國資委2016年度法治建設取得積極進展

貫徹落實中(zhong)(zhong)共中(zhong)(zhong)央(yang)、國務院印發的《法治政府建(jian)(jian)設實施綱(gang)要(yao)(2015-2020年(nian))》(以(yi)下簡稱《綱(gang)要(yao)》)要(yao)求,國資委2016年(nian)法治建(jian)(jian)設取(qu)得(de)積極進展。

一、切實(shi)加強組織領(ling)導

貫(guan)徹落(luo)(luo)實(shi)(shi)。經黨(dang)(dang)(dang)委(wei)(wei)會(hui)(hui)(hui)(hui)(hui)和(he)主任(ren)(ren)(ren)辦(ban)公會(hui)(hui)(hui)(hui)(hui)審議通過,印發(fa)(fa)《國(guo)(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)推(tui)(tui)進(jin)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)機(ji)構建設(she)實(shi)(shi)施方(fang)(fang)(fang)案(an)》(以(yi)下簡稱(cheng)《實(shi)(shi)施方(fang)(fang)(fang)案(an)》,將(jiang)《綱要(yao)(yao)(yao)(yao)(yao)》規(gui)定(ding)和(he)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管工(gong)(gong)(gong)作(zuo)實(shi)(shi)際相(xiang)(xiang)結(jie)合,明確(que)(que)(que)6個方(fang)(fang)(fang)面24項主要(yao)(yao)(yao)(yao)(yao)任(ren)(ren)(ren)務(wu),并(bing)(bing)逐一(yi)細化(hua)(hua)落(luo)(luo)實(shi)(shi)負(fu)責(ze)(ze)廳(ting)局、時(shi)(shi)間(jian)進(jin)度安排和(he)可檢驗(yan)的(de)(de)成果形式(shi)。四(si)是(shi)強(qiang)化(hua)(hua)工(gong)(gong)(gong)作(zuo)部署推(tui)(tui)動。黨(dang)(dang)(dang)委(wei)(wei)會(hui)(hui)(hui)(hui)(hui)、主任(ren)(ren)(ren)辦(ban)公會(hui)(hui)(hui)(hui)(hui)多次研究(jiu)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)作(zuo),主要(yao)(yao)(yao)(yao)(yao)負(fu)責(ze)(ze)同(tong)志親(qin)自謀(mou)劃、親(qin)自協調,確(que)(que)(que)保法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建設(she)與年(nian)度工(gong)(gong)(gong)作(zuo)要(yao)(yao)(yao)(yao)(yao)點同(tong)部署、同(tong)推(tui)(tui)進(jin)、同(tong)督(du)促;在中(zhong)(zhong)央(yang)企(qi)業(ye)、地方(fang)(fang)(fang)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)負(fu)責(ze)(ze)人(ren)會(hui)(hui)(hui)(hui)(hui)議上,主要(yao)(yao)(yao)(yao)(yao)負(fu)責(ze)(ze)同(tong)志明確(que)(que)(que)要(yao)(yao)(yao)(yao)(yao)求強(qiang)化(hua)(hua)依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)監(jian)(jian)管,嚴格依(yi)據國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管相(xiang)(xiang)關(guan)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)規(gui)規(gui)定(ding)的(de)(de)權(quan)限(xian)和(he)程(cheng)序行(xing)權(quan)履職(zhi),健(jian)全(quan)(quan)(quan)完善(shan)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管法(fa)(fa)(fa)(fa)(fa)(fa)(fa)規(gui)制(zhi)度體(ti)系(xi)(xi)(xi);組(zu)織召開中(zhong)(zhong)央(yang)企(qi)業(ye)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)作(zuo)會(hui)(hui)(hui)(hui)(hui)議和(he)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)系(xi)(xi)(xi)統政策法(fa)(fa)(fa)(fa)(fa)(fa)(fa)規(gui)工(gong)(gong)(gong)作(zuo)研討(tao)培訓班(ban),明確(que)(que)(que)2017年(nian)推(tui)(tui)進(jin)依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)監(jian)(jian)管、依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)企(qi)的(de)(de)具(ju)體(ti)工(gong)(gong)(gong)作(zuo)任(ren)(ren)(ren)務(wu)。

二、著力打造(zao)國資監管法治機構

認真(zhen)落(luo)實以(yi)管(guan)資本為主(zhu)加強國有(you)資產監(jian)管(guan)的改革要求,嚴格依據公司法(fa)(fa)、企(qi)業國有(you)資產法(fa)(fa)全(quan)面履行出資人職(zhi)責,建立健全(quan)依法(fa)(fa)監(jian)管(guan)的機制制度,法(fa)(fa)治機構建設取得(de)明顯進展。

(一(yi))依(yi)(yi)(yi)法(fa)全面履(lv)行(xing)(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)職(zhi)責。一(yi)是推進(jin)國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)職(zhi)能(neng)轉變(bian)。研究(jiu)(jiu)制(zhi)訂國(guo)(guo)(guo)務院國(guo)(guo)(guo)資(zi)(zi)(zi)委以管(guan)資(zi)(zi)(zi)本(ben)為(wei)主推進(jin)職(zhi)能(neng)轉變(bian)方(fang)案,強(qiang)化(hua)管(guan)資(zi)(zi)(zi)本(ben)重(zhong)點職(zhi)能(neng),加(jia)(jia)強(qiang)出資(zi)(zi)(zi)人監(jian)(jian)(jian)(jian)督(du),全面加(jia)(jia)強(qiang)黨的建(jian)設(she),精簡(jian)監(jian)(jian)(jian)(jian)管(guan)事(shi)(shi)項,改進(jin)國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)方(fang)式和(he)手(shou)段。同(tong)時,加(jia)(jia)快研究(jiu)(jiu)制(zhi)訂出資(zi)(zi)(zi)人監(jian)(jian)(jian)(jian)管(guan)權(quan)力和(he)責任(ren)清單。二是運用(yong)法(fa)治化(hua)方(fang)式行(xing)(xing)權(quan)履(lv)責。嚴格按(an)照法(fa)定(ding)職(zhi)責和(he)程序加(jia)(jia)強(qiang)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan),完善中央企業章(zhang)程管(guan)理(li),推動(dong)中央企業建(jian)立(li)規(gui)(gui)范(fan)董事(shi)(shi)會,進(jin)一(yi)步(bu)規(gui)(gui)范(fan)董事(shi)(shi)會運作,依(yi)(yi)(yi)法(fa)依(yi)(yi)(yi)規(gui)(gui)選(xuan)派、選(xuan)任(ren)和(he)管(guan)理(li)股東代表、董事(shi)(shi)、監(jian)(jian)(jian)(jian)事(shi)(shi)及(ji)經(jing)營(ying)管(guan)理(li)者,更多(duo)通過(guo)公(gong)司法(fa)人治理(li)結構有(you)(you)效體現(xian)出資(zi)(zi)(zi)人意志(zhi)。三是依(yi)(yi)(yi)法(fa)強(qiang)化(hua)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)督(du)。成立(li)監(jian)(jian)(jian)(jian)督(du)一(yi)局、監(jian)(jian)(jian)(jian)督(du)二局、監(jian)(jian)(jian)(jian)督(du)三局,負(fu)責深入核查、分類處(chu)置和(he)整(zheng)改督(du)辦委機關、監(jian)(jian)(jian)(jian)事(shi)(shi)會及(ji)有(you)(you)關監(jian)(jian)(jian)(jian)督(du)機構發現(xian)移交的問(wen)題(ti),依(yi)(yi)(yi)法(fa)組織開展國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)重(zhong)大損失調查,提出有(you)(you)關責任(ren)追(zhui)究(jiu)(jiu)的意見(jian)建(jian)議。落實《關于建(jian)立(li)國(guo)(guo)(guo)有(you)(you)企業違規(gui)(gui)經(jing)營(ying)投(tou)資(zi)(zi)(zi)責任(ren)追(zhui)究(jiu)(jiu)制(zhi)度(du)的意見(jian)》要求,加(jia)(jia)大對中央企業違規(gui)(gui)經(jing)營(ying)責任(ren)追(zhui)究(jiu)(jiu)力度(du),形成發現(xian)、調查、處(chu)理(li)問(wen)題(ti)的監(jian)(jian)(jian)(jian)督(du)工作閉環。

(二)完善國(guo)(guo)(guo)資(zi)(zi)監管(guan)(guan)法(fa)(fa)(fa)規(gui)(gui)(gui)制度(du)體系。一(yi)(yi)是(shi)加強重點(dian)領域國(guo)(guo)(guo)資(zi)(zi)監管(guan)(guan)立(li)法(fa)(fa)(fa)。圍繞(rao)國(guo)(guo)(guo)企(qi)國(guo)(guo)(guo)資(zi)(zi)改(gai)革發(fa)展(zhan)中(zhong)心任務,突出以管(guan)(guan)資(zi)(zi)本為(wei)主,編制我委(wei)(wei)(wei)2016年度(du)立(li)法(fa)(fa)(fa)工(gong)作(zuo)計劃,保障改(gai)革立(li)法(fa)(fa)(fa)需求(qiu)。全(quan)年共出臺《企(qi)業國(guo)(guo)(guo)有(you)資(zi)(zi)產交易監督管(guan)(guan)理辦法(fa)(fa)(fa)》《中(zhong)央企(qi)業負責(ze)人(ren)經營(ying)業績考(kao)核(he)辦法(fa)(fa)(fa)》《關(guan)于完善中(zhong)央企(qi)業功能分(fen)類考(kao)核(he)的(de)(de)實施方案》等(deng)27件(jian)(jian)(jian)規(gui)(gui)(gui)章規(gui)(gui)(gui)范(fan)(fan)性文件(jian)(jian)(jian)(含(han)黨委(wei)(wei)(wei)規(gui)(gui)(gui)范(fan)(fan)性文件(jian)(jian)(jian))。截至2016年底,國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)現(xian)行(xing)有(you)效(xiao)(xiao)規(gui)(gui)(gui)章28件(jian)(jian)(jian),規(gui)(gui)(gui)范(fan)(fan)性文件(jian)(jian)(jian)294件(jian)(jian)(jian),國(guo)(guo)(guo)資(zi)(zi)監管(guan)(guan)法(fa)(fa)(fa)規(gui)(gui)(gui)制度(du)體系進一(yi)(yi)步完善。二是(shi)加強規(gui)(gui)(gui)章規(gui)(gui)(gui)范(fan)(fan)性文件(jian)(jian)(jian)合法(fa)(fa)(fa)性審(shen)查。根據立(li)法(fa)(fa)(fa)法(fa)(fa)(fa)和(he)《規(gui)(gui)(gui)章制定程序條例》,嚴格落(luo)實《國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)立(li)法(fa)(fa)(fa)工(gong)作(zuo)規(gui)(gui)(gui)則》、《國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)規(gui)(gui)(gui)范(fan)(fan)性文件(jian)(jian)(jian)制定暫(zan)行(xing)辦法(fa)(fa)(fa)》,要求(qiu)規(gui)(gui)(gui)章規(gui)(gui)(gui)范(fan)(fan)性文件(jian)(jian)(jian)在提請委(wei)(wei)(wei)主任辦公(gong)(gong)會議審(shen)議前(qian),須由法(fa)(fa)(fa)制機構進行(xing)合法(fa)(fa)(fa)性審(shen)查并出具審(shen)查報告(gao)。三是(shi)深(shen)入開展(zhan)國(guo)(guo)(guo)資(zi)(zi)監管(guan)(guan)文件(jian)(jian)(jian)清理。根據國(guo)(guo)(guo)務院統一(yi)(yi)部署要求(qiu),對(dui)不利于穩(wen)增長、促改(gai)革、調(diao)結(jie)(jie)構、惠民(min)生的(de)(de)政(zheng)策(ce)性文件(jian)(jian)(jian)進行(xing)清理,共宣布廢止(zhi)、失效(xiao)(xiao)一(yi)(yi)批政(zheng)策(ce)性文件(jian)(jian)(jian)。清理結(jie)(jie)果以國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)公(gong)(gong)告(gao)的(de)(de)形(xing)式向社會公(gong)(gong)布。此外(wai),積(ji)極參(can)與(yu)《中(zhong)華(hua)(hua)人(ren)民(min)共和(he)國(guo)(guo)(guo)商品流(liu)通(tong)法(fa)(fa)(fa)》《中(zhong)華(hua)(hua)人(ren)民(min)共和(he)國(guo)(guo)(guo)反不正(zheng)當競爭法(fa)(fa)(fa)》《中(zhong)華(hua)(hua)人(ren)民(min)共和(he)國(guo)(guo)(guo)電力法(fa)(fa)(fa)》等(deng)國(guo)(guo)(guo)家重要立(li)法(fa)(fa)(fa)。

(三(san))推進決(jue)(jue)(jue)策(ce)科學化、民主(zhu)化、法(fa)(fa)治化。一(yi)是(shi)(shi)完善依法(fa)(fa)決(jue)(jue)(jue)策(ce)程序。明確重大決(jue)(jue)(jue)策(ce)應當(dang)經委黨委會(hui)、委主(zhu)任(ren)辦公(gong)會(hui)議討(tao)論(lun)(lun),由主(zhu)要負(fu)責同(tong)志在(zai)集體討(tao)論(lun)(lun)基礎上作(zuo)出決(jue)(jue)(jue)定。二是(shi)(shi)加強重大決(jue)(jue)(jue)策(ce)合法(fa)(fa)性(xing)審查。除規章規范性(xing)文件外,明確涉及(ji)國企國資改革發(fa)(fa)展的(de)重大決(jue)(jue)(jue)策(ce),必須征求(qiu)法(fa)(fa)制機(ji)(ji)構(gou)意見。三(san)是(shi)(shi)探(tan)索推行機(ji)(ji)關(guan)法(fa)(fa)律(lv)顧問制度(du)。在(zai)國資監管立法(fa)(fa)、重大事(shi)項決(jue)(jue)(jue)策(ce)、訴(su)訟復(fu)議和訴(su)訟案件應對等機(ji)(ji)關(guan)法(fa)(fa)律(lv)事(shi)務中,充分發(fa)(fa)揮法(fa)(fa)律(lv)顧問的(de)法(fa)(fa)律(lv)咨詢論(lun)(lun)證、審核(he)把關(guan)和協調服務作(zuo)用。

(四)強化對(dui)(dui)權(quan)力(li)的制(zhi)約和監(jian)(jian)(jian)督(du)(du)。一(yi)是(shi)健全國(guo)(guo)資(zi)監(jian)(jian)(jian)管權(quan)力(li)運(yun)行制(zhi)約和監(jian)(jian)(jian)督(du)(du)體系(xi)。注重(zhong)廉政風險防(fang)控(kong)建設,加(jia)強對(dui)(dui)“關(guan)鍵環(huan)節”的監(jian)(jian)(jian)督(du)(du),緊(jin)盯權(quan)力(li)集中(zhong)、資(zi)金密集、經(jing)營(ying)壟斷(duan)等重(zhong)點領域、重(zhong)點環(huan)節和重(zhong)點人(ren)員(yuan)。在國(guo)(guo)資(zi)委門(men)戶網站(zhan)添加(jia)中(zhong)央(yang)國(guo)(guo)家機關(guan)舉(ju)報(bao)網站(zhan)網址,暢(chang)通(tong)舉(ju)報(bao)監(jian)(jian)(jian)督(du)(du)渠道。二是(shi)自覺(jue)接受(shou)黨內監(jian)(jian)(jian)督(du)(du)和審計(ji)監(jian)(jian)(jian)督(du)(du)。按照“條條要(yao)整(zheng)改(gai)、件(jian)件(jian)有著落”的要(yao)求,把(ba)巡(xun)視反饋的突出(chu)問(wen)(wen)題,提出(chu)對(dui)(dui)應整(zheng)改(gai)措(cuo)施,一(yi)一(yi)對(dui)(dui)賬(zhang)銷(xiao)號,切實(shi)發(fa)揮好巡(xun)視發(fa)現問(wen)(wen)題、形(xing)成震懾、倒逼(bi)改(gai)革、促進發(fa)展(zhan)的作(zuo)(zuo)用。積(ji)極配合(he)審計(ji)監(jian)(jian)(jian)督(du)(du),全面提供資(zi)料、主(zhu)動說明(ming)情(qing)況;對(dui)(dui)審計(ji)發(fa)現的問(wen)(wen)題及(ji)時(shi)明(ming)確責任,落實(shi)整(zheng)改(gai)措(cuo)施,確保監(jian)(jian)(jian)管更加(jia)規(gui)范有效。三是(shi)全面推進信(xin)(xin)息(xi)公(gong)(gong)開。2016年我(wo)委通(tong)過(guo)國(guo)(guo)資(zi)委門(men)戶網站(zhan)主(zhu)動發(fa)布(bu)各類信(xin)(xin)息(xi),涵蓋國(guo)(guo)企國(guo)(guo)資(zi)深化改(gai)革、中(zhong)央(yang)企業(ye)(ye)經(jing)營(ying)發(fa)展(zhan)、中(zhong)央(yang)企業(ye)(ye)履行社(she)會責任等方面情(qing)況,特別是(shi)向社(she)會主(zhu)動公(gong)(gong)開中(zhong)央(yang)企業(ye)(ye)負責同(tong)志(zhi)2015年度(du)薪酬(chou)水(shui)平情(qing)況,進一(yi)步提高(gao)了中(zhong)央(yang)企業(ye)(ye)透明(ming)度(du)。依法依規(gui)做(zuo)好依申請公(gong)(gong)開工作(zuo)(zuo),印(yin)發(fa)了《關(guan)于推進中(zhong)央(yang)企業(ye)(ye)信(xin)(xin)息(xi)公(gong)(gong)開的指導意見》,推動中(zhong)央(yang)企業(ye)(ye)信(xin)(xin)息(xi)公(gong)(gong)開試點工作(zuo)(zuo)有序進行。

(五(wu))依法有效化(hua)解矛盾糾紛。一(yi)是(shi)提高(gao)信(xin)(xin)息公(gong)開、授權委托(tuo)等法律(lv)審核質量(liang),全面(mian)做(zuo)好涉訴案(an)件和(he)行政復議(yi)應對(dui)工(gong)(gong)作(zuo),較(jiao)好地防范(fan)了委機關法律(lv)風險(xian)。二是(shi)完善信(xin)(xin)訪(fang)工(gong)(gong)作(zuo)制(zhi)度(du)(du)。建立局處級干部定期參加接訪(fang)、新(xin)錄公(gong)務員信(xin)(xin)訪(fang)鍛煉(lian)等制(zhi)度(du)(du),提高(gao)全委干部信(xin)(xin)訪(fang)工(gong)(gong)作(zuo)意識。進(jin)一(yi)步規范(fan)信(xin)(xin)訪(fang)事項(xiang)辦(ban)理流程,研究網(wang)上信(xin)(xin)訪(fang)工(gong)(gong)作(zuo),暢通信(xin)(xin)訪(fang)渠道,推動通過(guo)法定途徑分類(lei)處理信(xin)(xin)訪(fang)投訴請求。組織中(zhong)(zhong)央企業深(shen)入開展矛盾糾紛排查化(hua)解工(gong)(gong)作(zuo),對(dui)排查出的問(wen)題(ti)做(zuo)到(dao)責任、人員、措施“三落實”,健全中(zhong)(zhong)央企業不穩定問(wen)題(ti)臺(tai)賬。

(六)加強機(ji)(ji)關(guan)法(fa)(fa)(fa)治(zhi)宣(xuan)傳教(jiao)(jiao)育(yu)。一是啟動“七五”普(pu)法(fa)(fa)(fa)工作。制(zhi)定(ding)(ding)《國(guo)(guo)務(wu)(wu)院(yuan)國(guo)(guo)資(zi)委(wei)(wei)關(guan)于在(zai)國(guo)(guo)資(zi)委(wei)(wei)系(xi)統(tong)開展(zhan)(zhan)法(fa)(fa)(fa)治(zhi)宣(xuan)傳教(jiao)(jiao)育(yu)的(de)(de)第七個五年規(gui)(gui)劃(2016-2020年)》,正式(shi)啟動國(guo)(guo)資(zi)委(wei)(wei)系(xi)統(tong)“七五”普(pu)法(fa)(fa)(fa)工作。二是深(shen)入(ru)抓好法(fa)(fa)(fa)治(zhi)教(jiao)(jiao)育(yu)。定(ding)(ding)期(qi)組織“法(fa)(fa)(fa)治(zhi)講堂(tang)”,邀請政(zheng)府機(ji)(ji)關(guan)、高等(deng)院(yuan)校(xiao)的(de)(de)專(zhuan)家學(xue)者以(yi)(yi)及律師、企(qi)業(ye)總法(fa)(fa)(fa)律顧問等(deng),在(zai)各中央企(qi)業(ye)和(he)地(di)方(fang)國(guo)(guo)資(zi)委(wei)(wei)設立分(fen)會(hui)場,以(yi)(yi)視頻形式(shi)進(jin)行(xing)專(zhuan)題(ti)講座,2016年共(gong)舉辦6期(qi)。深(shen)入(ru)開展(zhan)(zhan)“12·4”全(quan)國(guo)(guo)憲法(fa)(fa)(fa)日和(he)全(quan)國(guo)(guo)法(fa)(fa)(fa)制(zhi)宣(xuan)傳日宣(xuan)傳教(jiao)(jiao)育(yu)活動,加強公務(wu)(wu)員初任(ren)培(pei)(pei)訓、干(gan)部任(ren)職(zhi)培(pei)(pei)訓中的(de)(de)法(fa)(fa)(fa)律知(zhi)識培(pei)(pei)訓。組織機(ji)(ji)關(guan)干(gan)部旁(pang)聽我(wo)委(wei)(wei)涉訴案(an)件(jian)庭審(shen)并開展(zhan)(zhan)座談會(hui),通(tong)(tong)過(guo)網絡(luo)、微信等(deng)不(bu)斷拓寬法(fa)(fa)(fa)治(zhi)宣(xuan)傳教(jiao)(jiao)育(yu)渠道,提升機(ji)(ji)關(guan)干(gan)部法(fa)(fa)(fa)治(zhi)素養。三是加強對外法(fa)(fa)(fa)治(zhi)宣(xuan)傳。加強國(guo)(guo)資(zi)監管(guan)法(fa)(fa)(fa)規(gui)(gui)制(zhi)度的(de)(de)普(pu)法(fa)(fa)(fa)宣(xuan)傳,及時(shi)向(xiang)社(she)會(hui)公開國(guo)(guo)資(zi)委(wei)(wei)規(gui)(gui)章規(gui)(gui)范性文件(jian),并通(tong)(tong)過(guo)網站、公告、新聞(wen)通(tong)(tong)氣會(hui)等(deng)方(fang)式(shi)進(jin)行(xing)政(zheng)策解(jie)讀。組織編(bian)輯(ji)出版《一帶一路沿線國(guo)(guo)家法(fa)(fa)(fa)律風險防范指引》印尼、沙特、俄羅斯等(deng)9個國(guo)(guo)家分(fen)冊(ce)。會(hui)同(tong)有(you)關(guan)部門共(gong)同(tong)舉辦2期(qi)反(fan)壟斷法(fa)(fa)(fa)培(pei)(pei)訓班,對中央和(he)地(di)方(fang)國(guo)(guo)有(you)大中型(xing)企(qi)業(ye)進(jin)行(xing)法(fa)(fa)(fa)治(zhi)教(jiao)(jiao)育(yu)培(pei)(pei)訓。在(zai)2016年全(quan)國(guo)(guo)“六五”普(pu)法(fa)(fa)(fa)表彰(zhang)中,國(guo)(guo)務(wu)(wu)院(yuan)國(guo)(guo)資(zi)委(wei)(wei)普(pu)法(fa)(fa)(fa)辦被評(ping)為先進(jin)單位。

三、深入推(tui)進法治央企(qi)建設

認真貫徹全(quan)面(mian)(mian)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國(guo)戰(zhan)略,全(quan)力(li)(li)推(tui)動(dong)(dong)國(guo)資委(wei)《關(guan)于全(quan)面(mian)(mian)推(tui)進(jin)(jin)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)(yang)企(qi)(qi)建(jian)設(she)的(de)意見》落實(shi),力(li)(li)爭到(dao)2020年打(da)造治(zhi)(zhi)(zhi)理(li)(li)(li)完善、經(jing)營(ying)(ying)合(he)規(gui)、管(guan)(guan)(guan)理(li)(li)(li)規(gui)范、守法(fa)(fa)(fa)(fa)(fa)(fa)誠信的(de)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)(yang)企(qi)(qi)。一(yi)(yi)(yi)年來,在我委(wei)指導(dao)推(tui)動(dong)(dong)下,中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)企(qi)(qi)取得積極進(jin)(jin)展和(he)明(ming)(ming)顯(xian)成(cheng)效。一(yi)(yi)(yi)是(shi)(shi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)(yang)企(qi)(qi)建(jian)設(she)順利開(kai)局。推(tui)動(dong)(dong)全(quan)部(bu)中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)成(cheng)立法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)(yang)(yang)企(qi)(qi)建(jian)設(she)領導(dao)小(xiao)組(zu),結合(he)實(shi)際制(zhi)(zhi)定本企(qi)(qi)業(ye)(ye)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)設(she)實(shi)施(shi)方案(an),并將其納入“十三(san)(san)五”規(gui)劃同步(bu)實(shi)施(shi)、同步(bu)推(tui)進(jin)(jin)。許(xu)多企(qi)(qi)業(ye)(ye)主要(yao)領導(dao)親自擔(dan)任(ren)組(zu)長,部(bu)署安排法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工(gong)(gong)作(zuo)重(zhong)點任(ren)務和(he)具體措(cuo)施(shi),切實(shi)履(lv)(lv)行推(tui)進(jin)(jin)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)設(she)第(di)一(yi)(yi)(yi)責(ze)(ze)任(ren)人職責(ze)(ze)。二是(shi)(shi)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)理(li)(li)(li)穩步(bu)推(tui)進(jin)(jin)。指導(dao)中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)全(quan)面(mian)(mian)修(xiu)訂公(gong)司章(zhang)(zhang)程(cheng),健全(quan)議事規(gui)則(ze),編(bian)制(zhi)(zhi)“三(san)(san)會(hui)一(yi)(yi)(yi)層”權(quan)(quan)責(ze)(ze)清單,依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)明(ming)(ming)確職責(ze)(ze)邊界和(he)履(lv)(lv)職程(cheng)序,形成(cheng)權(quan)(quan)責(ze)(ze)對(dui)等(deng)、協調運轉(zhuan)、有效制(zhi)(zhi)衡(heng)的(de)治(zhi)(zhi)(zhi)理(li)(li)(li)機(ji)制(zhi)(zhi)。推(tui)動(dong)(dong)總(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問(wen)制(zhi)(zhi)度(du)和(he)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工(gong)(gong)作(zuo)要(yao)求納入章(zhang)(zhang)程(cheng),明(ming)(ming)確總(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問(wen)列席董(dong)事會(hui),為(wei)重(zhong)大經(jing)營(ying)(ying)決策提供法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)支(zhi)撐,促(cu)進(jin)(jin)各治(zhi)(zhi)(zhi)理(li)(li)(li)主體依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)履(lv)(lv)職、科學決策。三(san)(san)是(shi)(shi)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)合(he)規(gui)經(jing)營(ying)(ying)深(shen)(shen)入開(kai)展。指導(dao)中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)強化改革方案(an)制(zhi)(zhi)定和(he)實(shi)施(shi)過程(cheng)的(de)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)審核把關(guan),依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)依(yi)(yi)(yi)規(gui)參與處置“僵尸企(qi)(qi)業(ye)(ye)”、壓(ya)縮管(guan)(guan)(guan)理(li)(li)(li)層級(ji)(ji),依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)解決破(po)產(chan)注(zhu)銷、債權(quan)(quan)債務處理(li)(li)(li)等(deng)難點問(wen)題,助(zhu)力(li)(li)企(qi)(qi)業(ye)(ye)瘦身健體提質(zhi)增效。四是(shi)(shi)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)(fa)規(gui)范管(guan)(guan)(guan)理(li)(li)(li)持續深(shen)(shen)化。目(mu)前(qian)(qian),中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)規(gui)章(zhang)(zhang)制(zhi)(zhi)度(du)、經(jing)濟合(he)同、重(zhong)要(yao)決策法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)審核率已基本達到(dao)100%。在此基礎(chu)上,進(jin)(jin)一(yi)(yi)(yi)步(bu)督促(cu)企(qi)(qi)業(ye)(ye)提高審核質(zhi)量,加(jia)強風險(xian)識別、預警和(he)合(he)同履(lv)(lv)約(yue)全(quan)程(cheng)管(guan)(guan)(guan)控,推(tui)動(dong)(dong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)管(guan)(guan)(guan)理(li)(li)(li)與經(jing)營(ying)(ying)管(guan)(guan)(guan)理(li)(li)(li)深(shen)(shen)度(du)融(rong)合(he)。組(zu)織中國(guo)石油(you)、中國(guo)移動(dong)(dong)、東(dong)方電氣、招商局集團、中國(guo)中鐵等(deng)5家企(qi)(qi)業(ye)(ye)開(kai)展合(he)規(gui)管(guan)(guan)(guan)理(li)(li)(li)體系建(jian)設(she)試點。五是(shi)(shi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工(gong)(gong)作(zuo)基礎(chu)不斷夯實(shi)。推(tui)動(dong)(dong)中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)進(jin)(jin)一(yi)(yi)(yi)步(bu)健全(quan)總(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問(wen)制(zhi)(zhi)度(du),逐步(bu)拓(tuo)展法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)管(guan)(guan)(guan)理(li)(li)(li)職能,充(chong)實(shi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工(gong)(gong)作(zuo)力(li)(li)量,深(shen)(shen)入開(kai)展法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣傳教育。截至(zhi)目(mu)前(qian)(qian),102家中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)集團全(quan)部(bu)建(jian)立總(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問(wen)制(zhi)(zhi)度(du),全(quan)系統三(san)(san)級(ji)(ji)以上企(qi)(qi)業(ye)(ye)建(jian)立總(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問(wen)制(zhi)(zhi)度(du)的(de)達到(dao)3131戶,專職法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問(wen)人數超過21000人,法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工(gong)(gong)作(zuo)隊伍(wu)進(jin)(jin)一(yi)(yi)(yi)步(bu)壯大。

下一步(bu),我(wo)們將(jiang)深入貫徹黨中央、國務院關于法(fa)治(zhi)政府建設的部署要求,以(yi)(yi)打造法(fa)治(zhi)機構和法(fa)治(zhi)央企為目標,以(yi)(yi)落實《實施(shi)(shi)方案》為抓(zhua)手,進一步(bu)健全(quan)完善制(zhi)(zhi)度機制(zhi)(zhi),強(qiang)化任務措(cuo)施(shi)(shi)督促檢(jian)查,推動依(yi)法(fa)監管、依(yi)法(fa)治(zhi)企再上新臺階。
