai)(tai)公(gong)司(si)資(zi)產(chan)負債、擔(dan)保等基本情況,全面評估潛(qian)在風險,認真研究制定(ding)切實可行的(de)風險防(fang)范預案。

  (四(si))指(zhi)導健全企業(ye)國有(you)資產基礎管理工作體(ti)系。

  健全(quan)企(qi)業(ye)國(guo)(guo)有(you)(you)(you)(you)資產基(ji)(ji)礎管(guan)(guan)理工(gong)作(zuo)(zuo)體系(xi),既是開展(zhan)指導(dao)監(jian)督(du)工(gong)作(zuo)(zuo)的(de)(de)重(zhong)要(yao)抓手,也是上下級國(guo)(guo)資委之間加(jia)強聯(lian)系(xi)的(de)(de)重(zhong)要(yao)紐帶。認真做(zuo)好這(zhe)項工(gong)作(zuo)(zuo),有(you)(you)(you)(you)利于全(quan)面(mian)掌握(wo)國(guo)(guo)有(you)(you)(you)(you)資產整(zheng)體狀況,有(you)(you)(you)(you)利于全(quan)程監(jian)管(guan)(guan)國(guo)(guo)有(you)(you)(you)(you)資產流(liu)轉環節,有(you)(you)(you)(you)利于適(shi)時實現國(guo)(guo)有(you)(you)(you)(you)資產運營質量監(jian)測(ce)。目前,國(guo)(guo)資委系(xi)統(tong)基(ji)(ji)礎管(guan)(guan)理工(gong)作(zuo)(zuo)體系(xi)初步形成(cheng),管(guan)(guan)理規則(ze)逐步健全(quan)。但有(you)(you)(you)(you)關制(zhi)度位(wei)階較低,系(xi)統(tong)內外規則(ze)不(bu)統(tong)一(yi),部門職能交(jiao)叉、多頭(tou)管(guan)(guan)理、責任不(bu)清的(de)(de)現象仍(reng)然(ran)存(cun)在,縣級企(qi)業(ye)國(guo)(guo)有(you)(you)(you)(you)資產基(ji)(ji)礎管(guan)(guan)理缺位(wei)還比較嚴重(zhong)。同(tong)時,隨著這(zhe)幾年國(guo)(guo)有(you)(you)(you)(you)資產管(guan)(guan)理體制(zhi)改革和國(guo)(guo)有(you)(you)(you)(you)企(qi)業(ye)改革重(zhong)組的(de)(de)不(bu)斷(duan)深入,國(guo)(guo)有(you)(you)(you)(you)經濟(ji)在我國(guo)(guo)經濟(ji)社會(hui)發展(zhan)中(zhong)的(de)(de)主體地(di)位(wei)和主導(dao)作(zuo)(zuo)用進一(yi)步突出(chu),有(you)(you)(you)(you)關基(ji)(ji)礎數(shu)據對國(guo)(guo)家宏觀經濟(ji)決策的(de)(de)參考價值日益(yi)凸(tu)顯,因而(er)對我們加(jia)強企(qi)業(ye)國(guo)(guo)有(you)(you)(you)(you)資產基(ji)(ji)礎管(guan)(guan)理提出(chu)了更為重(zhong)要(yao)和緊迫的(de)(de)要(yao)求。

  “十二(er)五”時期,指導健(jian)全(quan)企(qi)業國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)工作體系,應當(dang)著力抓好(hao)以(yi)下(xia)三點:一要(yao)加(jia)快基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)制(zhi)(zhi)(zhi)度(du)建設(she)。2010年、2011年,國(guo)(guo)(guo)(guo)務院兩次將《企(qi)業國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)條例》列為(wei)“條件成熟時出臺”的(de)立法(fa)項(xiang)目。各地(di)(di)(di)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委一方(fang)面(mian)要(yao)積極(ji)配合起草好(hao)這(zhe)個條例,另一方(fang)面(mian),要(yao)重視加(jia)強(qiang)地(di)(di)(di)方(fang)國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)制(zhi)(zhi)(zhi)度(du)建設(she),積極(ji)創造條件,爭取實現(xian)本地(di)(di)(di)區基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)規則和制(zhi)(zhi)(zhi)度(du)的(de)統一。二(er)要(yao)完善(shan)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)工作機制(zhi)(zhi)(zhi)。要(yao)加(jia)強(qiang)與(yu)有(you)(you)關(guan)部(bu)門的(de)溝通(tong)協調,明(ming)確部(bu)門分(fen)(fen)工,依法(fa)落實省、地(di)(di)(di)市兩級(ji)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委企(qi)業國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)職責,盡(jin)快明(ming)確縣級(ji)企(qi)業國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)主體,建立全(quan)面(mian)覆蓋、層級(ji)完整的(de)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)工作機制(zhi)(zhi)(zhi)。三要(yao)利用好(hao)基(ji)礎管(guan)(guan)理(li)(li)(li)(li)(li)(li)數據成果。比如,通(tong)過全(quan)面(mian)掌握總量與(yu)分(fen)(fen)布情(qing)況,為(wei)國(guo)(guo)(guo)(guo)有(you)(you)經(jing)濟(ji)布局結構調整提(ti)供依據;通(tong)過及時跟蹤國(guo)(guo)(guo)(guo)有(you)(you)產(chan)權變動(dong)情(qing)況,有(you)(you)效維護國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)安全(quan);通(tong)過分(fen)(fen)析國(guo)(guo)(guo)(guo)有(you)(you)經(jing)濟(ji)運行動(dong)態,為(wei)政府實施宏觀(guan)經(jing)濟(ji)管(guan)(guan)理(li)(li)(li)(li)(li)(li)和國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委實施有(you)(you)效監管(guan)(guan)提(ti)供決策參(can)考。

  以上四(si)項(xiang)主(zhu)要(yao)任(ren)務(wu),是(shi)針(zhen)對國資委系統(tong)指導(dao)監督(du)工作(zuo)(zuo)需要(yao)重(zhong)點(dian)(dian)突破(po)的共(gong)性問(wen)題提出來的。各地情況不同,在開展指導(dao)監督(du)工作(zuo)(zuo)時(shi),還可以明確其他(ta)一些重(zhong)點(dian)(dian)工作(zuo)(zuo)任(ren)務(wu)。要(yao)分析本地區(qu)的突出矛(mao)盾和問(wen)題,分清輕(qing)重(zhong)緩急,在指導(dao)監督(du)工作(zuo)(zuo)中始終堅持抓重(zhong)點(dian)(dian),破(po)難點(dian)(dian),出亮(liang)點(dian)(dian),做精品。

  三、深(shen)入做好指導(dao)監督地方國資工作的幾點要求(qiu)

  今年是指導監(jian)(jian)督地方國(guo)資工作(zuo)深入推進的一年。按照“十二五”時期指導監(jian)(jian)督工作(zuo)總體思路和(he)主(zhu)要任(ren)務,各地國(guo)資委要著力在“提高認識、完善制(zhi)度、突出重(zhong)點、提升能力”上(shang)下功夫,扎(zha)扎(zha)實實地做好各項工作(zuo)。

  (一(yi))要(yao)始終把指導監(jian)督工作擺(bai)上重(zhong)要(yao)議事日程。

  上級(ji)國(guo)資(zi)(zi)委(wei)依法對下級(ji)政(zheng)府(fu)國(guo)有(you)資(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作(zuo)(zuo)進行指(zhi)(zhi)(zhi)導(dao)和(he)(he)(he)監(jian)(jian)督(du),是(shi)法律(lv)賦予各(ge)級(ji)國(guo)資(zi)(zi)委(wei)的(de)一(yi)項重(zhong)(zhong)要(yao)(yao)(yao)(yao)職責(ze)。各(ge)地國(guo)資(zi)(zi)委(wei)要(yao)(yao)(yao)(yao)從(cong)加快完(wan)善地方(fang)國(guo)有(you)資(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)體(ti)制(zhi)和(he)(he)(he)制(zhi)度、提升國(guo)有(you)資(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作(zuo)(zuo)能力(li)和(he)(he)(he)水(shui)平的(de)高(gao)度,深刻認識和(he)(he)(he)把(ba)握(wo)加強(qiang)指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)的(de)重(zhong)(zhong)要(yao)(yao)(yao)(yao)性和(he)(he)(he)緊迫性。要(yao)(yao)(yao)(yao)牢固樹立(li)國(guo)資(zi)(zi)系統一(yi)盤棋(qi)的(de)理念,加快形成國(guo)資(zi)(zi)監(jian)(jian)管(guan)(guan)的(de)“大合力(li)”。要(yao)(yao)(yao)(yao)切實(shi)糾正(zheng)指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)可有(you)可無的(de)模糊認識,克服各(ge)種畏難(nan)情(qing)緒,切實(shi)把(ba)指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)有(you)效開展(zhan)起來(lai)。各(ge)地國(guo)資(zi)(zi)委(wei)主要(yao)(yao)(yao)(yao)負責(ze)同(tong)志,要(yao)(yao)(yao)(yao)親自(zi)(zi)統籌謀(mou)劃,層層落實(shi)指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)責(ze)任;親自(zi)(zi)過問協(xie)調(diao),及時解決指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)涉及的(de)重(zhong)(zhong)大問題;親自(zi)(zi)溝通協(xie)商,切實(shi)加強(qiang)對下級(ji)政(zheng)府(fu)國(guo)有(you)資(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作(zuo)(zuo)的(de)指(zhi)(zhi)(zhi)導(dao)服務(wu)。分(fen)管(guan)(guan)指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)的(de)負責(ze)同(tong)志,更要(yao)(yao)(yao)(yao)盡職盡責(ze),深入分(fen)析把(ba)握(wo)本(ben)地區指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)的(de)重(zhong)(zhong)點(dian)(dian)、難(nan)點(dian)(dian),認真組織、協(xie)調(diao)和(he)(he)(he)落實(shi)指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)各(ge)項工(gong)(gong)作(zuo)(zuo)要(yao)(yao)(yao)(yao)求,努(nu)力(li)將指(zhi)(zhi)(zhi)導(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)引向(xiang)深入。

  (二)要繼續(xu)健全指導監督工(gong)作機制和制度(du)。

  健全(quan)完善指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)機(ji)(ji)制和(he)制度,是(shi)做好指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)(de)重(zhong)(zhong)要(yao)基(ji)礎。各地國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)要(yao)依據《指導(dao)監(jian)(jian)督(du)(du)(du)(du)辦(ban)法(fa)(fa)》的(de)(de)(de)(de)(de)(de)規定(ding),結合(he)(he)本地實(shi)(shi)際,進(jin)(jin)一步加強指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)機(ji)(ji)制和(he)制度建設(she)。要(yao)加快形(xing)成(cheng)委(wei)(wei)(wei)內各專業機(ji)(ji)構(gou)之間、上下(xia)(xia)級(ji)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)之間指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)(de)“兩個合(he)(he)力”。在(zai)明確委(wei)(wei)(wei)內分(fen)管領導(dao)和(he)工作(zuo)(zuo)(zuo)(zuo)機(ji)(ji)構(gou)的(de)(de)(de)(de)(de)(de)基(ji)礎上,既要(yao)發(fa)揮工作(zuo)(zuo)(zuo)(zuo)機(ji)(ji)構(gou)的(de)(de)(de)(de)(de)(de)信息溝通、交(jiao)流服務和(he)綜合(he)(he)協調作(zuo)(zuo)(zuo)(zuo)用(yong),又要(yao)調動委(wei)(wei)(wei)內專業機(ji)(ji)構(gou)開展指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)(de)積極性。要(yao)按照指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)(de)總體(ti)部署,通過會(hui)議、簡報(bao)、調研交(jiao)流和(he)指導(dao)檢查等多種(zhong)形(xing)式,加快健全(quan)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)系統上下(xia)(xia)聯動、運轉有力的(de)(de)(de)(de)(de)(de)指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)機(ji)(ji)制。要(yao)及時(shi)總結推(tui)廣指導(dao)監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)中的(de)(de)(de)(de)(de)(de)特色做法(fa)(fa)和(he)先進(jin)(jin)經驗,及時(shi)反饋工作(zuo)(zuo)(zuo)(zuo)中遇到的(de)(de)(de)(de)(de)(de)難點(dian)和(he)問題(ti)。要(yao)認真落實(shi)(shi)《指導(dao)監(jian)(jian)督(du)(du)(du)(du)辦(ban)法(fa)(fa)》確立的(de)(de)(de)(de)(de)(de)立法(fa)(fa)備案、法(fa)(fa)規政策實(shi)(shi)施督(du)(du)(du)(du)查和(he)重(zhong)(zhong)大(da)事項報(bao)告(gao)等“三項制度”。堅持寓指導(dao)于服務之中,發(fa)揮好指導(dao)工作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)(de)引(yin)導(dao)、規范、提高和(he)促進(jin)(jin)作(zuo)(zuo)(zuo)(zuo)用(yong),同時(shi)防止(zhi)越權(quan)(quan)干預下(xia)(xia)級(ji)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)依法(fa)(fa)行權(quan)(quan)履責。堅持監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)“少而精”的(de)(de)(de)(de)(de)(de)原(yuan)則,注意把監(jian)(jian)督(du)(du)(du)(du)工作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)(de)著力點(dian)放(fang)在(zai)確保國(guo)(guo)資(zi)(zi)監(jian)(jian)管法(fa)(fa)律(lv)法(fa)(fa)規和(he)國(guo)(guo)家政策的(de)(de)(de)(de)(de)(de)貫徹(che)實(shi)(shi)施上,放(fang)在(zai)國(guo)(guo)企改制、產(chan)(chan)權(quan)(quan)轉讓等可能出(chu)現違法(fa)(fa)違規行為的(de)(de)(de)(de)(de)(de)重(zhong)(zhong)點(dian)環節上,放(fang)在(zai)防范國(guo)(guo)有資(zi)(zi)產(chan)(chan)重(zhong)(zhong)大(da)損(sun)失和(he)重(zhong)(zhong)大(da)不良社會(hui)影響的(de)(de)(de)(de)(de)(de)潛在(zai)風(feng)險上。

  (三)要進一(yi)步突出指導監督工(gong)作重點(dian)。

  各地國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委要(yao)(yao)根據“十二五”時期(qi)指導(dao)監(jian)督工作(zuo)總體(ti)(ti)部署,注意從本地區實際情況和(he)工作(zuo)需要(yao)(yao)出發(fa),明確(que)(que)(que)工作(zuo)重(zhong)點,抓好重(zhong)點突破。要(yao)(yao)立足(zu)于(yu)(yu)進一步(bu)發(fa)揮(hui)國(guo)(guo)(guo)有(you)(you)經(jing)(jing)濟在地方經(jing)(jing)濟發(fa)展中(zhong)的(de)引領(ling)帶動作(zuo)用,積(ji)極參與當地企(qi)業(ye)脫鉤改制(zhi)(zhi)和(he)調整重(zhong)組(zu)工作(zuo),加(jia)(jia)快(kuai)推進地方經(jing)(jing)營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)的(de)集中(zhong)統一監(jian)管。要(yao)(yao)立足(zu)于(yu)(yu)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管體(ti)(ti)制(zhi)(zhi)改革(ge)的(de)正確(que)(que)(que)方向,堅持政(zheng)企(qi)分(fen)(fen)開、政(zheng)資(zi)(zi)(zi)(zi)分(fen)(fen)開、所有(you)(you)權與經(jing)(jing)營權相分(fen)(fen)離,確(que)(que)(que)保國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委直(zhi)屬特(te)設機構定位(wei),切實扭轉部分(fen)(fen)地市級國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委回歸(gui)行政(zheng)化(hua)的(de)趨勢。要(yao)(yao)立足(zu)于(yu)(yu)新的(de)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管體(ti)(ti)制(zhi)(zhi)的(de)特(te)點和(he)優(you)勢,繼續(xu)探索加(jia)(jia)強縣(xian)級經(jing)(jing)營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管工作(zuo),鼓勵國(guo)(guo)(guo)有(you)(you)企(qi)業(ye)數量(liang)較多、企(qi)業(ye)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)規模較大的(de)縣(xian)單獨設立國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委,指導(dao)暫不具備(bei)條件(jian)的(de)縣(xian)抓緊明確(que)(que)(que)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管責任主體(ti)(ti)。

  (四)要不(bu)斷提升(sheng)指導(dao)監督工(gong)作能力和水平。

  指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)(zuo)涉及(ji)國(guo)(guo)(guo)資監(jian)管和國(guo)(guo)(guo)企(qi)改(gai)革(ge)發展(zhan)的(de)方方面(mian)面(mian),政策要求(qiu)高,探(tan)索性(xing)(xing)很強,推進難度(du)大(da)(da),必須不斷(duan)提升指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)(zuo)的(de)能力和水平。要深(shen)入學習(xi)領(ling)會黨的(de)十六(liu)大(da)(da)、十七大(da)(da)關于國(guo)(guo)(guo)有資產監(jian)管體制改(gai)革(ge)和完善(shan)的(de)一(yi)系列方針政策,不斷(duan)探(tan)索解決(jue)指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)(zuo)涉及(ji)的(de)方向性(xing)(xing)、全局性(xing)(xing)、戰略性(xing)(xing)問題(ti)。要適應指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)(zuo)面(mian)臨的(de)新形勢新任務(wu),進一(yi)步加(jia)強指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)(zuo)隊伍(wu)(wu)建(jian)設。堅持“學用結合”,經常組織國(guo)(guo)(guo)資委系統深(shen)入交流學習(xi),及(ji)時研討重點問題(ti),加(jia)快(kuai)提高指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)(zuo)隊伍(wu)(wu)的(de)政治(zhi)業務(wu)素(su)質和綜合工作(zuo)(zuo)(zuo)能力,努力培養一(yi)支懂政策法規、精(jing)國(guo)(guo)(guo)資監(jian)管、善(shan)協調服務(wu)的(de)指(zhi)導(dao)監(jian)督(du)工作(zuo)(zuo)(zuo)隊伍(wu)(wu)。

  根(gen)據委(wei)里會(hui)(hui)議計(ji)劃(hua),今年不再(zai)專門召(zhao)開國資(zi)委(wei)系統政(zheng)策法規工作會(hui)(hui)議,借此機(ji)會(hui)(hui),我想重點強調兩(liang)個問(wen)題(ti)。

  (一)關(guan)于依法行權履(lv)責、進一步加(jia)強法治機構建設(she)。

  近幾年(nian)來(lai),國(guo)(guo)務(wu)院高度重視(shi)法(fa)治政(zheng)(zheng)(zheng)府(fu)(fu)建設,專門印發(fa)了《國(guo)(guo)務(wu)院全(quan)面推(tui)進依法(fa)行(xing)政(zheng)(zheng)(zheng)實施綱要》和《國(guo)(guo)務(wu)院關于加強法(fa)治政(zheng)(zheng)(zheng)府(fu)(fu)建設的意見(jian)》,并(bing)且(qie)召開了全(quan)國(guo)(guo)依法(fa)行(xing)政(zheng)(zheng)(zheng)工(gong)作(zuo)(zuo)(zuo)會議(yi),明確要求(qiu)各級政(zheng)(zheng)(zheng)府(fu)(fu)部門從立法(fa)、決(jue)策(ce)、執行(xing)、監(jian)督(du)等方面,采取(qu)切(qie)實措施,全(quan)面推(tui)進依法(fa)行(xing)政(zheng)(zheng)(zheng)工(gong)作(zuo)(zuo)(zuo)。國(guo)(guo)資委雖然不是政(zheng)(zheng)(zheng)府(fu)(fu)行(xing)政(zheng)(zheng)(zheng)部門,但(dan)作(zuo)(zuo)(zuo)為直屬特(te)設機構在依法(fa)行(xing)權履責(ze)過程中(zhong),同樣(yang)必(bi)須貫(guan)徹落實好這(zhe)些部署(shu)和要求(qiu)。

  國(guo)(guo)(guo)(guo)(guo)務院國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)去年12月印發了《關于依(yi)法(fa)(fa)行(xing)權履責(ze)(ze)進一步加(jia)強法(fa)(fa)治機(ji)構(gou)(gou)建(jian)設的(de)(de)實(shi)施意(yi)見》,明確提出(chu)加(jia)強國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)法(fa)(fa)治機(ji)構(gou)(gou)建(jian)設的(de)(de)總體要(yao)(yao)求和(he)(he)具體任務。希(xi)望各(ge)(ge)地國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)高度重視這(zhe)項(xiang)(xiang)工(gong)(gong)(gong)作。一要(yao)(yao)繼(ji)續做(zuo)好國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)管立法(fa)(fa)工(gong)(gong)(gong)作。國(guo)(guo)(guo)(guo)(guo)務院國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)于近日制(zhi)定出(chu)臺了《中央(yang)企(qi)(qi)業境(jing)外國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產監(jian)督管理(li)暫(zan)行(xing)辦法(fa)(fa)》和(he)(he)《中央(yang)企(qi)(qi)業境(jing)外國(guo)(guo)(guo)(guo)(guo)有(you)產權管理(li)暫(zan)行(xing)辦法(fa)(fa)》,目(mu)前正(zheng)在抓緊起草《企(qi)(qi)業國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產基礎管理(li)條例》,同時(shi)配合(he)財政部起草《國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)本(ben)經(jing)(jing)營預算條例》。各(ge)(ge)地國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)也要(yao)(yao)結合(he)本(ben)地區(qu)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)管工(gong)(gong)(gong)作實(shi)際(ji)和(he)(he)突(tu)出(chu)問(wen)題,切實(shi)加(jia)強相關制(zhi)度建(jian)設,努力實(shi)現國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)履行(xing)職(zhi)(zhi)責(ze)(ze)的(de)(de)各(ge)(ge)項(xiang)(xiang)行(xing)為都(dou)有(you)法(fa)(fa)可依(yi)。二要(yao)(yao)堅(jian)持國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)系統(tong)依(yi)法(fa)(fa)科學民主決策。加(jia)強對(dui)重大(da)決策事項(xiang)(xiang)的(de)(de)合(he)法(fa)(fa)性審查(cha),未經(jing)(jing)合(he)法(fa)(fa)性審查(cha)或者經(jing)(jing)審查(cha)不合(he)法(fa)(fa)的(de)(de),不能(neng)提交委(wei)(wei)(wei)主任辦公(gong)會議(yi)討(tao)論決定。三要(yao)(yao)牢(lao)固樹立程(cheng)(cheng)序意(yi)識。在履行(xing)出(chu)資(zi)(zi)人(ren)職(zhi)(zhi)責(ze)(ze)過程(cheng)(cheng)中,自覺(jue)按程(cheng)(cheng)序辦事,嚴格遵守(shou)公(gong)司(si)(si)法(fa)(fa)、企(qi)(qi)業國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)產法(fa)(fa)和(he)(he)公(gong)司(si)(si)章(zhang)程(cheng)(cheng)有(you)關公(gong)司(si)(si)治理(li)結構(gou)(gou)和(he)(he)議(yi)事規(gui)則的(de)(de)各(ge)(ge)項(xiang)(xiang)規(gui)定,認真執(zhi)行(xing)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)工(gong)(gong)(gong)作規(gui)程(cheng)(cheng)。四要(yao)(yao)深入開展“六(liu)五(wu)”普法(fa)(fa)工(gong)(gong)(gong)作。根(gen)據全國(guo)(guo)(guo)(guo)(guo)普法(fa)(fa)辦“六(liu)五(wu)”普法(fa)(fa)規(gui)劃(hua)和(he)(he)即將印發的(de)(de)《國(guo)(guo)(guo)(guo)(guo)務院國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)關于在國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)系統(tong)開展法(fa)(fa)制(zhi)宣傳教(jiao)育的(de)(de)第六(liu)個五(wu)年規(gui)劃(hua)》,進一步提高國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)系統(tong)廣大(da)干(gan)部職(zhi)(zhi)工(gong)(gong)(gong)特別(bie)是領導干(gan)部的(de)(de)法(fa)(fa)律(lv)意(yi)識,大(da)力推進機(ji)關合(he)規(gui)文化建(jian)設,自覺(jue)防范(fan)好各(ge)(ge)級國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)行(xing)權履責(ze)(ze)中的(de)(de)法(fa)(fa)律(lv)風險(xian)。

  (二)關于加快落實(shi)地方國有(you)重點企業法制工作三年目標。

  按照地(di)方國(guo)(guo)(guo)有重(zhong)點(dian)企(qi)業(ye)法(fa)(fa)(fa)制工作第二個三年目標要(yao)求(qiu)(qiu),在今年年底前,省屬國(guo)(guo)(guo)有重(zhong)點(dian)企(qi)業(ye)要(yao)全部(bu)設(she)立法(fa)(fa)(fa)律(lv)事務機構,70%以(yi)上(shang)的(de)企(qi)業(ye)要(yao)建立總(zong)法(fa)(fa)(fa)律(lv)顧問制度。據初步統計(ji),截止到今年5月底,928戶省屬國(guo)(guo)(guo)有重(zhong)點(dian)企(qi)業(ye)中,有782戶建立了(le)法(fa)(fa)(fa)律(lv)事務機構,占(zhan)84%;419戶建立了(le)總(zong)法(fa)(fa)(fa)律(lv)顧問制度,占(zhan)45%。總(zong)體上(shang)看(kan),這一進展與目標要(yao)求(qiu)(qiu)相比還有不(bu)小差(cha)距,特別是有6個省國(guo)(guo)(guo)資委所監管(guan)企(qi)業(ye),至今未(wei)有一戶設(she)立總(zong)法(fa)(fa)(fa)律(lv)顧問,應當(dang)引(yin)起(qi)我(wo)們的(de)高度重(zhong)視。

  目(mu)(mu)前,距離三年(nian)(nian)目(mu)(mu)標(biao)(biao)(biao)(biao)結(jie)束僅剩半(ban)年(nian)(nian)時間,各地(di)國(guo)(guo)資委(wei)要(yao)(yao)(yao)(yao)進(jin)(jin)一步增強緊迫感,采取有力措(cuo)施盡(jin)快完(wan)成任(ren)務。一要(yao)(yao)(yao)(yao)切實落(luo)實工作(zuo)責任(ren),加大推進(jin)(jin)力度。尤其是進(jin)(jin)展較慢的(de)(de)省市,國(guo)(guo)資委(wei)領(ling)(ling)導(dao)(dao)要(yao)(yao)(yao)(yao)親自抓,法(fa)(fa)規處室要(yao)(yao)(yao)(yao)切實履行職責,要(yao)(yao)(yao)(yao)會(hui)同(tong)干部管(guan)理處室在摸清(qing)具(ju)體(ti)情況(kuang)和(he)原(yuan)因的(de)(de)基(ji)礎上,抓緊進(jin)(jin)行專題(ti)研究,制(zhi)定(ding)符合(he)實際的(de)(de)整改推進(jin)(jin)計劃。二要(yao)(yao)(yao)(yao)及時開展專項督導(dao)(dao),有效解(jie)決推進(jin)(jin)三年(nian)(nian)目(mu)(mu)標(biao)(biao)(biao)(biao)的(de)(de)短(duan)板。要(yao)(yao)(yao)(yao)針對所監管(guan)企(qi)(qi)業落(luo)實三年(nian)(nian)目(mu)(mu)標(biao)(biao)(biao)(biao)的(de)(de)薄弱環(huan)節,擬定(ding)督導(dao)(dao)名單(dan),由(you)國(guo)(guo)資委(wei)領(ling)(ling)導(dao)(dao)帶隊,通(tong)(tong)(tong)過與企(qi)(qi)業領(ling)(ling)導(dao)(dao)當面交換(huan)意見、幫助(zhu)總結(jie)分析(xi)典型案例等(deng)形(xing)式,對重點(dian)(dian)企(qi)(qi)業逐戶開展專項督導(dao)(dao)。三要(yao)(yao)(yao)(yao)注意抓好總法(fa)(fa)律顧問(wen)的(de)(de)上崗到位(wei),突出(chu)推進(jin)(jin)三年(nian)(nian)目(mu)(mu)標(biao)(biao)(biao)(biao)實現(xian)的(de)(de)重點(dian)(dian)環(huan)節。對于暫時沒有合(he)適專職人選的(de)(de)企(qi)(qi)業,可(ke)(ke)以由(you)企(qi)(qi)業領(ling)(ling)導(dao)(dao)班子成員兼任(ren),也可(ke)(ke)以面向社會(hui)公(gong)開招聘(pin)。各地(di)還可(ke)(ke)以借(jie)鑒(jian)江西、河(he)南(nan)、湖北等(deng)地(di)國(guo)(guo)資委(wei)的(de)(de)做法(fa)(fa),向監管(guan)企(qi)(qi)業直接委(wei)派(pai)總法(fa)(fa)律顧問(wen)。四要(yao)(yao)(yao)(yao)認(ren)真組織檢查(cha)(cha)驗(yan)收,確保(bao)三年(nian)(nian)目(mu)(mu)標(biao)(biao)(biao)(biao)的(de)(de)實現(xian)不走(zou)過場。各地(di)要(yao)(yao)(yao)(yao)按照目(mu)(mu)標(biao)(biao)(biao)(biao)要(yao)(yao)(yao)(yao)求的(de)(de)基(ji)本內容,借(jie)鑒(jian)國(guo)(guo)務院國(guo)(guo)資委(wei)檢查(cha)(cha)驗(yan)收中央企(qi)(qi)業的(de)(de)做法(fa)(fa),具(ju)體(ti)細化檢查(cha)(cha)驗(yan)收標(biao)(biao)(biao)(biao)準,在今年(nian)(nian)年(nian)(nian)底前后,通(tong)(tong)(tong)過自查(cha)(cha)、互(hu)查(cha)(cha)、抽(chou)查(cha)(cha)相結(jie)合(he)的(de)(de)方式,全面檢查(cha)(cha)本地(di)區(qu)國(guo)(guo)有重點(dian)(dian)企(qi)(qi)業三年(nian)(nian)目(mu)(mu)標(biao)(biao)(biao)(biao)的(de)(de)完(wan)成情況(kuang),注意總結(jie)先進(jin)(jin)典型,著力解(jie)決突出(chu)困難(nan)和(he)問(wen)題(ti),檢查(cha)(cha)結(jie)果要(yao)(yao)(yao)(yao)以適當形(xing)式進(jin)(jin)行通(tong)(tong)(tong)報。
