編者(zhe)按:貫徹落(luo)實中共中央(yang)、國務(wu)院印發的《法治(zhi)政府建(jian)(jian)設(she)實施綱要(2015-2020年)》,根(gen)據《國務(wu)院國資委(wei)推(tui)進國資監管法治(zhi)機構建(jian)(jian)設(she)實施方案》,國資委(wei)起草形成了《關于2018年法治(zhi)建(jian)(jian)設(she)工作情況(kuang)的報告(gao)》,已(yi)在國資委(wei)網站發布。現將(jiang)全文(wen)刊登(deng),供參考。

貫徹落(luo)實(shi)(shi)中(zhong)(zhong)共中(zhong)(zhong)央、國務院印發的(de)《法(fa)(fa)治(zhi)政府建設(she)實(shi)(shi)施綱要(yao)(yao)(2015-2020年(nian)(nian))》和中(zhong)(zhong)央全面依法(fa)(fa)治(zhi)國委員會要(yao)(yao)求(qiu),國資委2018年(nian)(nian)法(fa)(fa)治(zhi)建設(she)工作取得積極進展:
2018年(nian),國(guo)(guo)資(zi)委(wei)以習近平(ping)新(xin)時(shi)代中(zhong)(zhong)國(guo)(guo)特色社會主義思想為指導,全(quan)(quan)(quan)面貫徹(che)落實黨的十九(jiu)大和十九(jiu)屆二中(zhong)(zhong)、三中(zhong)(zhong)全(quan)(quan)(quan)會精神,深入(ru)貫徹(che)全(quan)(quan)(quan)面依法(fa)(fa)治(zhi)(zhi)國(guo)(guo)戰(zhan)略部署,認真落實國(guo)(guo)務院關于法(fa)(fa)治(zhi)(zhi)政府建(jian)(jian)設(she)的工作要求,扎(zha)實推進國(guo)(guo)資(zi)監管法(fa)(fa)治(zhi)(zhi)機構(gou)建(jian)(jian)設(she),在依法(fa)(fa)全(quan)(quan)(quan)面履(lv)職、完善法(fa)(fa)規體系、健全(quan)(quan)(quan)決策(ce)機制、強化(hua)權力(li)監督、有效(xiao)化(hua)解矛盾(dun)、開展法(fa)(fa)治(zhi)(zhi)宣傳、促進依法(fa)(fa)治(zhi)(zhi)企等方面取得積極成效(xiao),國(guo)(guo)資(zi)國(guo)(guo)企法(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)邁出新(xin)步伐。
一、切實加強對法治建設的領導和頂層制度設計
一(yi)(yi)是(shi)深(shen)入學(xue)(xue)(xue)習(xi)(xi)(xi)貫徹(che)(che)習(xi)(xi)(xi)近(jin)平總(zong)(zong)書(shu)(shu)(shu)記(ji)(ji)全(quan)(quan)(quan)(quan)面(mian)(mian)依法(fa)(fa)(fa)(fa)(fa)治(zhi)國(guo)(guo)新(xin)理念新(xin)思想新(xin)戰略。習(xi)(xi)(xi)近(jin)平總(zong)(zong)書(shu)(shu)(shu)記(ji)(ji)在中(zhong)(zhong)(zhong)央(yang)(yang)(yang)全(quan)(quan)(quan)(quan)面(mian)(mian)依法(fa)(fa)(fa)(fa)(fa)治(zhi)國(guo)(guo)委(wei)(wei)(wei)員會(hui)(hui)(hui)(hui)第一(yi)(yi)次(ci)會(hui)(hui)(hui)(hui)議上強(qiang)調(diao),要(yao)加強(qiang)黨(dang)對全(quan)(quan)(quan)(quan)面(mian)(mian)依法(fa)(fa)(fa)(fa)(fa)治(zhi)國(guo)(guo)的(de)領導,更(geng)好發揮法(fa)(fa)(fa)(fa)(fa)治(zhi)固根(gen)本穩預(yu)期利長遠(yuan)的(de)保(bao)障(zhang)作(zuo)用。黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)專(zhuan)(zhuan)題組織學(xue)(xue)(xue)習(xi)(xi)(xi),深(shen)刻(ke)領會(hui)(hui)(hui)(hui)習(xi)(xi)(xi)近(jin)平總(zong)(zong)書(shu)(shu)(shu)記(ji)(ji)重要(yao)講話精神,研(yan)究(jiu)推進國(guo)(guo)資(zi)國(guo)(guo)企(qi)法(fa)(fa)(fa)(fa)(fa)治(zhi)建設(she)的(de)貫徹(che)(che)落實措施,并將有關學(xue)(xue)(xue)習(xi)(xi)(xi)情況向(xiang)中(zhong)(zhong)(zhong)央(yang)(yang)(yang)全(quan)(quan)(quan)(quan)面(mian)(mian)依法(fa)(fa)(fa)(fa)(fa)治(zhi)國(guo)(guo)委(wei)(wei)(wei)員會(hui)(hui)(hui)(hui)辦(ban)公室報告。黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)傳(chuan)達學(xue)(xue)(xue)習(xi)(xi)(xi)2018年中(zhong)(zhong)(zhong)央(yang)(yang)(yang)政(zheng)(zheng)法(fa)(fa)(fa)(fa)(fa)工(gong)(gong)(gong)(gong)作(zuo)會(hui)(hui)(hui)(hui)議精神,原原本本地學(xue)(xue)(xue)習(xi)(xi)(xi)了習(xi)(xi)(xi)近(jin)平總(zong)(zong)書(shu)(shu)(shu)記(ji)(ji)關于政(zheng)(zheng)法(fa)(fa)(fa)(fa)(fa)工(gong)(gong)(gong)(gong)作(zuo)的(de)重要(yao)指示(shi),研(yan)究(jiu)了下一(yi)(yi)步(bu)貫徹(che)(che)落實的(de)工(gong)(gong)(gong)(gong)作(zuo)安排。二是(shi)組織開展憲(xian)法(fa)(fa)(fa)(fa)(fa)學(xue)(xue)(xue)習(xi)(xi)(xi)宣(xuan)貫活動。先后召開3次(ci)黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)議,深(shen)入學(xue)(xue)(xue)習(xi)(xi)(xi)習(xi)(xi)(xi)近(jin)平總(zong)(zong)書(shu)(shu)(shu)記(ji)(ji)在十九屆二中(zhong)(zhong)(zhong)全(quan)(quan)(quan)(quan)會(hui)(hui)(hui)(hui)上的(de)重要(yao)講話精神,認真(zhen)學(xue)(xue)(xue)習(xi)(xi)(xi)憲(xian)法(fa)(fa)(fa)(fa)(fa)修正案(an)。組織召開國(guo)(guo)資(zi)委(wei)(wei)(wei)系統深(shen)入學(xue)(xue)(xue)習(xi)(xi)(xi)宣(xuan)傳(chuan)和貫徹(che)(che)實施憲(xian)法(fa)(fa)(fa)(fa)(fa)動員部署(shu)視頻會(hui)(hui)(hui)(hui),全(quan)(quan)(quan)(quan)面(mian)(mian)布置國(guo)(guo)資(zi)委(wei)(wei)(wei)系統學(xue)(xue)(xue)習(xi)(xi)(xi)宣(xuan)貫工(gong)(gong)(gong)(gong)作(zuo)。邀(yao)請專(zhuan)(zhuan)家在黨(dang)委(wei)(wei)(wei)中(zhong)(zhong)(zhong)心(xin)組集(ji)體學(xue)(xue)(xue)習(xi)(xi)(xi)和委(wei)(wei)(wei)機(ji)關法(fa)(fa)(fa)(fa)(fa)治(zhi)建設(she)培訓班上作(zuo)憲(xian)法(fa)(fa)(fa)(fa)(fa)專(zhuan)(zhuan)題講座(zuo),進一(yi)(yi)步(bu)弘揚憲(xian)法(fa)(fa)(fa)(fa)(fa)精神、增強(qiang)憲(xian)法(fa)(fa)(fa)(fa)(fa)意識。三是(shi)強(qiang)化(hua)制度(du)設(she)計。黨(dang)政(zheng)(zheng)主要(yao)負(fu)責(ze)(ze)(ze)同志(zhi)切實履行推進法(fa)(fa)(fa)(fa)(fa)治(zhi)建設(she)第一(yi)(yi)責(ze)(ze)(ze)任(ren)(ren)人職責(ze)(ze)(ze),深(shen)入研(yan)究(jiu)謀劃(hua)國(guo)(guo)資(zi)國(guo)(guo)企(qi)法(fa)(fa)(fa)(fa)(fa)治(zhi)建設(she)年度(du)工(gong)(gong)(gong)(gong)作(zuo)任(ren)(ren)務,并納入《國(guo)(guo)資(zi)委(wei)(wei)(wei)2018年工(gong)(gong)(gong)(gong)作(zuo)要(yao)點(dian)》,確(que)保(bao)法(fa)(fa)(fa)(fa)(fa)治(zhi)建設(she)與其他重點(dian)工(gong)(gong)(gong)(gong)作(zuo)同部署(shu)、同推進、同督(du)促。委(wei)(wei)(wei)黨(dang)委(wei)(wei)(wei)會(hui)(hui)(hui)(hui)、委(wei)(wei)(wei)主任(ren)(ren)辦(ban)公會(hui)(hui)(hui)(hui)全(quan)(quan)(quan)(quan)年研(yan)究(jiu)討論法(fa)(fa)(fa)(fa)(fa)治(zhi)工(gong)(gong)(gong)(gong)作(zuo)35次(ci),制定修訂《中(zhong)(zhong)(zhong)央(yang)(yang)(yang)企(qi)業違規經營投資(zi)責(ze)(ze)(ze)任(ren)(ren)追究(jiu)實施辦(ban)法(fa)(fa)(fa)(fa)(fa)(試行)》《國(guo)(guo)資(zi)委(wei)(wei)(wei)立法(fa)(fa)(fa)(fa)(fa)工(gong)(gong)(gong)(gong)作(zuo)規則》等文(wen)件,為國(guo)(guo)資(zi)國(guo)(guo)企(qi)法(fa)(fa)(fa)(fa)(fa)治(zhi)建設(she)提(ti)供制度(du)支撐和保(bao)障(zhang)。
二、依法推進國資監管職能轉變
一(yi)是(shi)(shi)進(jin)(jin)(jin)一(yi)步(bu)厘清權(quan)責(ze)(ze)邊界。根據《國(guo)(guo)務(wu)院(yuan)辦公(gong)廳關于轉(zhuan)(zhuan)發國(guo)(guo)務(wu)院(yuan)國(guo)(guo)資(zi)(zi)委以管(guan)(guan)(guan)資(zi)(zi)本(ben)為主推進(jin)(jin)(jin)職(zhi)(zhi)能轉(zhuan)(zhuan)變方案的通知》,研究制(zhi)定出(chu)資(zi)(zi)人監(jian)(jian)(jian)管(guan)(guan)(guan)權(quan)力(li)和(he)責(ze)(ze)任(ren)(ren)(ren)清單,明確(que)了(le)規(gui)劃(hua)(hua)與(yu)投(tou)資(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)、資(zi)(zi)本(ben)運(yun)營與(yu)收益管(guan)(guan)(guan)理、改革改組等9大類36項(xiang)權(quan)責(ze)(ze)事(shi)(shi)項(xiang),依(yi)法(fa)(fa)明確(que)國(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)職(zhi)(zhi)責(ze)(ze)范圍,嚴格規(gui)范履職(zhi)(zhi)方式和(he)流程。二是(shi)(shi)突(tu)出(chu)“放(fang)管(guan)(guan)(guan)結合”。制(zhi)定《上市公(gong)司國(guo)(guo)有(you)股權(quan)監(jian)(jian)(jian)督管(guan)(guan)(guan)理辦法(fa)(fa)》《中(zhong)(zhong)央企(qi)(qi)業(ye)(ye)工(gong)(gong)(gong)資(zi)(zi)總額管(guan)(guan)(guan)理辦法(fa)(fa)》,進(jin)(jin)(jin)一(yi)步(bu)精(jing)簡下放(fang)監(jian)(jian)(jian)管(guan)(guan)(guan)事(shi)(shi)項(xiang)、優化監(jian)(jian)(jian)管(guan)(guan)(guan)方式,切(qie)實(shi)增強企(qi)(qi)業(ye)(ye)活力(li)。突(tu)出(chu)管(guan)(guan)(guan)資(zi)(zi)本(ben)重點(dian)職(zhi)(zhi)能,強化投(tou)資(zi)(zi)規(gui)劃(hua)(hua)、資(zi)(zi)本(ben)運(yun)作(zuo)(zuo)和(he)考(kao)(kao)核分配監(jian)(jian)(jian)管(guan)(guan)(guan),防止國(guo)(guo)有(you)資(zi)(zi)產流失。研究起草(cao)中(zhong)(zhong)央企(qi)(qi)業(ye)(ye)公(gong)司章程指引、落實(shi)董事(shi)(shi)會職(zhi)(zhi)權(quan)試點(dian)工(gong)(gong)(gong)作(zuo)(zuo)等相(xiang)關文(wen)件(jian),注重通過公(gong)司法(fa)(fa)人治理結構依(yi)法(fa)(fa)履行(xing)出(chu)資(zi)(zi)人職(zhi)(zhi)責(ze)(ze)。三是(shi)(shi)強化責(ze)(ze)任(ren)(ren)(ren)追究。制(zhi)定企(qi)(qi)業(ye)(ye)違規(gui)經(jing)營投(tou)資(zi)(zi)責(ze)(ze)任(ren)(ren)(ren)追究辦法(fa)(fa),推動中(zhong)(zhong)央企(qi)(qi)業(ye)(ye)建立(li)相(xiang)關制(zhi)度(du)和(he)工(gong)(gong)(gong)作(zuo)(zuo)體系。深(shen)入開展國(guo)(guo)有(you)資(zi)(zi)產重大損失調查及違規(gui)責(ze)(ze)任(ren)(ren)(ren)追究。四是(shi)(shi)運(yun)用(yong)信息化手段加強事(shi)(shi)中(zhong)(zhong)事(shi)(shi)后監(jian)(jian)(jian)管(guan)(guan)(guan)。初(chu)步(bu)建成國(guo)(guo)資(zi)(zi)國(guo)(guo)企(qi)(qi)在線(xian)監(jian)(jian)(jian)管(guan)(guan)(guan)系統(tong),對(dui)中(zhong)(zhong)央企(qi)(qi)業(ye)(ye)集團層面“三重一(yi)大”事(shi)(shi)項(xiang)決策(ce)制(zhi)度(du)、規(gui)則、清單、程序實(shi)現實(shi)時在線(xian)監(jian)(jian)(jian)管(guan)(guan)(guan),投(tou)資(zi)(zi)、考(kao)(kao)核分配等工(gong)(gong)(gong)作(zuo)(zuo)初(chu)步(bu)實(shi)現動態(tai)監(jian)(jian)(jian)測與(yu)展示,國(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)效能進(jin)(jin)(jin)一(yi)步(bu)提升(sheng)。
三、完善國資監管法規制度體系
一是加強重點領(ling)域國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)管(guan)(guan)立(li)(li)法(fa)(fa)(fa)。圍(wei)繞國(guo)(guo)(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)(guo)(guo)企改(gai)革發(fa)展中心(xin)工(gong)作,編制(zhi)(zhi)(zhi)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)2018年立(li)(li)法(fa)(fa)(fa)工(gong)作計劃(hua),列入(ru)立(li)(li)法(fa)(fa)(fa)項目(mu)(mu)21項。全(quan)(quan)年出(chu)臺《關(guan)于(yu)中央企業規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)實施企業年金的意(yi)見》等規(gui)(gui)(gui)(gui)(gui)章規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)14件(jian)(jian)。截至目(mu)(mu)前(qian),國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)現行(xing)(xing)(xing)(xing)有(you)(you)效規(gui)(gui)(gui)(gui)(gui)章27件(jian)(jian)、規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)209件(jian)(jian),系(xi)統(tong)完備(bei)(bei)、科學有(you)(you)效的國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)管(guan)(guan)法(fa)(fa)(fa)規(gui)(gui)(gui)(gui)(gui)制(zhi)(zhi)(zhi)度體系(xi)基本形成。二是嚴(yan)格(ge)規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)規(gui)(gui)(gui)(gui)(gui)章規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)制(zhi)(zhi)(zhi)定(ding)(ding)程序(xu)。根(gen)據(ju)《行(xing)(xing)(xing)(xing)政法(fa)(fa)(fa)規(gui)(gui)(gui)(gui)(gui)制(zhi)(zhi)(zhi)定(ding)(ding)程序(xu)條(tiao)例(li)》和(he)《規(gui)(gui)(gui)(gui)(gui)章制(zhi)(zhi)(zhi)定(ding)(ding)程序(xu)條(tiao)例(li)》,修訂(ding)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)立(li)(li)法(fa)(fa)(fa)工(gong)作規(gui)(gui)(gui)(gui)(gui)則,強化(hua)黨對立(li)(li)法(fa)(fa)(fa)工(gong)作的領(ling)導(dao),細化(hua)公開(kai)征集項目(mu)(mu)建議、完善(shan)溝通協商(shang)機(ji)制(zhi)(zhi)(zhi)、開(kai)展評估等環節,提高立(li)(li)法(fa)(fa)(fa)工(gong)作質量。印(yin)發(fa)《關(guan)于(yu)貫徹落實〈國(guo)(guo)(guo)(guo)(guo)務院辦(ban)公廳關(guan)于(yu)加強行(xing)(xing)(xing)(xing)政規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)制(zhi)(zhi)(zhi)定(ding)(ding)和(he)監(jian)(jian)督管(guan)(guan)理工(gong)作的通知(zhi)〉的通知(zhi)》,對嚴(yan)控發(fa)文(wen)(wen)數量、嚴(yan)格(ge)發(fa)文(wen)(wen)程序(xu)、加強合(he)法(fa)(fa)(fa)性(xing)審(shen)核(he)等提出(chu)明(ming)確要(yao)(yao)求。全(quan)(quan)年開(kai)展規(gui)(gui)(gui)(gui)(gui)章規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)法(fa)(fa)(fa)律審(shen)核(he)48件(jian)(jian)次,實行(xing)(xing)(xing)(xing)規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)統(tong)一登記(ji)、統(tong)一編號、統(tong)一印(yin)發(fa)。三是持續開(kai)展規(gui)(gui)(gui)(gui)(gui)章規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)清(qing)理工(gong)作。按(an)照黨中央、國(guo)(guo)(guo)(guo)(guo)務院要(yao)(yao)求,開(kai)展涉(she)黨和(he)國(guo)(guo)(guo)(guo)(guo)家機(ji)構改(gai)革的規(gui)(gui)(gui)(gui)(gui)章規(gui)(gui)(gui)(gui)(gui)范(fan)(fan)(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)專項清(qing)理,同時對不適應國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)管(guan)(guan)新(xin)要(yao)(yao)求的文(wen)(wen)件(jian)(jian)一并清(qing)理,共廢止失效15件(jian)(jian),文(wen)(wen)件(jian)(jian)清(qing)理長效機(ji)制(zhi)(zhi)(zhi)初步(bu)建立(li)(li)。四是積(ji)極參(can)與國(guo)(guo)(guo)(guo)(guo)家重點立(li)(li)法(fa)(fa)(fa)。開(kai)展《公司(si)法(fa)(fa)(fa)》修改(gai)問(wen)題研究,配合(he)做好《企業國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產監(jian)(jian)督管(guan)(guan)理暫行(xing)(xing)(xing)(xing)條(tiao)例(li)》修改(gai)工(gong)作。在《審(shen)計法(fa)(fa)(fa)》《資(zi)源稅法(fa)(fa)(fa)》《中央儲(chu)備(bei)(bei)糧管(guan)(guan)理條(tiao)例(li)》等法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)(gui)(gui)(gui)(gui)制(zhi)(zhi)(zhi)修訂(ding)過程中,充分(fen)反映相(xiang)關(guan)意(yi)見建議。
四、推進決策科學化、民主化、法治化
一是(shi)落(luo)實依(yi)法(fa)(fa)決(jue)(jue)(jue)策(ce)機(ji)制(zhi)(zhi)。健(jian)全(quan)(quan)國資委(wei)(wei)工作(zuo)規(gui)(gui)則(ze),全(quan)(quan)年共召開(kai)63次黨委(wei)(wei)會(hui)、主(zhu)任辦公(gong)(gong)會(hui)研究重(zhong)大事項(xiang),嚴格落(luo)實集體領導、民(min)主(zhu)集中(zhong)、會(hui)議決(jue)(jue)(jue)定(ding)的(de)決(jue)(jue)(jue)策(ce)機(ji)制(zhi)(zhi),確(que)保作(zuo)出各項(xiang)決(jue)(jue)(jue)策(ce)程(cheng)序規(gui)(gui)范、科學有(you)效(xiao)。二是(shi)加強重(zhong)大決(jue)(jue)(jue)策(ce)合法(fa)(fa)性(xing)(xing)審查。健(jian)全(quan)(quan)國資委(wei)(wei)重(zhong)大決(jue)(jue)(jue)策(ce)合法(fa)(fa)性(xing)(xing)審查機(ji)制(zhi)(zhi),明確(que)決(jue)(jue)(jue)策(ce)方(fang)(fang)(fang)案需包含法(fa)(fa)律(lv)法(fa)(fa)規(gui)(gui)政策(ce)依(yi)據、履行(xing)(xing)法(fa)(fa)定(ding)程(cheng)序等情況(kuang)。充分發揮法(fa)(fa)律(lv)顧問和(he)公(gong)(gong)職律(lv)師作(zuo)用,全(quan)(quan)年對中(zhong)央(yang)企業章程(cheng)、改制(zhi)(zhi)重(zhong)組方(fang)(fang)(fang)案以及(ji)國有(you)資本投資、運營公(gong)(gong)司試點等決(jue)(jue)(jue)策(ce)事項(xiang)進行(xing)(xing)法(fa)(fa)律(lv)論證(zheng)把關。三是(shi)建(jian)立健(jian)全(quan)(quan)公(gong)(gong)平競(jing)爭審查機(ji)制(zhi)(zhi)。落(luo)實國務院關于建(jian)立公(gong)(gong)平競(jing)爭審查制(zhi)(zhi)度(du)的(de)要求,從(cong)市場(chang)準入(ru)、商品和(he)要素自由流動等方(fang)(fang)(fang)面對政策(ce)措施深入(ru)開(kai)展審查,同時組織公(gong)(gong)平競(jing)爭專項(xiang)清理,確(que)保監(jian)管行(xing)(xing)為(wei)依(yi)法(fa)(fa)合規(gui)(gui)。
五、強化對權力的制約和監督
一(yi)(yi)(yi)是健(jian)全(quan)常(chang)態化(hua)、長(chang)效化(hua)的(de)(de)(de)(de)監(jian)(jian)督(du)制度(du)。根據(ju)《各(ge)廳(ting)局職(zhi)能及主(zhu)(zhu)(zhu)要(yao)工(gong)作(zuo)(zuo)事(shi)項(xiang)(試行)》,完(wan)善《國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)機關(guan)(guan)職(zhi)責分(fen)解一(yi)(yi)(yi)覽表(biao)》,進(jin)一(yi)(yi)(yi)步明確工(gong)作(zuo)(zuo)職(zhi)責和程序,優化(hua)履職(zhi)方(fang)式(shi)。出臺《關(guan)(guan)于規(gui)(gui)范國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)機關(guan)(guan)工(gong)作(zuo)(zuo)人(ren)員與中(zhong)央(yang)企業(ye)往來行為的(de)(de)(de)(de)規(gui)(gui)定》,對(dui)依法合規(gui)(gui)行權(quan)履職(zhi)提(ti)(ti)出具(ju)體(ti)要(yao)求(qiu),推(tui)(tui)動(dong)構建與中(zhong)央(yang)企業(ye)“親”“清”健(jian)康的(de)(de)(de)(de)工(gong)作(zuo)(zuo)關(guan)(guan)系。按照(zhao)《關(guan)(guan)于合理(li)確定并嚴格規(gui)(gui)范中(zhong)央(yang)企業(ye)負責人(ren)履職(zhi)待(dai)遇、業(ye)務支出的(de)(de)(de)(de)意見》有關(guan)(guan)規(gui)(gui)定,結(jie)合巡視(shi)、審(shen)(shen)計(ji)(ji)、紀檢(jian)監(jian)(jian)察發現的(de)(de)(de)(de)突(tu)出問題,進(jin)一(yi)(yi)(yi)步健(jian)全(quan)相(xiang)關(guan)(guan)制度(du)規(gui)(gui)范。二是自覺接受黨內(nei)監(jian)(jian)督(du)和審(shen)(shen)計(ji)(ji)監(jian)(jian)督(du)。組(zu)織召開(kai)(kai)(kai)國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)直屬機關(guan)(guan)警(jing)示教育(yu)大(da)會,深(shen)入剖析中(zhong)央(yang)第一(yi)(yi)(yi)輪(lun)巡視(shi)國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)發現的(de)(de)(de)(de)突(tu)出問題,以典型案件為反(fan)面(mian)教材,教育(yu)引導廣大(da)黨員干(gan)部深(shen)刻反(fan)思、引以為戒。配合審(shen)(shen)計(ji)(ji)署(shu)對(dui)國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)開(kai)(kai)(kai)展2017年(nian)預算執行等情況(kuang)審(shen)(shen)計(ji)(ji)以及相(xiang)關(guan)(guan)專項(xiang)審(shen)(shen)計(ji)(ji),積極提(ti)(ti)供材料、主(zhu)(zhu)(zhu)動(dong)說明情況(kuang)、全(quan)力整改問題。三是全(quan)面(mian)推(tui)(tui)進(jin)陽光(guang)監(jian)(jian)管。編制《國(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)主(zhu)(zhu)(zhu)動(dong)公開(kai)(kai)(kai)基本(ben)目錄》,包(bao)括(kuo)7類30項(xiang)具(ju)體(ti)公開(kai)(kai)(kai)事(shi)項(xiang),同(tong)時明確了公開(kai)(kai)(kai)時限和公開(kai)(kai)(kai)方(fang)式(shi)。通過公告、新(xin)聞發布會、官方(fang)網站、微信公眾號(hao)等多(duo)種(zhong)渠道(dao)主(zhu)(zhu)(zhu)動(dong)發布國(guo)(guo)(guo)資(zi)(zi)國(guo)(guo)(guo)企權(quan)威信息(xi),包(bao)括(kuo)國(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)管規(gui)(gui)章規(gui)(gui)范性文(wen)件、中(zhong)央(yang)企業(ye)經(jing)濟(ji)運行情況(kuang)、監(jian)(jian)督(du)檢(jian)查結(jie)果等。
六、依法有效化解矛盾糾紛
一(yi)是妥(tuo)善應對(dui)(dui)機關涉訴案(an)件。認真辦(ban)(ban)(ban)理(li)(li)行(xing)(xing)(xing)政復(fu)(fu)議(yi)、行(xing)(xing)(xing)政訴訟(song)案(an)件,就國(guo)資委涉行(xing)(xing)(xing)政訴訟(song)案(an)有關定性問(wen)題,主(zhu)動與最高(gao)法院(yuan)(yuan)溝通(tong)協調,最高(gao)法院(yuan)(yuan)明確不(bu)(bu)(bu)受理(li)(li)以(yi)行(xing)(xing)(xing)政復(fu)(fu)議(yi)為(wei)由對(dui)(dui)國(guo)資委提起的(de)行(xing)(xing)(xing)政訴訟(song)。二是立(li)足源頭(tou)治(zhi)理(li)(li)加強維穩工(gong)作(zuo)。對(dui)(dui)于企(qi)(qi)業(ye)改制(zhi)、廠辦(ban)(ban)(ban)大(da)集體改革、分(fen)離企(qi)(qi)業(ye)辦(ban)(ban)(ban)社(she)會(hui)等可能引(yin)發社(she)會(hui)矛(mao)(mao)盾(dun)潛在風(feng)險(xian)的(de)國(guo)企(qi)(qi)改革事(shi)項,加強業(ye)務(wu)(wu)工(gong)作(zuo)與維穩工(gong)作(zuo)的(de)結合,將(jiang)推(tui)進(jin)改革與確保穩定同謀(mou)劃、同部(bu)署、同落實,從源頭(tou)上把控風(feng)險(xian)。組織中(zhong)央(yang)(yang)企(qi)(qi)業(ye)開展矛(mao)(mao)盾(dun)糾(jiu)(jiu)紛排查化(hua)解(jie),對(dui)(dui)排查出的(de)不(bu)(bu)(bu)穩定問(wen)題建立(li)風(feng)險(xian)管控臺(tai)賬(zhang),并制(zhi)訂相應化(hua)解(jie)措施(shi)。三(san)是不(bu)(bu)(bu)斷(duan)提升信訪(fang)工(gong)作(zuo)法治(zhi)化(hua)水平(ping)。嚴格執行(xing)(xing)(xing)信訪(fang)條例,全面推(tui)進(jin)訴訪(fang)分(fen)離,運用法治(zhi)思(si)維分(fen)類處理(li)(li)信訪(fang)問(wen)題,引(yin)導信訪(fang)人通(tong)過(guo)司法程序妥(tuo)善解(jie)決矛(mao)(mao)盾(dun)問(wen)題。加強機關接訪(fang)辦(ban)(ban)(ban)信、復(fu)(fu)查復(fu)(fu)核、轉辦(ban)(ban)(ban)督辦(ban)(ban)(ban)等基(ji)礎業(ye)務(wu)(wu)管理(li)(li),進(jin)一(yi)步(bu)優化(hua)網上辦(ban)(ban)(ban)理(li)(li)信訪(fang)的(de)工(gong)作(zuo)流程。四是指導協調中(zhong)央(yang)(yang)企(qi)(qi)業(ye)重大(da)法律(lv)糾(jiu)(jiu)紛案(an)件。印發中(zhong)央(yang)(yang)企(qi)(qi)業(ye)法律(lv)糾(jiu)(jiu)紛案(an)件綜合分(fen)析報告,督促(cu)企(qi)(qi)業(ye)依法妥(tuo)善解(jie)決矛(mao)(mao)盾(dun)糾(jiu)(jiu)紛,及時(shi)化(hua)解(jie)社(she)會(hui)不(bu)(bu)(bu)穩定因素。
七、大力推進“七五”普法工作
一(yi)是(shi)積極開展法(fa)(fa)(fa)治(zhi)(zhi)宣(xuan)傳。制定《國(guo)務院國(guo)資(zi)(zi)委(wei)普(pu)法(fa)(fa)(fa)責(ze)任清(qing)單》,按(an)照“業(ye)務誰主管誰普(pu)法(fa)(fa)(fa)”原則,明確各(ge)廳局責(ze)任。國(guo)資(zi)(zi)國(guo)企(qi)(qi)(qi)重要政策文件出臺(tai)后,通過舉行(xing)新聞發(fa)(fa)布會、媒體通氣(qi)會,組(zu)(zu)織專(zhuan)家(jia)解讀、發(fa)(fa)表專(zhuan)題(ti)文章(zhang)等形式,做好政策宣(xuan)講(jiang)解讀工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)。創建“國(guo)資(zi)(zi)法(fa)(fa)(fa)治(zhi)(zhi)”微信公眾號(hao),定期發(fa)(fa)布中央企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)治(zhi)(zhi)建設(she)信息,加(jia)(jia)強宣(xuan)傳引導。組(zu)(zu)織開展“七五”普(pu)法(fa)(fa)(fa)中期檢查,及時總結工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)情(qing)況上報全國(guo)普(pu)法(fa)(fa)(fa)辦。二是(shi)切實(shi)加(jia)(jia)強系(xi)統內(nei)法(fa)(fa)(fa)治(zhi)(zhi)培(pei)訓。舉辦國(guo)資(zi)(zi)委(wei)機關法(fa)(fa)(fa)治(zhi)(zhi)建設(she)專(zhuan)題(ti)培(pei)訓班(ban),邀請專(zhuan)家(jia)、法(fa)(fa)(fa)官為機關干部(bu)講(jiang)授(shou)公平(ping)競(jing)爭審查、行(xing)政訴(su)(su)訟(song)法(fa)(fa)(fa)和典型(xing)案例。全年(nian)組(zu)(zu)織6期“法(fa)(fa)(fa)治(zhi)(zhi)講(jiang)堂(tang)”,邀請知(zhi)名專(zhuan)家(jia)學(xue)者、律(lv)師進(jin)行(xing)視(shi)頻授(shou)課(ke),國(guo)資(zi)(zi)委(wei)系(xi)統每期參(can)加(jia)(jia)人員近2萬人。深入企(qi)(qi)(qi)業(ye)宣(xuan)貫法(fa)(fa)(fa)治(zhi)(zhi)建設(she)要求,派員參(can)加(jia)(jia)中央企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)治(zhi)(zhi)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)會議、為企(qi)(qi)(qi)業(ye)黨委(wei)(黨組(zu)(zu))中心組(zu)(zu)專(zhuan)題(ti)學(xue)法(fa)(fa)(fa)授(shou)課(ke)70余次。舉辦中央企(qi)(qi)(qi)業(ye)境(jing)外法(fa)(fa)(fa)律(lv)風險防范等4個(ge)(ge)培(pei)訓班(ban),組(zu)(zu)織涉(she)美訴(su)(su)訟(song)應對(dui)法(fa)(fa)(fa)律(lv)事務境(jing)外培(pei)訓,取(qu)得了較好效果。三是(shi)有(you)力(li)促進(jin)共享交(jiao)流。將全部(bu)中央企(qi)(qi)(qi)業(ye)按(an)行(xing)業(ye)、地域分(fen)成12個(ge)(ge)協作(zuo)(zuo)(zuo)(zuo)組(zu)(zu),組(zu)(zu)內(nei)企(qi)(qi)(qi)業(ye)輪流牽頭(tou),圍繞不同主題(ti)定期座談交(jiao)流,全年(nian)各(ge)協作(zuo)(zuo)(zuo)(zuo)組(zu)(zu)共開展活動(dong)34次。不斷充實(shi)中央企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)治(zhi)(zhi)建設(she)優(you)(you)秀案例庫(ku),已發(fa)(fa)布優(you)(you)秀案例200個(ge)(ge),供企(qi)(qi)(qi)業(ye)學(xue)習借鑒。
八、促進中央企業提高依法治企水平
一是督促企(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)治(zhi)建(jian)(jian)設第(di)一責(ze)(ze)任人(ren)(ren)職(zhi)責(ze)(ze)落實(shi)。貫徹中(zhong)(zhong)(zhong)(zhong)央(yang)要求,印發《中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)(qi)(qi)業(ye)主要負(fu)責(ze)(ze)人(ren)(ren)履行推進法(fa)(fa)(fa)治(zhi)建(jian)(jian)設第(di)一責(ze)(ze)任人(ren)(ren)職(zhi)責(ze)(ze)規定》。組織對全(quan)部中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)(qi)(qi)業(ye)貫徹落實(shi)情況進行實(shi)地調研,將第(di)一責(ze)(ze)任人(ren)(ren)職(zhi)責(ze)(ze)細化(hua)為38項(xiang)指(zhi)標,對企(qi)(qi)(qi)業(ye)逐(zhu)一分(fen)析評估,并逐(zhu)一反饋結果,有力(li)促進法(fa)(fa)(fa)治(zhi)央(yang)企(qi)(qi)(qi)建(jian)(jian)設整體水平不斷提(ti)升。二是指(zhi)導中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)(qi)(qi)業(ye)加(jia)強(qiang)風險防范。在先行試點、總結研究(jiu)的基礎上,出臺《中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)(qi)(qi)業(ye)合規管(guan)(guan)理指(zhi)引(試行)》,編(bian)寫(xie)《知(zhi)名跨國公(gong)司合規管(guan)(guan)理典型(xing)案例匯編(bian)》,推動企(qi)(qi)(qi)業(ye)全(quan)面加(jia)強(qiang)風險管(guan)(guan)控(kong),提(ti)升依(yi)法(fa)(fa)(fa)合規經(jing)營管(guan)(guan)理能力(li)。組織企(qi)(qi)(qi)業(ye)全(quan)面開展境外(wai)法(fa)(fa)(fa)律(lv)(lv)(lv)風險排查處(chu)置,全(quan)面梳理企(qi)(qi)(qi)業(ye)海外(wai)經(jing)營5大類20種風險,強(qiang)化(hua)綜合分(fen)析和(he)風險提(ti)示。三是夯實(shi)組織體系和(he)隊伍建(jian)(jian)設。推動企(qi)(qi)(qi)業(ye)建(jian)(jian)立(li)健(jian)全(quan)法(fa)(fa)(fa)治(zhi)工作機構,探索(suo)設立(li)法(fa)(fa)(fa)律(lv)(lv)(lv)服(fu)務中(zhong)(zhong)(zhong)(zhong)心等法(fa)(fa)(fa)律(lv)(lv)(lv)資(zi)源集約化(hua)管(guan)(guan)理模式。指(zhi)導企(qi)(qi)(qi)業(ye)強(qiang)化(hua)法(fa)(fa)(fa)律(lv)(lv)(lv)顧問配備(bei)和(he)隊伍培養,目(mu)前(qian)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)(qi)(qi)業(ye)全(quan)系統(tong)共有法(fa)(fa)(fa)律(lv)(lv)(lv)顧問1.1萬人(ren)(ren)。建(jian)(jian)立(li)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)(qi)(qi)業(ye)金融法(fa)(fa)(fa)律(lv)(lv)(lv)人(ren)(ren)才(cai)庫和(he)涉外(wai)法(fa)(fa)(fa)律(lv)(lv)(lv)人(ren)(ren)才(cai)庫,目(mu)前(qian)入庫專家(jia)193人(ren)(ren)。
習近(jin)平總書記在中央(yang)全面依法治(zhi)(zhi)(zhi)(zhi)國委(wei)員會(hui)(hui)第(di)二次會(hui)(hui)議(yi)上(shang)強(qiang)調(diao),推進全面依法治(zhi)(zhi)(zhi)(zhi)國,要(yao)堅持法治(zhi)(zhi)(zhi)(zhi)國家、法治(zhi)(zhi)(zhi)(zhi)政府、法治(zhi)(zhi)(zhi)(zhi)社會(hui)(hui)一(yi)(yi)體建設(she),法治(zhi)(zhi)(zhi)(zhi)政府建設(she)是重點(dian)任務,對法治(zhi)(zhi)(zhi)(zhi)國家、法治(zhi)(zhi)(zhi)(zhi)社會(hui)(hui)建設(she)具(ju)有示范(fan)帶動作(zuo)用。下一(yi)(yi)步(bu),國資(zi)委(wei)將以習近(jin)平新時代中國特色(se)社會(hui)(hui)主義思想為指(zhi)導,深入貫徹黨的十九大和(he)十九屆二中、三(san)中全會(hui)(hui)精神,落實政府工作(zuo)報(bao)告有關法治(zhi)(zhi)(zhi)(zhi)政府建設(she)要(yao)求,緊緊圍繞國資(zi)國企改革發展中心任務,進一(yi)(yi)步(bu)健(jian)全完善(shan)制度(du)機制,強(qiang)化任務措施督(du)促檢(jian)查(cha),全力打造國資(zi)監管法治(zhi)(zhi)(zhi)(zhi)機構和(he)法治(zhi)(zhi)(zhi)(zhi)央(yang)企,為推動企業實現高質(zhi)量發展、加快培育具(ju)有全球競爭力的世界一(yi)(yi)流(liu)企業提供有力法治(zhi)(zhi)(zhi)(zhi)保障(zhang)。

●國資委政策法規局赴地方開展片區調研
2019年3月中旬(xun),政(zheng)策法規局分(fen)別赴四川、山東、湖北(bei)三個(ge)地方(fang),組織召開了完善國(guo)(guo)有資產管(guan)理(li)體制片區(qu)調研(yan)座談(tan)會,并(bing)深入(ru)實(shi)地調研(yan)了部(bu)分(fen)省屬(shu)重點國(guo)(guo)有企業。全(quan)國(guo)(guo)37個(ge)省級國(guo)(guo)資委(wei)和部(bu)分(fen)地市級國(guo)(guo)資委(wei)有關負責同志、政(zheng)策法規處室負責同志參加了調研(yan)座談(tan)。

為貫徹中央全(quan)面依法治國戰(zhan)略部署,落(luo)實2019年中央企業(ye)法治工(gong)作會(hui)議(yi)要(yao)求,截至4月(yue)(yue)2日,中核集團等35家(jia)中央企業(ye)組織(zhi)召開(kai)了2019年法治工(gong)作會(hui)議(yi),25家(jia)中央企業(ye)計劃于本(ben)月(yue)(yue)組織(zhi)召開(kai)會(hui)議(yi)。
各(ge)中(zhong)央(yang)企(qi)(qi)業(ye)法(fa)治工(gong)作會(hui)議(yi)緊(jin)緊(jin)圍繞法(fa)治央(yang)企(qi)(qi)建(jian)設總目標,在(zai)(zai)持續推進(jin)法(fa)治建(jian)設第一責任(ren)人(ren)職(zhi)責落(luo)實、完善(shan)法(fa)律風險防范機制(zhi)、開展合規管理、提升法(fa)律管理水平(ping)和加強(qiang)法(fa)律人(ren)才隊伍建(jian)設等方面,系統總結本(ben)企(qi)(qi)業(ye)法(fa)治工(gong)作成效(xiao),分析存(cun)在(zai)(zai)的(de)問題,研判形勢,部(bu)署2019年企(qi)(qi)業(ye)法(fa)治工(gong)作重點任(ren)務。中(zhong)央(yang)企(qi)(qi)業(ye)對法(fa)治工(gong)作會(hui)議(yi)給予了高度重視,多家企(qi)(qi)業(ye)主要領導(dao)(dao)出席會(hui)議(yi)并講話,分管領導(dao)(dao)做企(qi)(qi)業(ye)法(fa)治工(gong)作報告,企(qi)(qi)業(ye)總法(fa)律顧問現場述職(zhi),各(ge)部(bu)門領導(dao)(dao)和所屬骨干(gan)企(qi)(qi)業(ye)主要領導(dao)(dao)參會(hui)。會(hui)議(yi)的(de)順利召開,為持續深(shen)入推進(jin)法(fa)治央(yang)企(qi)(qi)建(jian)設,推動企(qi)(qi)業(ye)在(zai)(zai)法(fa)治軌道上深(shen)化改革和高質量發(fa)展奠定了堅實基礎。

2.“全面(mian)依(yi)法治(zhi)國背景下(xia)中央企(qi)業(ye)(ye)加強法治(zhi)工作具(ju)有重要意義,哈(ha)電集(ji)團作為央企(qi)必(bi)須要把依(yi)法治(zhi)企(qi)作為強企(qi)之(zhi)基、興企(qi)之(zhi)本、健企(qi)之(zhi)策,堅(jian)(jian)持(chi)(chi)依(yi)法治(zhi)理(li)、依(yi)法經營(ying)、依(yi)法管(guan)(guan)理(li)共同(tong)推進,堅(jian)(jian)持(chi)(chi)法治(zhi)體系、法治(zhi)能力、法治(zhi)文化一體化建設,全面(mian)提升企(qi)業(ye)(ye)法律管(guan)(guan)理(li)能力,為哈(ha)電集(ji)團“12348”發(fa)展(zhan)戰略提供堅(jian)(jian)強的法律支撐(cheng)。”

●中央企業法治工作重點措施
1.東航(hang)集(ji)團(tuan):為保證合規經營,提升旅客信息保護水平,東航(hang)集(ji)團(tuan)制定下(xia)發《關于加強互聯網化東航(hang)戰略法律(lv)服務保障指(zhi)導意見》。成立GDPR合規建設領導小組(zu)(zu)和工作小組(zu)(zu),任(ren)命數據保護官,東航(hang)成為國內首家設立數據保護官的企業。聘(pin)請專業機(ji)構,利用外(wai)部資源就GDPR相(xiang)關條款和具體事(shi)項提供法律(lv)建議。梳理(li)內部風(feng)險點,開展合規整(zheng)改(gai),發布隱私政(zheng)策,持續(xu)推進與供應商簽(qian)署相(xiang)關協議,明確(que)合作伙伴的數據保護義(yi)務和責任(ren)。目前,梳理(li)出的44項整(zheng)改(gai)項中除(chu)長期整(zheng)改(gai)項外(wai),其余已基本完成。
2.中(zhong)國(guo)商飛:中(zhong)國(guo)商飛深(shen)入學(xue)習(xi)貫(guan)(guan)徹(che)黨的十(shi)九大精(jing)神,認真(zhen)學(xue)習(xi)習(xi)近平(ping)新時代中(zhong)國(guo)特(te)色社(she)會主義思想,大力(li)推進法(fa)(fa)治(zhi)商飛建設。一是不斷強化第一責任(ren)人職(zhi)責貫(guan)(guan)徹(che)落(luo)(luo)實(shi)(shi)。董事長親自部署,親自動(dong)員,聽取(qu)匯(hui)報,提出(chu)要求(qiu)(qiu)。總經理(li)親自策(ce)劃(hua),將落(luo)(luo)實(shi)(shi)第一責任(ren)人職(zhi)責要求(qiu)(qiu)有效落(luo)(luo)實(shi)(shi)延伸至(zhi)各單位(wei)各部門(men)。切實(shi)(shi)強化領導干(gan)部法(fa)(fa)治(zhi)學(xue)習(xi),年度集中(zhong)學(xue)法(fa)(fa)時間達41小時。二是進一步提升風險(xian)防控能力(li),專門(men)成(cheng)立競爭對策(ce)專項(xiang)改革小組,深(shen)入開(kai)展法(fa)(fa)律(lv)(lv)合規(gui)研(yan)究(jiu),形成(cheng)《WTO貿易合規(gui)內部管理(li)指引》《美國(guo)出(chu)口管制(zhi)合規(gui)指引》等(deng)一系列研(yan)究(jiu)成(cheng)果。定期(qi)梳理(li)排查境外法(fa)(fa)律(lv)(lv)風險(xian),編(bian)制(zhi)人力(li)資(zi)源、產(chan)品責任(ren)等(deng)專業領域法(fa)(fa)律(lv)(lv)風險(xian)崗位(wei)防控指引。
