國有資(zi)產(chan)監管(guan)大格局的(de)指導意見
為深入貫徹落實黨的十(shi)八(ba)大和(he)十(shi)八(ba)屆(jie)三中(zhong)全會(hui)精神(shen),進一(yi)步(bu)完善全區國(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)(guan)體制(zhi),提高全區國(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)(guan)水平(ping),根據《中(zhong)華人民(min)共和(he)國(guo)(guo)企業(ye)(ye)國(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)法(fa)》、《企業(ye)(ye)國(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)督(du)管(guan)(guan)(guan)(guan)理暫行條例》、《地方國(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)(guan)工作指(zhi)導(dao)監(jian)督(du)辦(ban)法(fa)》(國(guo)(guo)務院國(guo)(guo)資(zi)委(wei)令第(di)25號)等法(fa)律法(fa)規(gui),結合(he)實際,現(xian)就加強市(shi)、縣(xian)(市(shi)、區,以下(xia)簡稱(cheng)縣(xian))國(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)(guan)工作、加快構(gou)建全區國(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)(guan)大格(ge)局(ju),提出如(ru)下(xia)指(zhi)導(dao)意見。
一、重要意義
市、縣(xian)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作是(shi)全區國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作的(de)(de)(de)重(zhong)(zhong)要(yao)組成部分。經(jing)過多年的(de)(de)(de)改革(ge)發展(zhan),全區市、縣(xian)兩(liang)級(ji)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)體制(zhi)(zhi)機(ji)制(zhi)(zhi)不(bu)(bu)斷(duan)完善,國(guo)(guo)(guo)(guo)(guo)有(you)(you)經(jing)濟布局(ju)結(jie)構(gou)不(bu)(bu)斷(duan)優化,國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)規模質量(liang)不(bu)(bu)斷(duan)提升,市、縣(xian)兩(liang)級(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)國(guo)(guo)(guo)(guo)(guo)企(qi)成為(wei)推(tui)動(dong)本地(di)區經(jing)濟社會(hui)發展(zhan)的(de)(de)(de)骨(gu)干(gan)力(li)量(liang)。但是(shi),部分市、縣(xian)面臨著國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)體制(zhi)(zhi)不(bu)(bu)夠(gou)完善、履行國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)出(chu)(chu)資(zi)(zi)人職責不(bu)(bu)夠(gou)到位、國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作進展(zhan)不(bu)(bu)夠(gou)平衡、企(qi)業(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)基礎性管(guan)(guan)理工(gong)(gong)作與形勢任(ren)務要(yao)求不(bu)(bu)適應,以及(ji)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機(ji)構(gou)與有(you)(you)關部門的(de)(de)(de)關系尚(shang)(shang)未(wei)(wei)完全理順(shun)、縣(xian)級(ji)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)出(chu)(chu)資(zi)(zi)人制(zhi)(zhi)度(du)尚(shang)(shang)未(wei)(wei)完全落實(shi)、各級(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)聯合(he)互動(dong)的(de)(de)(de)工(gong)(gong)作機(ji)制(zhi)(zhi)尚(shang)(shang)未(wei)(wei)真正建立等(deng)亟(ji)待(dai)解決(jue)的(de)(de)(de)問(wen)題,影響國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作和國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)改革(ge)的(de)(de)(de)深入推(tui)進,需要(yao)引起高度(du)重(zhong)(zhong)視。
上級國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機(ji)構對下(xia)級政(zheng)府國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作(zuo)進行指導監(jian)(jian)督,是(shi)維護國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)“國(guo)(guo)(guo)家所有(you)、分級代表”的(de)(de)(de)一(yi)項重要制度安排(pai)。加(jia)強指導監(jian)(jian)督工(gong)(gong)作(zuo),是(shi)加(jia)快(kuai)完(wan)善國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)體制和制度的(de)(de)(de)內在要求,也(ye)是(shi)進一(yi)步加(jia)強國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機(ji)構建設的(de)(de)(de)重要措(cuo)施(shi),對于切(qie)實解(jie)決好(hao)市、縣國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)(gong)作(zuo)存在的(de)(de)(de)不到位、不平衡、不適(shi)應等問題,提高(gao)國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機(ji)構履(lv)職(zhi)能力,加(jia)快(kuai)構建整合(he)協調、開放合(he)作(zuo)的(de)(de)(de)國(guo)(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)大(da)格局(ju),實現各級國(guo)(guo)(guo)資(zi)(zi)融合(he)發(fa)展、聯動發(fa)展,更好(hao)地營造國(guo)(guo)(guo)有(you)企業(ye)(ye)改(gai)革(ge)發(fa)展的(de)(de)(de)良好(hao)環(huan)境,做(zuo)強做(zuo)優(you)國(guo)(guo)(guo)有(you)企業(ye)(ye),促進全區(qu)經濟(ji)社會穩中求進、穩中向好(hao)發(fa)展具有(you)十分重要的(de)(de)(de)意(yi)義(yi)。
二、總體要求
市、縣兩級政府要(yao)(yao)加(jia)強對國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)工(gong)(gong)作(zuo)的(de)領導(dao),按(an)照國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)分級管(guan)理的(de)原則,進(jin)一步明確國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)的(de)責任主(zhu)體(ti)。全(quan)區各級國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)機(ji)(ji)構(gou)要(yao)(yao)在本(ben)(ben)級黨委(wei)、政府的(de)領導(dao)下,堅持(chi)(chi)以(yi)(yi)鄧小平理論、“三個代表”重(zhong)(zhong)要(yao)(yao)思想和科(ke)學(xue)發(fa)展(zhan)觀為指(zhi)導(dao),深(shen)入貫徹落實黨的(de)十八(ba)大、十八(ba)屆三中全(quan)會精神,緊(jin)緊(jin)圍繞(rao)推(tui)(tui)動國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)上水(shui)平、國(guo)企(qi)發(fa)展(zhan)上臺階的(de)“兩新目標(biao)”,以(yi)(yi)加(jia)強地方國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)機(ji)(ji)構(gou)建(jian)設、推(tui)(tui)進(jin)經營性國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)集中統一監(jian)(jian)(jian)(jian)管(guan)、強化企(qi)業(ye)國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)基礎管(guan)理為重(zhong)(zhong)點,按(an)照以(yi)(yi)管(guan)資(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)為主(zhu)加(jia)強國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)的(de)要(yao)(yao)求,充分發(fa)揮國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)運(yun)營平臺作(zuo)用,努力(li)提高國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)資(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)化、市場化、證券(quan)化水(shui)平。牢固樹(shu)立各級國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)“一盤棋(qi)”的(de)理念,立足“指(zhi)導(dao)、溝通、交流、服務”,加(jia)快健全(quan)緊(jin)密聯系、深(shen)度融合(he)、有(you)(you)(you)效整合(he)的(de)工(gong)(gong)作(zuo)系統,不斷完(wan)(wan)善(shan)指(zhi)導(dao)監(jian)(jian)(jian)(jian)督有(you)(you)(you)效、互相支持(chi)(chi)有(you)(you)(you)力(li)、溝通協調順暢的(de)工(gong)(gong)作(zuo)機(ji)(ji)制(zhi),推(tui)(tui)動構(gou)建(jian)國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)大格局,努力(li)提升國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)機(ji)(ji)構(gou)依(yi)法履(lv)行出(chu)資(zi)(zi)(zi)(zi)(zi)(zi)人職責的(de)能力(li)和水(shui)平,為完(wan)(wan)善(shan)國(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)體(ti)制(zhi)機(ji)(ji)制(zhi)、促進(jin)國(guo)有(you)(you)(you)企(qi)業(ye)改革發(fa)展(zhan)作(zuo)出(chu)新貢獻。
三、基本原則
(一)堅持國有(you)資(zi)產(chan)屬(shu)于國家所(suo)有(you)原則,落實國有(you)資(zi)產(chan)監管責任,保障國有(you)資(zi)產(chan)監管政策法規的貫徹實施。
(二)堅持(chi)各級(ji)(ji)政(zheng)府分別代表(biao)國(guo)家履(lv)行(xing)出資(zi)人職責(ze)原則,各級(ji)(ji)國(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機(ji)(ji)構(gou)應(ying)當根據本級(ji)(ji)政(zheng)府授(shou)權,按照法定職責(ze)和程序(xu)指導(dao)監(jian)督(du)下級(ji)(ji)國(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機(ji)(ji)構(gou)的(de)工作,尊重和維護下級(ji)(ji)國(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機(ji)(ji)構(gou)的(de)出資(zi)人權利,不得代替(ti)或者(zhe)干預下級(ji)(ji)國(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)機(ji)(ji)構(gou)履(lv)行(xing)出資(zi)人職責(ze)。
(三)堅持政(zheng)企分開(kai)、政(zheng)資(zi)分開(kai)、所有(you)權(quan)和(he)經(jing)營權(quan)分離、政(zheng)府的社會(hui)公共管理(li)職(zhi)能與(yu)國(guo)有(you)資(zi)產出資(zi)人職(zhi)能分開(kai)的原則,完善(shan)經(jing)營性國(guo)有(you)資(zi)產監(jian)管體制機(ji)制,積極探索國(guo)有(you)資(zi)產監(jian)管和(he)運營的有(you)效(xiao)途徑和(he)方式。
(四(si))堅持依法合規(gui)原則,加強分類(lei)指導,突出監督重(zhong)點,增強地方國有資(zi)產監管工(gong)作的規(gui)范性和有效性。
四、重點任務
(一)繼續深化國(guo)(guo)資國(guo)(guo)企改(gai)革(ge)(ge)。要認真(zhen)貫徹(che)落(luo)實(shi)黨的(de)十(shi)(shi)八大、十(shi)(shi)八屆三中全(quan)會(hui)、自治區黨委十(shi)(shi)屆四次(ci)全(quan)會(hui)精神,全(quan)面深化國(guo)(guo)資國(guo)(guo)企改(gai)革(ge)(ge),各市、縣要相應成立深化國(guo)(guo)資國(guo)(guo)企改(gai)革(ge)(ge)領導小組(zu),負責整體統籌推進改(gai)革(ge)(ge)工作,研(yan)究制定相關方案措施,協調(diao)解(jie)決存在的(de)問題,全(quan)力做好本級政(zheng)府深化國(guo)(guo)資國(guo)(guo)企改(gai)革(ge)(ge)工作。
(二)健全完善國(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)管(guan)(guan)組織(zhi)體(ti)系。市(shi)、縣政(zheng)府要進一步加強國(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)管(guan)(guan)機構(gou)建設(she),堅(jian)持(chi)市(shi)級國(guo)(guo)(guo)資(zi)委政(zheng)府直(zhi)屬特設(she)機構(gou)性(xing)質不變,明(ming)確(que)縣級國(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)管(guan)(guan)責任主體(ti),積(ji)極(ji)探索符合改(gai)革要求和本地實際的國(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)管(guan)(guan)有(you)效方(fang)式和途徑,努力實現經營(ying)性(xing)國(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)管(guan)(guan)和明(ming)確(que)縣級國(guo)(guo)(guo)資(zi)監(jian)(jian)管(guan)(guan)責任主體(ti)的“全覆蓋”。
(三)健(jian)全完(wan)善(shan)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)管(guan)制(zhi)(zhi)度(du)體(ti)系。市、縣國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)管(guan)機構要依據《中(zhong)華人民共和(he)國(guo)(guo)(guo)企業國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產法(fa)》和(he)《企業國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)督(du)管(guan)理(li)暫行(xing)條例》,在國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產出(chu)資(zi)(zi)人制(zhi)(zhi)度(du)、國(guo)(guo)(guo)家(jia)出(chu)資(zi)(zi)企業制(zhi)(zhi)度(du)和(he)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產統一監(jian)管(guan)制(zhi)(zhi)度(du)三大制(zhi)(zhi)度(du)框架下,健(jian)全完(wan)善(shan)本地區具(ju)體(ti)規章制(zhi)(zhi)度(du),形(xing)成監(jian)督(du)有(you)(you)力(li)、管(guan)理(li)科學、運作高(gao)效的國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)管(guan)制(zhi)(zhi)度(du)體(ti)系。要切(qie)實(shi)加強(qiang)(qiang)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)管(guan)法(fa)律、行(xing)政法(fa)規和(he)規章的執行(xing)力(li)度(du),強(qiang)(qiang)化監(jian)督(du)檢(jian)查,確保各(ge)項制(zhi)(zhi)度(du)落實(shi)到位(wei)。
(四(si))健全(quan)完(wan)善(shan)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)工(gong)作(zuo)(zuo)體系。市、縣國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)機(ji)構要深入探索國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)工(gong)作(zuo)(zuo)規律(lv),進一(yi)步充實(shi)完(wan)善(shan)以發(fa)展(zhan)戰略制(zhi)定(ding)、主業核(he)定(ding)、業績考核(he)、薪酬(chou)分(fen)配、企業領導(dao)人員任(ren)(聘(pin))免、財(cai)務監(jian)督(du)與(yu)評價、產(chan)(chan)(chan)權管(guan)(guan)(guan)理(li)、監(jian)事會監(jian)督(du)、風險(xian)管(guan)(guan)(guan)控等為主線的(de)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)工(gong)作(zuo)(zuo)閉環,加(jia)快健全(quan)全(quan)區規則統一(yi)、分(fen)類分(fen)層、權責明(ming)確(que)、運轉高效和規范透明(ming)的(de)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)工(gong)作(zuo)(zuo)體系。建立完(wan)善(shan)經(jing)營性(xing)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)集中統一(yi)監(jian)管(guan)(guan)(guan)制(zhi)度,推進全(quan)面實(shi)現政(zheng)企分(fen)開(kai)、政(zheng)資(zi)分(fen)開(kai)。根據基礎支撐、戰略引導(dao)、公益(yi)產(chan)(chan)(chan)品和服務、一(yi)般(ban)競爭性(xing)領域(yu)等不同功(gong)能定(ding)位(wei),探索實(shi)行國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)分(fen)類監(jian)管(guan)(guan)(guan),提高國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)(guan)的(de)針(zhen)對性(xing)有(you)(you)效性(xing),全(quan)面落實(shi)國(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)保值(zhi)增值(zhi)責任(ren)。
(五)健全完(wan)善指(zhi)(zhi)(zhi)導監(jian)(jian)督(du)工作(zuo)機(ji)制。自治區和(he)市(shi)級國(guo)(guo)(guo)有資(zi)(zi)產監(jian)(jian)管(guan)機(ji)構(gou)要嚴(yan)格按照《地方(fang)國(guo)(guo)(guo)有資(zi)(zi)產監(jian)(jian)管(guan)工作(zuo)指(zhi)(zhi)(zhi)導監(jian)(jian)督(du)辦法》(國(guo)(guo)(guo)務院國(guo)(guo)(guo)資(zi)(zi)委令(ling)第25號)的(de)(de)(de)(de)規(gui)定,進一步明確指(zhi)(zhi)(zhi)導監(jian)(jian)督(du)工作(zuo)的(de)(de)(de)(de)主要職(zhi)責(ze)和(he)要求,充分發(fa)揮好指(zhi)(zhi)(zhi)導監(jian)(jian)督(du)工作(zuo)的(de)(de)(de)(de)引導、規(gui)范、提高和(he)促進作(zuo)用(yong)。要加快(kuai)完(wan)善上下(xia)聯動(dong)、規(gui)范有序、全面(mian)覆蓋的(de)(de)(de)(de)指(zhi)(zhi)(zhi)導監(jian)(jian)督(du)工作(zuo)機(ji)制,始終堅持指(zhi)(zhi)(zhi)導寓于服務之中,把指(zhi)(zhi)(zhi)導監(jian)(jian)督(du)下(xia)級國(guo)(guo)(guo)有資(zi)(zi)產監(jian)(jian)管(guan)工作(zuo)的(de)(de)(de)(de)重(zhong)點(dian)放在加強(qiang)監(jian)(jian)管(guan)機(ji)構(gou)建設(she)與提高監(jian)(jian)管(guan)機(ji)構(gou)依法履職(zhi)的(de)(de)(de)(de)能力和(he)水平、指(zhi)(zhi)(zhi)導地方(fang)國(guo)(guo)(guo)有經濟布局結構(gou)調(diao)整、指(zhi)(zhi)(zhi)導和(he)支持國(guo)(guo)(guo)有企業改革發(fa)展、加強(qiang)國(guo)(guo)(guo)有資(zi)(zi)產基礎管(guan)理等(deng)重(zhong)點(dian)環節上,確保指(zhi)(zhi)(zhi)導監(jian)(jian)督(du)及時有效。
五、主要措施
(一)切(qie)實(shi)加強(qiang)(qiang)組織領導(dao)。市(shi)、縣(xian)政府要高(gao)度重視國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)(zuo),充(chong)分認識在新形(xing)勢下(xia)加強(qiang)(qiang)和(he)(he)完善國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)(zuo)的(de)重要意義,為(wei)開(kai)展監(jian)(jian)管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)(zuo)創造(zao)必(bi)要條(tiao)(tiao)件。市(shi)、縣(xian)國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管(guan)(guan)(guan)機(ji)構要把加強(qiang)(qiang)國(guo)資(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)(zuo)列入(ru)(ru)重要議事日程,研究制訂切(qie)實(shi)可行的(de)工(gong)(gong)作(zuo)(zuo)(zuo)計(ji)劃(hua)和(he)(he)實(shi)施方案,落實(shi)工(gong)(gong)作(zuo)(zuo)(zuo)職責,加強(qiang)(qiang)督(du)促檢(jian)查。條(tiao)(tiao)件成(cheng)熟的(de)市(shi)可將對縣(xian)級國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)(zuo)列入(ru)(ru)政府績效(xiao)考評范圍。
(二)進一(yi)步明(ming)確(que)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)責任主(zhu)體。市、縣(xian)政府要(yao)建立和完善本級(ji)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)機構(gou),做到機構(gou)、人員、職能(neng)、責任“四到位(wei)”。國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)數量較大(da)、具(ju)備(bei)條件的縣(xian)應設立獨立的國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)機構(gou),暫不具(ju)備(bei)設立獨立監(jian)管(guan)(guan)(guan)機構(gou)的縣(xian)應明(ming)確(que)一(yi)個履(lv)行(xing)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)職責的部(bu)門(men)或(huo)組建國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)經營管(guan)(guan)(guan)理公司授權統(tong)一(yi)監(jian)管(guan)(guan)(guan)。要(yao)認真落實以(yi)管(guan)(guan)(guan)資(zi)本為主(zhu)加強(qiang)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)的要(yao)求,調整優化國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)職能(neng),突出履(lv)行(xing)出資(zi)人職責的重點(dian)環節(jie),做到監(jian)管(guan)(guan)(guan)不缺位(wei)、不錯(cuo)位(wei)、不越位(wei)。
(三)推動經營(ying)性國(guo)有(you)資(zi)產(chan)(chan)集中統一監管。要切(qie)實轉變(bian)政(zheng)府職能,加快政(zheng)企(qi)分開步伐,對仍由(you)黨政(zheng)機(ji)關(guan)管理的(de)企(qi)業和經營(ying)性資(zi)產(chan)(chan)要制定分離(li)脫鉤方案和時間表,盡(jin)快納入國(guo)有(you)資(zi)產(chan)(chan)監管機(ji)構實行(xing)統一監管。支持按照出資(zi)關(guan)系對地方金融、文化等領域(yu)經營(ying)性國(guo)有(you)資(zi)產(chan)(chan)實行(xing)專(zhuan)業或授權(quan)監管。
(四)執行重大事(shi)項報(bao)告(gao)制度。市、縣國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)管(guan)(guan)機構(gou)要定期向(xiang)本級(ji)黨委、政(zheng)府(fu)匯報(bao)本地區(qu)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)企改革發(fa)展情(qing)(qing)(qing)況(kuang)以及國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)總(zong)量(liang)、結(jie)構(gou)、變動、收益等匯總(zong)分析情(qing)(qing)(qing)況(kuang),圍繞當(dang)地經濟(ji)社會發(fa)展大局(ju)和國(guo)(guo)(guo)(guo)有(you)(you)(you)經濟(ji)改革發(fa)展狀(zhuang)況(kuang),提出(chu)相關意見(jian)建(jian)議。下級(ji)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)機構(gou)要將(jiang)本地區(qu)國(guo)(guo)(guo)(guo)有(you)(you)(you)經濟(ji)運行情(qing)(qing)(qing)況(kuang)以及所(suo)出(chu)資(zi)(zi)(zi)企業匯總(zong)月度及年(nian)度財務情(qing)(qing)(qing)況(kuang)向(xiang)上(shang)一級(ji)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)機構(gou)報(bao)告(gao)。下級(ji)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)機構(gou)出(chu)臺(tai)的規(gui)范(fan)性文(wen)件要向(xiang)上(shang)一級(ji)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)機構(gou)報(bao)備。
(五)加強(qiang)指(zhi)導(dao)監(jian)(jian)督(du)工作。根據(ju)逐級指(zhi)導(dao)監(jian)(jian)督(du)的(de)(de)原則(ze),上級國(guo)有資(zi)產(chan)監(jian)(jian)管(guan)機構應當加強(qiang)與(yu)下級政府的(de)(de)溝通協調,加強(qiang)對下級國(guo)有資(zi)產(chan)監(jian)(jian)管(guan)工作的(de)(de)調研(yan)指(zhi)導(dao),加強(qiang)業(ye)務交流和(he)培(pei)訓,及時(shi)總(zong)結(jie)推廣國(guo)有資(zi)產(chan)監(jian)(jian)管(guan)和(he)國(guo)有企業(ye)改革發展(zhan)的(de)(de)典型經(jing)驗,通報開(kai)展(zhan)監(jian)(jian)督(du)檢查情況(kuang)。
(六)加強合作(zuo)交流。要(yao)進一步優(you)化資(zi)(zi)源(yuan)配置,按照市場(chang)經濟(ji)規律,大力(li)推進各級(ji)國(guo)有(you)(you)(you)資(zi)(zi)產(chan)開放性市場(chang)化有(you)(you)(you)效整合、兼并重(zhong)組(zu),實(shi)(shi)現優(you)勢互(hu)補、互(hu)利共贏。要(yao)進一步拓(tuo)寬(kuan)各級(ji)國(guo)有(you)(you)(you)資(zi)(zi)產(chan)監管(guan)機(ji)構(gou)(gou)信(xin)息(xi)交流渠(qu)道,建立(li)健(jian)全國(guo)有(you)(you)(you)資(zi)(zi)產(chan)基礎(chu)管(guan)理信(xin)息(xi)平臺,大力(li)推進信(xin)息(xi)交流工作(zuo)的制(zhi)度化、規范(fan)化,逐步實(shi)(shi)現信(xin)息(xi)互(hu)通,數據(ju)共享。要(yao)積極搭建人才隊(dui)伍培養平臺,健(jian)全完善各級(ji)國(guo)有(you)(you)(you)資(zi)(zi)產(chan)監管(guan)機(ji)構(gou)(gou)之(zhi)間(jian)、國(guo)有(you)(you)(you)資(zi)(zi)產(chan)監管(guan)機(ji)構(gou)(gou)與(yu)監管(guan)企業之(zhi)間(jian)的人員雙(shuang)向(xiang)交流掛職(zhi)制(zhi)度,努力(li)實(shi)(shi)現人才資(zi)(zi)源(yuan)共享。
(七)嚴(yan)格實施監(jian)(jian)督檢查(cha)。各級(ji)國(guo)(guo)(guo)有資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)機構要依(yi)法加強對下級(ji)政府國(guo)(guo)(guo)有資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)工作的監(jian)(jian)督檢查(cha),上級(ji)國(guo)(guo)(guo)有資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)機構發現下級(ji)政府國(guo)(guo)(guo)有資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)工作中存在(zai)與國(guo)(guo)(guo)有資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)法律(lv)、行政法規和國(guo)(guo)(guo)家(jia)方針政策不符情形的,應(ying)當依(yi)法提出糾(jiu)正意(yi)見(jian)或處理建(jian)議。
(八)著力發展(zhan)(zhan)地方國(guo)有(you)優(you)(you)勢(shi)特色(se)企(qi)業。繼續推動(dong)國(guo)有(you)企(qi)業加快轉型升級和調整產業結構,推進(jin)自主創新(xin)、優(you)(you)化內(nei)部資(zi)源(yuan)配置(zhi),大力發展(zhan)(zhan)新(xin)型混合(he)所有(you)制企(qi)業,推動(dong)國(guo)有(you)資(zi)本(ben)、集體資(zi)本(ben)、非公有(you)資(zi)本(ben)相互融合(he)、優(you)(you)勢(shi)互補、共同發展(zhan)(zhan),探索(suo)改組或組建國(guo)有(you)資(zi)本(ben)投資(zi)運營公司,加快打造一批具有(you)競(jing)爭(zheng)力和影響力的(de)地方優(you)(you)勢(shi)特色(se)企(qi)業。
(九)大(da)力加強(qiang)自身(shen)建設。要(yao)大(da)力推動國(guo)有(you)資產(chan)監管機(ji)構專業化(hua)、規范(fan)化(hua)、制度化(hua)建設,切實(shi)改進干部作風,強(qiang)化(hua)大(da)局(ju)意(yi)(yi)(yi)(yi)識、責任意(yi)(yi)(yi)(yi)識、服務意(yi)(yi)(yi)(yi)識、擔當(dang)意(yi)(yi)(yi)(yi)識,提(ti)升履職能力,提(ti)高監管水平。要(yao)依法規范(fan)出資人行權履責的各(ge)項(xiang)活動,重視合(he)法性(xing)、合(he)規性(xing)審查,強(qiang)化(hua)監督機(ji)制,防范(fan)法律風險(xian),全面提(ti)高國(guo)有(you)資產(chan)監管工作規范(fan)化(hua)水平。
