國務院國資(zi)委近(jin)日(ri)印發《中(zhong)央企業工(gong)資(zi)總額管理辦法》(國資(zi)委令(ling)第39號,以下(xia)簡稱《辦法》)。
《辦法》以(yi)習近平(ping)新時代中(zhong)國特(te)色社會主義思想為指引,以(yi)建立健全與勞動(dong)力市場基本(ben)(ben)適應、與企(qi)(qi)業經濟效益和勞動(dong)生(sheng)產率掛鉤(gou)的(de)工(gong)資(zi)決定和正常增長機制,增強企(qi)(qi)業活力和動(dong)力,促進企(qi)(qi)業實現(xian)高(gao)質量發展,推動(dong)國有資(zi)本(ben)(ben)做強做優(you)做大為目(mu)標,以(yi)出資(zi)人(ren)管資(zi)本(ben)(ben)為主強化激勵約(yue)束建設為遵循(xun),按照《國務院關于(yu)改革國有企(qi)(qi)業工(gong)資(zi)決定機制的(de)意(yi)見》(國發〔2018〕16號,以(yi)下簡稱《意(yi)見》)精(jing)神,在(zai)繼承以(yi)往有效經驗和做法的(de)基礎上,對(dui)現(xian)行(xing)中(zhong)央(yang)企(qi)(qi)業工(gong)資(zi)總額管理相關制度辦法進行(xing)修改和完善。
《辦法》明確對(dui)(dui)(dui)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)工(gong)(gong)資(zi)(zi)總額(e)實行分(fen)類(lei)(lei)管(guan)(guan)理(li)。對(dui)(dui)(dui)主業(ye)(ye)(ye)處(chu)于充分(fen)競(jing)爭行業(ye)(ye)(ye)和(he)領域的(de)商業(ye)(ye)(ye)類(lei)(lei)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)工(gong)(gong)資(zi)(zi)總額(e)預(yu)算(suan)原則上全(quan)部實行備(bei)案制管(guan)(guan)理(li),由企業(ye)(ye)(ye)董(dong)事(shi)(shi)(shi)會在(zai)依法依規的(de)前(qian)提下,自主決(jue)定(ding)年度工(gong)(gong)資(zi)(zi)總額(e)預(yu)算(suan),國(guo)資(zi)(zi)委由事(shi)(shi)(shi)前(qian)核(he)準轉變為事(shi)(shi)(shi)前(qian)引導、事(shi)(shi)(shi)中(zhong)監(jian)測和(he)事(shi)(shi)(shi)后監(jian)督;對(dui)(dui)(dui)主業(ye)(ye)(ye)處(chu)于關系國(guo)家安全(quan)、國(guo)民經濟命脈的(de)重要行業(ye)(ye)(ye)和(he)關鍵領域、主要承擔重大專(zhuan)項任務(wu)的(de)商業(ye)(ye)(ye)類(lei)(lei)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)和(he)以提供公(gong)(gong)共產品或服務(wu)為主的(de)公(gong)(gong)益類(lei)(lei)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye),工(gong)(gong)資(zi)(zi)總額(e)預(yu)算(suan)繼(ji)續實行核(he)準制管(guan)(guan)理(li);對(dui)(dui)(dui)開展國(guo)有資(zi)(zi)本投資(zi)(zi)、運營公(gong)(gong)司或者(zhe)混合所有制改革等試點的(de)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye),提出可(ke)以探(tan)索實行更加(jia)靈活高效(xiao)的(de)工(gong)(gong)資(zi)(zi)總額(e)管(guan)(guan)理(li)方(fang)式(shi)。
《辦(ban)法》明確對中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)(gong)資(zi)(zi)總(zong)額實(shi)(shi)行分(fen)(fen)級(ji)管(guan)(guan)(guan)(guan)理(li)。按照(zhao)《中(zhong)(zhong)共中(zhong)(zhong)央(yang) 國(guo)務院關于深化國(guo)有企(qi)業(ye)(ye)改革的指導意見》(中(zhong)(zhong)發(fa)〔2015〕22號(hao),以下簡稱中(zhong)(zhong)發(fa)22號(hao)文件(jian))、《國(guo)務院辦(ban)公廳關于轉發(fa)國(guo)務院國(guo)資(zi)(zi)委(wei)以管(guan)(guan)(guan)(guan)資(zi)(zi)本為主推進(jin)職能(neng)轉變方(fang)案的通知》(國(guo)辦(ban)發(fa)〔2017〕38號(hao))要求,結合當前中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)(gong)資(zi)(zi)總(zong)額管(guan)(guan)(guan)(guan)理(li)實(shi)(shi)際,強調中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)(gong)資(zi)(zi)總(zong)額實(shi)(shi)行分(fen)(fen)級(ji)管(guan)(guan)(guan)(guan)理(li)體制,國(guo)資(zi)(zi)委(wei)與(yu)中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)權責清(qing)晰、各司其職,國(guo)資(zi)(zi)委(wei)負責管(guan)(guan)(guan)(guan)制度(du)、管(guan)(guan)(guan)(guan)總(zong)量(liang)、管(guan)(guan)(guan)(guan)監督(du),中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)負責管(guan)(guan)(guan)(guan)內部自主分(fen)(fen)配(pei)、管(guan)(guan)(guan)(guan)預算分(fen)(fen)解(jie)落(luo)實(shi)(shi)、管(guan)(guan)(guan)(guan)具體操(cao)作執(zhi)行。
《辦法》緊緊圍繞中(zhong)發(fa)22號文件和《意見》關于(yu)“建立健(jian)全與(yu)(yu)勞動力市(shi)場(chang)基本(ben)適應、與(yu)(yu)企(qi)(qi)(qi)業(ye)經濟效(xiao)益(yi)(yi)和勞動生產(chan)率掛鉤的(de)工(gong)(gong)(gong)資(zi)(zi)決(jue)定(ding)(ding)和正常增(zeng)(zeng)長(chang)(chang)(chang)機制”的(de)要求,明確(que)(que)規(gui)定(ding)(ding)中(zhong)央(yang)企(qi)(qi)(qi)業(ye)工(gong)(gong)(gong)資(zi)(zi)總額(e)(e)預算主要按(an)照(zhao)效(xiao)益(yi)(yi)決(jue)定(ding)(ding)、效(xiao)率調整(zheng)、水(shui)平(ping)(ping)(ping)調控三個環(huan)節決(jue)定(ding)(ding)。一是中(zhong)央(yang)企(qi)(qi)(qi)業(ye)工(gong)(gong)(gong)資(zi)(zi)總額(e)(e)預算與(yu)(yu)利潤(run)總額(e)(e)等經濟效(xiao)益(yi)(yi)指(zhi)(zhi)標(biao)的(de)業(ye)績(ji)考核目標(biao)值掛鉤,并且根據目標(biao)值的(de)先進(jin)程度(du)確(que)(que)定(ding)(ding)不(bu)(bu)同(tong)(tong)的(de)預算水(shui)平(ping)(ping)(ping),引導中(zhong)央(yang)企(qi)(qi)(qi)業(ye)通過(guo)完成高質量發(fa)展目標(biao),帶(dai)動職工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)總額(e)(e)合理(li)有序增(zeng)(zeng)長(chang)(chang)(chang)。二是工(gong)(gong)(gong)資(zi)(zi)增(zeng)(zeng)長(chang)(chang)(chang)還應當通過(guo)人工(gong)(gong)(gong)成本(ben)投入產(chan)出(chu)效(xiao)率、勞動生產(chan)率等指(zhi)(zhi)標(biao)對(dui)標(biao)進(jin)行調整(zheng),進(jin)一步協調不(bu)(bu)同(tong)(tong)效(xiao)率的(de)企(qi)(qi)(qi)業(ye)之間(jian)工(gong)(gong)(gong)資(zi)(zi)分(fen)配(pei)關系,提高企(qi)(qi)(qi)業(ye)工(gong)(gong)(gong)資(zi)(zi)總額(e)(e)決(jue)定(ding)(ding)機制的(de)科(ke)學(xue)性與(yu)(yu)有效(xiao)性。三是注重收入分(fen)配(pei)公平(ping)(ping)(ping),國資(zi)(zi)委(wei)將按(an)照(zhao)國家有關部(bu)門發(fa)布的(de)工(gong)(gong)(gong)資(zi)(zi)指(zhi)(zhi)導線和對(dui)非競(jing)爭類國有企(qi)(qi)(qi)業(ye)的(de)工(gong)(gong)(gong)資(zi)(zi)調控要求,對(dui)部(bu)分(fen)工(gong)(gong)(gong)資(zi)(zi)水(shui)平(ping)(ping)(ping)偏高、過(guo)高的(de)行業(ye)與(yu)(yu)企(qi)(qi)(qi)業(ye),尤其是主業(ye)不(bu)(bu)屬于(yu)充分(fen)競(jing)爭行業(ye)和領域的(de)企(qi)(qi)(qi)業(ye)工(gong)(gong)(gong)資(zi)(zi)增(zeng)(zeng)長(chang)(chang)(chang)過(guo)快的(de)情況進(jin)行適當約束,確(que)(que)保企(qi)(qi)(qi)業(ye)職工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)的(de)水(shui)平(ping)(ping)(ping)與(yu)(yu)增(zeng)(zeng)長(chang)(chang)(chang)幅度(du)更加公平(ping)(ping)(ping)合理(li)、規(gui)范(fan)有序。同(tong)(tong)時(shi),對(dui)中(zhong)央(yang)企(qi)(qi)(qi)業(ye)承擔重大(da)(da)專(zhuan)項(xiang)任務、重大(da)(da)科(ke)技創新項(xiang)目等特(te)殊事項(xiang)的(de),《辦法》也明確(que)(que)將予以適度(du)支持(chi)。
《辦法》在從宏觀層面(mian)完善國家、企(qi)(qi)(qi)(qi)業和(he)職工(gong)(gong)三者工(gong)(gong)資分(fen)配關系,加大出資人(ren)(ren)向中央企(qi)(qi)(qi)(qi)業董事會授權(quan)的(de)同時,也(ye)同步對責(ze)任落實和(he)制(zhi)度配套進行了(le)規定。一是(shi)(shi)強調企(qi)(qi)(qi)(qi)業作為內部(bu)分(fen)配的(de)責(ze)任主體(ti),應(ying)當(dang)持續深化內部(bu)三項制(zhi)度改革,構建企(qi)(qi)(qi)(qi)業內部(bu)管(guan)理人(ren)(ren)員(yuan)能(neng)上(shang)能(neng)下、員(yuan)工(gong)(gong)能(neng)進能(neng)出、收(shou)入能(neng)增能(neng)減的(de)市場化勞(lao)動用工(gong)(gong)和(he)收(shou)入分(fen)配管(guan)理機制(zhi),切實承擔起搞好(hao)、搞活企(qi)(qi)(qi)(qi)業內部(bu)分(fen)配的(de)職責(ze)。二是(shi)(shi)加強監(jian)督檢(jian)查,明(ming)確(que)界定企(qi)(qi)(qi)(qi)業違規責(ze)任,并將企(qi)(qi)(qi)(qi)業工(gong)(gong)資總額管(guan)理情(qing)況納入各(ge)項監(jian)督檢(jian)查范(fan)圍,與審計、巡視(shi)等(deng)工(gong)(gong)作形成合(he)力(li),確(que)保實現權(quan)責(ze)對等(deng),監(jian)管(guan)到位。
